E-Scooter Laws in Canada: Province-by-Province Rules (2026)

This article is general information about e-scooter laws across Canada's provinces and territories and is not legal advice. Municipal rules change frequently and can override what the province allows, so confirm the current bylaw with your own municipality before riding, or consult a lawyer licensed in your province. Information last verified on 23 July 2026.

This article covers e-scooter law in Canada at the provincial and municipal level, since there is no federal e-scooter statute. It addresses personal e-scooters and, where relevant, shared rental fleets, in Ontario, British Columbia, Quebec, Alberta, Manitoba, Saskatchewan, Nova Scotia, and Prince Edward Island. Coverage for New Brunswick, Newfoundland and Labrador, and the three territories is limited, and that gap is stated plainly rather than filled with a guess.

No federal law: how the two-layer system works

Canada has no Criminal Code provision, no federal Motor Vehicle Safety Act regulation, and no national standard that legalizes or bans e-scooters. Regulation happens provincially, almost always through a time-limited pilot made under the province's own highway or traffic act. Prince Edward Island is the only jurisdiction here with a standing, non-expiring regulation rather than a pilot.

Most provinces add a second layer: a municipal opt-in. Ontario's O. Reg. 389/19 deems a compliant e-scooter not a motor vehicle (s. 1(2)), but preserves any municipal bylaw governing motorized vehicles (s. 1(3)). That clause is why an e-scooter can be legal under the province and still illegal on a specific city's streets: Toronto has not opted in and still bans e-scooters, while Ottawa, in the same province, opted in and extended its program to 2029.

Alberta and Manitoba go further. Alberta bans personal e-scooters provincewide regardless of what a municipality wants, permitting only ministerial-exemption rental fleets. Manitoba has no framework in force at all yet: a bill has passed the legislature but has not been proclaimed.

Province-by-province comparison

The table below summarizes personal e-scooter status as of July 23, 2026. "Pilot" means the regulation has a built-in expiry date; "permanent" means it does not.

Ontario: a 2029 pilot, but Toronto still says no

Ontario regulates e-scooters under O. Reg. 389/19, Pilot Project, Electric Kick-Scooters, made under the Highway Traffic Act. Section 1(1) defines an e-scooter by its two-wheel, standing-platform design and a motor capped at 500 watts and 24 km/h; section 1(2) deems a compliant device not a motor vehicle, so no licence or insurance is required. Riders must be 16 or older (s. 7(1)), and a helmet is mandatory only under 18. O. Reg. 398/24, s. 1 rewrote the sunset clause, so the pilot is now revoked on November 27, 2029, and Ontario's guidance states a fine range of $250 to $2,500.

The catch is section 1(3): any municipal bylaw governing motorized vehicles still applies, so a municipality must separately opt in. Toronto has not, and its page, last modified July 22, 2026, confirms the ban remains in effect. Ottawa opted in and, in April 2025, extended its shared program through 2029; personal e-scooters are also legal there, at a city speed limit of 20 km/h and a $150 fine for sidewalk riding.

British Columbia: a second four-year pilot, all-ages helmets

British Columbia regulates under the Electric Kick Scooter Pilot Project Regulation, B.C. Reg. 247/2023. An earlier pilot ran 2021 to 2024; the current one runs April 5, 2024 to April 5, 2028, again only in "participating communities" that have opted in. Riders must be 16 or older, with no licence or insurance required, and device limits track Ontario's closely except the speed capability is 25 km/h.

The clearest contrast with Ontario: British Columbia requires a helmet for every rider, not just minors. Riding is limited to bike lanes or the right side of roads posted 50 km/h or under; sidewalks and crosswalks are off-limits unless specifically signed. The province states a $109 fine on its official rider guidance; higher figures circulate but were not verified against the regulation for this article.

Quebec: a rule that changed days before this was written

Quebec's e-scooter pilot, the Projet pilote relatif aux appareils de transport personnel motorisés (ATPM), made under C-24.2, r. 39.1.002, is a "device family" pilot also covering electric unicycles, and first took effect July 20, 2023. Its enabling provision, art. 633.1 of the Code de la sécurité routière, caps a ministerial pilot at three years plus one possible two-year extension, so the original pilot would have expired July 20, 2026.

Arrêté numéro 2026-10, signed June 29, 2026 and published in the Gazette officielle du Québec on July 3, 2026, used that full extension, pushing the pilot to July 20, 2028. Under the standard 15-day rule for gazetted regulations, the amendment took effect around July 18, 2026, only days before this article's research was completed. Two earlier, narrower Quebec e-scooter regulations that predate the current pilot have already been repealed and are not current law.

The amendment did more than move the date. New article 3.1 confirms the pilot also applies on private roads open to public traffic and on lands like shopping-centre lots. New article 19.1, for the first time, caps the rider's own speed at 25 km/h, separately from the device's existing 25 km/h motor cutoff. The fine schedule was restructured into a $200 tier (weight and the new rider speed-conduct rule) and a $100 tier (other equipment non-compliance).

Riders must be at least 14, carry ID, and wear a helmet; hands-free device users also need elbow pads, knee pads, closed shoes, and full-finger gloves. E-scooters may use roads posted 50 km/h or under and adjoining bike lanes, but not faster roads except to cross, use a linking roundabout, or ride a physically protected cycle track.

