Are e-scooters legal in Hong Kong?

No, not currently. Hong Kong has no dedicated vehicle category for e-scooters or other electric mobility devices (EMDs). Instead, the Road Traffic Ordinance (Cap. 374) classifies any mechanically propelled vehicle as a motor vehicle, and because EMDs have no type-approval pathway that would let them be registered or licensed, using one on a carriageway, footpath, or cycle track can be prosecuted under the same offense that applies to any unregistered, unlicensed motor vehicle. Private ownership and rental use are treated the same. Neither is currently authorized.

What counts as an e-scooter here

The Road Traffic Ordinance's motor vehicle definition is broad and was not written with e-scooters in mind. It sweeps in electric scooters, e-unicycles, e-hoverboards, e-skateboards, and even e-bicycles, since none of them has a route to registration under current law.

Where you can ride

Nowhere in public, under current law. The Transport Department states plainly that using an EMD on a carriageway, footpath, or cycle track may commit an offense, and its own guidance is that currently, any use of EMDs may be illegal. No official guidance addresses a private-property carve-out beyond that statement.

Rider rules

There are no rider rules, such as age, helmet, or license requirements, currently in force for EMDs, because the devices have no lawful path onto the road at all. Any such rules exist only in the government's PROPOSED framework described below, not as current law.

Penalties

Riders face prosecution under Section 52 of the Road Traffic Ordinance for operating an unregistered and unlicensed vehicle. On first conviction, that carries a fine at level 2, currently HK$5,000, and up to 3 months' imprisonment. Because there is no purpose-built micromobility offense, this is a materially harsher maximum exposure than jurisdictions that regulate e-scooters with a scooter-specific fine schedule.

Enforcement in practice

The Transport Department's own position is that enforceability against modern EMDs is legally untested, since the law predates the devices and no case appears to have produced a definitive court judgment. Day-to-day, anecdotal and tourist reporting suggests light enforcement despite the harsh statutory ceiling.

That gap between a severe maximum penalty and reportedly light routine enforcement does not change the legal position. Using an EMD in public remains an offense today, and light enforcement is not permission.

Legal history and what may change

Hong Kong has run only closed-track trials so far, at Pak Shek Kok and at Tseung Kwan O South in 2021, both time-limited and already concluded. There is no live public pilot as of this writing, despite that framing sometimes appearing in casual coverage.

Separately, the government announced in July 2025 that it intends to submit a Bill amending the Ordinance, plus new subsidiary legislation, to the Legislative Council for scrutiny in 2026. Per the government's own reply to a Legislative Council question, the proposed framework would set a minimum age of 16 and require a helmet, restrict use to certified, labelled devices on designated cycle tracks opened in phases, and separately allow power-assisted pedal cycles on all cycle tracks. Some media reporting describes a proposed 25 km/h speed cap with an automatic power cutoff, though this research treats that figure as reported, not yet confirmed as final legislative text. None of this is law yet. It is a legislative proposal still moving toward introduction.
