China E-Scooter Laws: No National Right, Beijing and Shanghai Ban Them (2026)

Are e-scooters legal in China?
There is no dedicated national vehicle category, and no national vehicle-type-approval standard, for true stand-up e-scooters in China, unlike the standard that exists for e-bicycles. The closest national text is Article 74 of the Regulations for the Implementation of the Road Traffic Safety Law, which bars pedestrians from using skateboards, roller skates, and similar sliding tools on the road. That clause does not name e-scooters specifically, but the consistent reading, in press coverage and by the absence of any type-approval pathway, is that e-scooters have no national road right.
Practically, this is a subnational story. Individual cities set and enforce their own rules, and the two largest, Beijing and Shanghai, have both codified explicit bans.
Local and regional variation
- Beijing: A newly recodified Beijing Non-Motor Vehicle Management Regulation takes effect May 1, 2026. Article 21 bars scooters, self-balancing wheels, unicycles, and similar devices from the road entirely, beyond a specific short list of permitted non-motor vehicles, such as registered and plated e-bicycles, mobility wheelchairs, standards-compliant bicycles, and human- or animal-powered vehicles. Article 45 sets the penalty at a warning or a fine of 10 to 50 yuan.
- Shanghai: City traffic police classify e-scooters, self-balancing wheels, and unicycles as unregistered mobility tools barred from the road. A first offense draws a 100 yuan fine. A second or later offense means the vehicle is confiscated plus a 500 yuan fine. Skateboards and roller skates get lighter treatment, a warning for the first two offenses and 50 yuan from the third.
- Other cities: Guangzhou, Shenzhen, and other major cities were not individually checked in this research. Treat a similar pattern as likely, not confirmed, city by city.
What counts as an e-scooter here
No national type-approval definition exists for e-scooters. A separate, newer national standard for e-bicycles, GB 17761-2024, effective September 1, 2025 and fully enforced from December 1, 2025, governs a different, adjacent product, pedal e-bicycles, not scooters, and caps e-bicycle design speed at 25 km/h. That standard's figures should not be borrowed for e-scooter reporting.
Rental
No significant dockless e-scooter-share sector was found operating in mainland Chinese cities in this research, a sharp contrast to the country's large e-bicycle and bike-share markets.

Enforcement in practice
Enforcement is routine in Beijing and Shanghai, both of which run active campaigns with escalating fines for repeat offenders. In smaller cities, enforcement intensity is a documented data gap in this research. Riders should not assume a lighter rule simply because a particular city has not been individually checked.
Enforcement patterns do not change the underlying legal position. Being unaware of a specific municipal rule is not a defense against it.
