Are e-scooters legal in South Korea?
Yes, but with more friction than most countries in this region. E-scooters fall under South Korea's personal mobility device (PMD) category within the Road Traffic Act. Since a May 13, 2021 amendment, riding one legally requires holding at least a moped-class license, not just meeting an age minimum. That makes the framework closer to a light-moped regime than the license-free micromobility rules common elsewhere in Asia.
This applies the same way to privately owned devices and to rental devices from shared fleets that operate in Seoul and other cities.
What counts as an e-scooter here
Korean legal guides commonly describe a personal mobility device as a motorized bicycle whose motor disengages once the device reaches 25 km/h, and that weighs under 30 kg, meeting further government-specified standards. This research could not directly confirm that exact wording against the primary statute text, since the government's own law database was unreachable during research. Treat the substance, a licensed, helmet-required, motor-disengaging-at-25km/h device, as the reliable part, not the precise legal phrasing.
Rider rules
- License: at least a moped-class license (wondongi jangchi jajeongeo myeonheo), which carries a 16-year age floor of its own. There is no personal-mobility-device-specific age rule separate from this license requirement.
- Helmet: mandatory since May 13, 2021. Failing to wear one carries a 20,000 won fine.
- Passengers: personal mobility devices are single-rider vehicles. Carrying a passenger carries a 40,000 won fine, though throttle e-bikes may carry two.
- History: a brief December 2020 rule had opened these devices to unlicensed riders as young as 13. That rule was reversed after public backlash, leading to the current May 2021 license-and-helmet regime.

Enforcement in practice
Statutory fines exist for the violations above, but street-level license checks are reportedly uncommon in everyday riding. Enforcement is more visible for high-profile violations, such as tandem riding or riding under the influence, than for routine license or paperwork stops.
That gap between the rule on the books and everyday policing is part of why lawmakers are debating loosening, not tightening, the requirement for rental riders specifically. Enforcement patterns do not change the underlying legal requirement to hold a license and wear a helmet.
Legal history and what may change
A National Assembly Land, Infrastructure and Transport Committee subcommittee was still debating a bill, as of a reconvened session on April 28, 2026, that would let rental operators verify a rider's age (16 and older), identity, and completion of safety education INSTEAD OF checking a license. The push follows industry pushback over falling rental usage, with roughly 70 percent of scooter-share subscribers reportedly in their 20s.
This is a proposed change, not current law, and it would apply only to rental operators, not to the underlying license requirement for privately owned devices. Separately, the Korean National Police Agency has floated introducing a dedicated personal-mobility-device license, distinct from the moped license, an idea also raised without success in 2021 and 2023 proposals to the National Assembly. Neither change has been enacted as of this writing.
