Austria E-Scooter Laws: Speed, Age, and Helmet Rules After the 2026 Reform

This article covers the federal rules in the Straßenverkehrsordnung (StVO), Austria's road traffic act, which apply everywhere in the country, plus the municipal layer Vienna has added for shared rental scooters. It does not cover Germany, Switzerland, or any other neighbouring country; see the comparison guide linked at the end for those.

The legal position

What changed on 1 May 2026

On 1 May 2026, the 36. StVO-Novelle, the 36th amendment to the Straßenverkehrsordnung, took effect and substantially reworked the rules for e-scooters. An official press release from BMIMI, the responsible federal ministry, confirms the reform formally declares e-scooters to be vehicles in their own right and raises the power and speed ceiling for the category to 600 watts and 25 km/h, up from the 250-watt limit that applied before. The Austrian motorists' association ÖAMTC corroborates the same figures in its own explainer of the reform, and the change was also carried on the OTS press-release wire.

This is a recent increase, not a static rule. If you see older material describing a 250-watt e-scooter category in Austria, treat it as describing the law before 1 May 2026, not the current rule.

Before the reform, the operative provision sat at § 88b StVO ("Rollerfahren"). Some secondary reporting states that BGBl. I Nr. 17/2026 renumbered this provision to § 68a StVO, but Austria's RIS legal database (ris.bka.gv.at) returned a server error on repeated attempts made while researching this article, so that exact new paragraph number could not be independently confirmed against the official text. This article therefore cites the 36. StVO-Novelle as the enacting reform rather than asserting an unverified section number as settled fact.

Where you can ride

The reform ties e-scooter riding to the same infrastructure bicycles use. Where a dedicated bike path (Radweg) exists, riders must use it, in the correct direction. Where no bike path exists, riders may use the roadway wherever cycling is otherwise permitted. Pedestrian zones are open to e-scooters only where local signage specifically authorizes it, and then only at walking speed, the same standard that applies in Wohnstraßen (residential streets) and other traffic-calmed encounter zones.

Sidewalks (Gehsteige) remain off-limits to e-scooters in the general case. This is unchanged by the 2026 reform.

Age: no rider under 12 without supervision

A child under 12 may not ride an e-scooter alone. They may ride only if supervised by someone at least 16, unless the child holds a Radfahrausweis, Austria's child cycling-proficiency licence. The reform does not set out a separate stated minimum age above 12; in practice, the effective floor is a child who holds that cycling licence, or is 12 or older.

Helmet: mandatory under 16

A helmet is now mandatory for any e-scooter rider under 16. This is a new, higher threshold introduced by the 1 May 2026 reform; earlier informal reporting had described the helmet duty as tied to a lower age. Riders who are 16 or older are not legally required to wear a helmet, though wearing one is still good practice on a device that reaches 25 km/h.

Do not confuse this with the separate e-bike helmet rule. For e-bikes, the same reform widened the helmet duty to riders until they complete their 14th year, up from the previous under-12 threshold. E-bikes are capped at 250 watts and 25 km/h, a different legal category from the 600-watt e-scooter class described in this article, and the two helmet ages should not be swapped.

Equipment now required on every e-scooter

The 36. StVO-Novelle adds a full equipment mandate that did not previously apply to e-scooters:

Alcohol limit: 0.5 per mille

Other riding restrictions

Only one rider is permitted per e-scooter; carrying a passenger is not allowed. Cargo is restricted to small, fixed roller-bag-type containers; towing a trailer, or being towed, is prohibited. A mobile phone may be used only hands-free while riding, the same standard that applies to cyclists.

No licence, insurance, or plate required

Within the 600 W / 25 km/h e-scooter category, Austria requires no driving licence, no third-party insurance, and no number plate. This applies to a privately owned e-scooter. It is a separate question from Vienna's municipal plate requirement for rental fleets, covered below, which is a local rule and not a national one.