Alberta: still banned for personal use

Alberta treats motorized scooters, electric or gas, as prohibited miniature vehicles under the Traffic Safety Act: they cannot be ridden on roadways or sidewalks, and a municipality cannot legalize personal e-scooters on its own. The only path to a legal fleet is a ministerial exemption for a shared rental program. An Alberta Municipalities resolution current to August 2025 confirms the province's response addressed a separate golf-cart pilot, not e-scooters, and the personal-use legalization request was not granted.

Calgary runs a shared program with Bird Canada and Neuron under city permits, current as of July 18, 2026: riders must be 18 or older, helmets are encouraged but not required, and the speed limit is 20 km/h, reduced to 15 km/h in designated slow zones. Fines run $400 for reckless operation, $400 for a collision, and $75 for a passenger. Other Alberta municipalities ran similar exemption pilots from 2019 per a 2023-vintage source; their 2026 status was not re-verified here.

Manitoba: a bill that passed but isn't law yet

Manitoba is the clearest "enacted but not in force" trap in this article. Bill 43, The Highway Traffic Amendment and Drivers and Vehicles Amendment Act, passed third reading, but its own text sets its coming into force by proclamation, and none had been made as of July 23, 2026. Today, the Highway Traffic Act does not classify e-scooters as bicycles, motorcycles, or motor vehicles, leaving no clear lawful path onto a public road.

If proclaimed, Bill 43 would create a "personal electric vehicle" category covering e-scooters, e-skateboards, and unicycles, with a combined 500-watt motor limit, a 32 km/h device ceiling, and a lower 25 km/h rider cap. It would set a minimum age of 16 and require a helmet for all ages, with a private-property exception. None of this is enforceable today; treat Manitoba's status as unresolved until proclaimed.

Saskatchewan: provincial ban, Saskatoon opts out of it

Saskatchewan does have a real provincial framework: The Limited Speed Motor Vehicle Regulations (T-18.1 Reg 19, effective September 15, 2022) define an electric kick scooter (500 W, 24 km/h, 45 kg, no seat), set a minimum age of 16 and a mandatory helmet, and require no registration or licence. The catch is s.6(2): an e-scooter may be operated on a highway only where the municipality has enacted a bylaw governing it, so absent a local bylaw, riding on public roads in that community remains unlawful. Saskatoon passed exactly that bylaw amendment on September 24, 2025, legalizing personal e-scooters on the public right-of-way under the same rules as its shared Neuron fleet, and Regina permits both shared and personal riding under its Traffic Bylaw.

Nova Scotia and Prince Edward Island: two ways to make it permanent

Nova Scotia amended its Motor Vehicle Act in April 2022 to exclude e-scooters from the definition of "motor vehicle" and treat riders as cyclists, with a minimum age of 14, a provincial speed ceiling of 32 km/h, and a mandatory helmet; municipalities may set stricter local rules. Halifax's Micromobility By-law (M-300), effective July 15, 2023, allows riding on roads posted 50 km/h or under, bike lanes, and a specific list of multi-use pathways, at 25 km/h on the roadway and 15 km/h on a pathway; sidewalks are banned.

Prince Edward Island is the one province here where e-scooters are not on a pilot at all. The Electric Kick-Scooters Regulations (EC863/22) carry no revocation clause, and the device definition mirrors Ontario's closely, but PEI departs in two ways: the helmet rule applies to every rider, not just those under 18, and e-scooters are barred only above 60 km/h, a higher ceiling than Quebec's or Ontario's 50 km/h cutoff. Section 11 sets a penalty of $200 to $2,000 on summary conviction.

New Brunswick, Newfoundland and Labrador, and the territories: the honest gaps

No dedicated e-scooter regulation was found for New Brunswick after searching the Motor Vehicle Act; its registration rules address "electric motor driven cycles" built to a limited-speed-motorcycle standard, a different, moped-style category, not a kick-scooter carve-out. This is a genuine gap, not a confirmed ban or permission, and a New Brunswick reader should check with their own municipality.

Non-government sources describe rules for Newfoundland and Labrador, but none were confirmed against a government or CanLII source for this article, so they are not repeated here. The Yukon, Northwest Territories, and Nunavut were not researched at all. Both gaps are stated so a reader there knows to check directly with their own government rather than assume an unconfirmed rule.

Enforcement in practice

Several jurisdictions publish their own fine schedules: Ontario states $250 to $2,500 under the pilot regulation; British Columbia states $109 plus up to $2,000 in further penalties or impoundment; Quebec sets $200 for weight or rider speed-conduct violations and $100 for other equipment non-compliance; Prince Edward Island sets $200 to $2,000 on summary conviction; Ottawa states $150 for sidewalk riding; and Calgary states $400, $400, and $75 across its rental bylaws.

None of this describes how often those fines are actually issued. Toronto's ban page cites rising e-scooter injuries as its rationale but publishes no injury count, and no seizure or ticketing data was gathered for this article. A fine schedule tells a reader the maximum consequence; it says nothing about how strictly a rule is enforced day to day, and lighter enforcement in one city is not permission to break the rule. British Columbia also prohibits impaired or distracted riding outright, in line with Canada's general rule that operating any vehicle while impaired carries its own separate consequences under Canada's impaired driving penalties.
