BC Demerit Points: ICBC Penalty Point Rules Explained

British Columbia does not suspend your licence at a fixed point total like Ontario or Alberta; instead, points trigger three separate and stackable consequences from ICBC and RoadSafetyBC.

Why BC's System Looks Different From Other Provinces

Drivers who move to British Columbia from Ontario or Alberta often ask what point total gets a licence suspended in BC. The honest answer is that no such single number exists. BC's Motor Vehicle Act and ICBC run three parallel consequences off the same point record, and each one has its own trigger, its own timeline, and its own dollar figure or administrative process.

Understanding this matters because a driver who stays just under one threshold can still be caught by another. Four points might feel manageable, but it is already enough to trigger a premium bill from ICBC. Nine to eleven points can bring a knock from RoadSafetyBC even though no premium has increased that month. And a single bad conviction, such as excessive speeding, can generate a Driver Risk Premium invoice even if the driver's running point total looks fine.

This page walks through penalty point values, then each of the three consequences in turn, then how BC compares with other provinces.

Penalty Points by Offence

Under the Motor Vehicle Act Regulations (Division 28), ICBC assigns penalty points to a driver's record on conviction. The values below are the offence categories most drivers actually encounter.

Other convictions, such as failing to stop for police, running a red light, or an unsafe lane change, also carry their own point values under the same regulation, generally in the 2 to 6 point range. Impaired driving and dangerous driving under the Criminal Code sit in a higher 10 point category and typically arrive alongside an automatic roadside prohibition, not just points. Because the schedule is detailed, always check the current ICBC fines and points table or the Motor Vehicle Act Regulations directly for a specific ticket.

Every penalty point stays on a BC driving record for 2 years, counted from the date of the offence, not the date of conviction or payment.

The Three Separate Consequences of BC Penalty Points

Think of these as three different departments looking at the same point record for three different reasons.

1. Driver Penalty Point (DPP) Premium

If a driver has 4 or more penalty points on their record at the end of a 12 month assessment period, ICBC bills a Driver Penalty Point premium. This is separate from any court fine and separate from Autoplan insurance. It is billed even to someone who does not own or insure a vehicle, because it is tied to the driving privilege itself, not to a policy.

The premium generally starts a few hundred dollars a year at the 4 point threshold and climbs as more points accumulate. ICBC reviews each driver's record annually, usually around the driver's birthday (their assessment date), and sends an invoice roughly a month ahead of that date if points have been added since the last review. Because the exact dollar figure at each point level can change, always confirm the current table on ICBC's Driver Penalty Point page before budgeting for a bill.

2. Point-Based Driving Prohibition

Separately from the premium, RoadSafetyBC monitors point records for driving prohibitions. This is a discretionary administrative review, not an automatic cutoff. A fully licensed Class 5 driver is typically flagged for review around 9 to 11 points within a 12 month period. A new driver still in the Graduated Licensing Program on a Class 7 licence is held to a much stricter standard and is typically reviewed at just 4 points in 12 months, reflecting the lower risk tolerance for novice drivers.

When a driver crosses into review range, RoadSafetyBC does not suspend the licence on the spot. The driver instead receives a formal notice, often called a notice of intent to prohibit, and generally has an opportunity to respond or request a review before any prohibition takes effect. This process sits under the Motor Vehicle Act's high risk driver provisions and is handled by RoadSafetyBC, a division of the provincial government, not by ICBC.

3. Driver Risk Premium (DRP)

The Driver Risk Premium is the least intuitive of the three because it does not depend on a running point total at all. ICBC assesses the DRP based on specific high-risk convictions on a driver's record over the prior 3 years, such as a Criminal Code driving conviction, a 10-point Motor Vehicle Act conviction, excessive speeding, or distracted driving. A driver could be well under the 4-point DPP threshold and still owe a Driver Risk Premium because of a single serious conviction.

A single excessive-speeding conviction, for example, can generate a DRP bill of several hundred dollars, and the amount can be higher where multiple qualifying convictions fall within the same 3 year lookback window. Like the DPP, the DRP is billed once a year near the driver's assessment date and is entirely separate from any court-ordered fine, vehicle impound, or roadside prohibition tied to the same offence.