Private scooters and rental scooters follow the same national rules

The speed and power cap, helmet-under-16 rule, equipment mandate, and alcohol limit above apply identically whether the e-scooter is privately owned or rented from an operator. Austria's national rules do not create a separate legal category for rental devices. Where rental scooters differ is at the municipal level, most visibly in Vienna, where an operator-licensing and parking regime sits on top of the national rules described above.

E-mopeds: classified as motor vehicles since 1 October 2026

A separate change affects e-mopeds, a faster and more powerful category than the e-scooter class covered in this article. Since 1 October 2026, e-mopeds have been classified as motor vehicles, which brings registration, insurance, a driving licence, and a helmet requirement, and removes access to cycling infrastructure (e-mopeds are confined to the roadway, without cycle-path access, and barred from riding against one-way traffic).

That reclassification took effect on 1 October 2026, so e-moped registration, insurance, and licence duties now apply.

Penalties

Austria has no single, dedicated e-scooter fine catalogue. Violations instead fall under general administrative criminal law (Verwaltungsstrafrecht), which gives authorities a discretionary statutory range, commonly reported as roughly 7 to 726 euros, with the exact amount set case by case depending on the violation and circumstances. A commonly cited on-the-spot Organmandat figure for sidewalk riding is around 36 euros, with a maximum of 726 euros if the matter is instead referred to the district authority.

These figures come from vehicle-sector and consumer-legal reporting rather than a single published statutory fine table, so treat them as a general guide and confirm the current amount with a lawyer or your local Bezirkshauptmannschaft before assuming a specific figure applies to a specific situation.

The "10,000 euro fine" is not Austrian law

A widely shared claim states that e-scooter riders in Austria can be fined 10,000 euros. That figure does not come from Austrian law. It traces back to a South Korean case involving a man riding an e-scooter while intoxicated, used in Austrian consumer reporting as an international comparison point, not as a description of an Austrian penalty. Austria, as described above, has no dedicated e-scooter fine schedule at all, let alone one that reaches five figures.

Enforcement in practice

Austria's federal police do not appear to publish a nationwide aggregate of e-scooter citations or seizures comparable to what some other countries' police forces release. Coverage of individual enforcement actions exists at the regional and local level, but no single official statistic captures how often the rules above are actually enforced nationwide.

The absence of a published national enforcement statistic does not change what the law requires. The 600 W / 25 km/h category definition, the under-16 helmet rule, the equipment mandate, and the 0.5 per mille alcohol limit all apply regardless of how visibly a given district is enforcing them, and a quiet enforcement pattern in one area is not permission to disregard the underlying rule.

Vienna: the local variation

Vienna layers its own municipal rules on top of the national framework, mainly aimed at the shared rental fleets. Under the city's E-ScooterVO ordinance, rental operators must use designated, red-marked parking zones, each sized for roughly 8 to 10 scooters. Vienna also enforces a blanket parking ban within 100 metres of each such zone, which covers bike infrastructure too, so a rental scooter cannot simply be left in a cycle lane just outside the zone's radius.

Outside that 100-metre buffer, parking is permitted only in the designated parking lane. Additional no-go zones apply near landmarks including the Staatsoper, Rathausplatz, and the Albertina.

Since 1 July 2023, the City of Vienna has limited itself to two rental concessions citywide, according to the city's own official page. Some later reporting has referenced a larger number of operators following a subsequent tender round; the city's official page, current as of this article's verification date, still states two concessions, so treat any figure above two as unconfirmed until the city updates that page.

Fleet size is capped by district: up to 250 scooters in the Innere Stadt (Vienna's first district) and up to 750 across districts 2 through 9 plus district 20. Rental operators must use GPS geofencing that automatically reduces scooter speed near hospitals, markets, and in pedestrian zones, and every rental unit must carry a municipal number plate (Nummernschild). That plate requirement is a Vienna-specific rule for rental fleets; it does not apply to privately owned e-scooters, and no equivalent national plate requirement exists for the e-scooter category described earlier in this article.

Since 1 May 2026, the national helmet-under-16 rule and the equipment mandate apply to Vienna's rental scooters exactly as they do to private ones; no Vienna-specific carve-out from those national rules has been found.
