E-Scooter Laws Around the World: Country-by-Country Map (2026)

Is it legal to ride an e-scooter?

Ask that question and the honest answer is always "it depends which country, and often which city." Some countries treat a privately owned e-scooter as an ordinary motor vehicle that needs a plate, insurance, and a licence category that may not even exist yet. Others exempt it from all of that. A few make the only lawful e-scooter one you rent from a licensed operator inside a government-approved area, with private ownership staying illegal everywhere else. The comparison below is organized country by country because that is genuinely the smallest unit where the question has a single answer, and for Canada, Australia, and the United States even that is too coarse, since the rule changes again by province, territory, or state.

The distinction that trips up the most readers is private ownership versus rental. A country that bans private e-scooters outright, like the United Kingdom, can still have thousands of legal rental e-scooters operating on the same streets under a completely separate legal framework, because the rental operator supplies the insurance or licence category a private owner cannot obtain. Conversely, a country where private e-scooters are fully legal, like France or Italy, may still restrict or ban a specific rental business model in a specific city while private ownership stays untouched everywhere else. Never assume the answer for one applies to the other, and always check both separately for the country you care about.

The five legal models

Despite all the country-level variation, most of the 16 jurisdictions in this guide fall into one of five broad patterns.

Legal nationally, no special approval needed

In France, a compliant EDPM (engin de deplacement personnel motorise) is legal for anyone aged 14 or over to own and ride under a single national framework set by Decret n. 2019-1082 and the Code de la route, with no municipal licence, registration, or rental-only carve-out standing between an ordinary rider and the road. Switzerland's E-Trottinett category works much the same way: no plate, no registration, and no insurance requirement at all, just a national vehicle-technical standard (VTS Art. 18 Bst. b) and an age floor.

Legal, but it varies below the national level

Canada has no federal e-scooter law at all. Ontario and British Columbia run province-level pilot regulations that individual municipalities must separately opt into (Toronto has opted out and bans e-scooters outright, while Ottawa has extended its pilot to 2029), Quebec runs a provincewide pilot that needs no municipal opt-in, Prince Edward Island has standing permanent legislation rather than a time-limited pilot, and Alberta has no framework permitting personal e-scooters on public roads (shared rental fleets operate in cities such as Calgary under separate arrangements). Australia shows the same pattern state by state, from New South Wales' current ban on private use to Victoria's permanent legalization since October 2024.

Rental-only, private ownership stays illegal

The United Kingdom is the clearest example. A privately owned e-scooter has no lawful route onto a public road anywhere in the UK, because it is treated as a motor vehicle under the Road Traffic Act 1988 with no insurance product or licence category that covers it. The only lawful way to ride one in public is inside a government-approved rental trial, where the operator supplies the third-party insurance and the licence category the rider needs, currently authorized to run until at least 31 May 2028.

Effectively prohibited on public roads

South Africa has no dedicated e-scooter category in its national traffic law. The National Road Traffic Amendment Act 8 of 2024 created two new vehicle exemptions, but neither actually covers a standard kick-style e-scooter (one requires pedals, the other is an undefined "environmentally friendly vehicle" category with no published implementing regulations found), so a private e-scooter defaults to the general "motor vehicle" definition with no registration pathway available. In practice this leaves it not road-legal, a position South African municipalities such as Stellenbosch have enforced against the same rental operator twice, in 2020 and again in 2026.

Folded into a moped-style licensing regime

The Netherlands is the outlier that surprises the most readers, because a standing kick-style e-step is legally a "bijzondere bromfiets" (special moped), not a bicycle. It needs type approval from the Netherlands Vehicle Authority (RDW), a kenteken registration plate (mandatory for new approvals since 1 July 2025), and third-party liability insurance, the same building blocks an ordinary moped needs, just under a narrower, device-specific version of that regime.

Why enforcement doesn't equal legality

Every country in the comparison table above has places where private e-scooters are ridden constantly despite being illegal, and every country has cities where police issue far fewer citations than the law on the books would allow. Neither fact changes what the law actually says. A light enforcement pattern is not a legal exception, and a heavily reported crackdown is not new law, it is an existing rule being enforced more visibly than before.

Italy's own rollout illustrates this well. The Ministry of Infrastructure and Transport reported over 133,000 identification marks issued nationally by 30 June 2026, alongside separate reports of thousands of roadside checks in Rome and Milan since the insurance and identification-mark mandates took effect. That enforcement activity confirms the rules are being applied, it does not create a new legal status, and a device without its mark or insurance stays non-compliant whether or not a given rider has been stopped yet.

The reverse pattern shows up just as often. South African authorities have taken the same enforcement position against the same rental operator twice, six years apart (Stellenbosch Municipality in 2020, and the municipality again in 2026 with national Department of Transport backing), specifically because no dedicated e-scooter law exists there to create room for a different reading. A gap in enforcement resources is not the same thing as a gap in the law, and neither one should be read as permission to ride.