Consequences at a Glance

Notice that a driver can face any one of these on its own, two together, or all three in the same year depending on what is on their record. There is no single moment where BC 'suspends at N points' the way Ontario or Alberta do.

New Drivers on a Class 7 Licence (GLP)

Drivers in BC's Graduated Licensing Program hold a Class 7 licence (either a novice or a learner stage) before qualifying for a full Class 5. Because new drivers statistically carry more crash risk, RoadSafetyBC applies a much lower review threshold to them, generally 4 points in 12 months rather than the 9 to 11 points applied to full licence holders. A new driver should treat even a single moderate ticket, such as a 3 point speeding conviction, as something that can bring scrutiny well before it would for an experienced driver.

The DPP premium threshold of 4 or more points applies the same way to GLP drivers as to fully licensed drivers, since ICBC's premium system does not vary by licence class the way RoadSafetyBC's prohibition review does.

How Long Points Stay on Your Record

Every penalty point in BC expires 2 years after the date of the offence. This 2 year window is what ICBC and RoadSafetyBC both use for their respective 12 month rolling reviews, since a driver's active point total at any moment is simply the sum of points from offences committed in the past 2 years that have not yet dropped off.

Because the DPP premium and the prohibition review both look at a 12 month period, a driver whose points are clustered near an old assessment date can see their situation change significantly at the next annual review, even without a new ticket, simply because older points age out of the count.

How British Columbia Compares to Other Provinces

Ontario and Alberta both use a single cumulative point total that triggers an automatic suspension: 15 or more points in Ontario or Alberta, with lower thresholds for novice drivers. Quebec goes further and revokes the licence outright at its threshold, which varies by age and licence class. BC deliberately does not use a single automatic suspension trigger. Instead, its three-part structure, the DPP premium, the RoadSafetyBC prohibition review, and the DRP, means consequences arrive as separate financial and administrative actions rather than one bright-line cutoff.

Checking Your Own Record and Avoiding a Prohibition

A BC driver can request their own driving record from ICBC to see current points and their expiry dates. Because the DPP premium and DRP invoices arrive roughly a month before a driver's birthday assessment date, checking a record well ahead of that date gives time to plan for a possible bill. Drivers who receive a notice of intent to prohibit from RoadSafetyBC should read it carefully and respond within the stated deadline, since the notice itself is not the final prohibition and generally allows a response or review request first.

Frequently Asked Questions

At how many points does BC suspend a driver's licence?

BC does not use a single point total for automatic suspension the way Ontario or Alberta do. Instead, 4 or more points in 12 months triggers an ICBC Driver Penalty Point premium, and roughly 9 to 11 points in 12 months (4 points for a Class 7 GLP driver) can prompt a discretionary RoadSafetyBC review that may lead to a driving prohibition.

What is the Driver Penalty Point premium and how much does it cost?

The DPP premium is an annual charge ICBC bills once a driver has 4 or more penalty points on their record at their yearly assessment date. It starts at a few hundred dollars a year and increases with additional points. It applies even to drivers who do not own or insure a vehicle.

How is the Driver Risk Premium different from the Driver Penalty Point premium?

The DPP premium is based purely on a driver's running point total. The Driver Risk Premium (DRP) is triggered by specific high-risk convictions, such as excessive speeding, distracted driving, or a Criminal Code driving offence, over a 3 year window, regardless of the driver's overall point total. A driver can owe one, both, or neither in a given year.

How many points can a new (Class 7 or GLP) driver have before facing a prohibition review in BC?

RoadSafetyBC generally reviews a new Class 7 (Graduated Licensing Program) driver for a driving prohibition at around 4 points in 12 months, a much lower threshold than the roughly 9 to 11 points applied to fully licensed Class 5 drivers.

How long do penalty points stay on a BC driving record?

Penalty points in British Columbia stay on a driving record for 2 years from the date of the offence, not the conviction or payment date. Both the DPP premium review and the RoadSafetyBC prohibition review look at points within a rolling 12 month window inside that 2 year record.

Does a driving prohibition happen automatically once a driver reaches the point threshold?

No. RoadSafetyBC's point-based prohibition is discretionary. A driver who reaches the review range typically receives a notice of intent to prohibit and generally has an opportunity to respond or request a review before any prohibition takes effect, unlike Ontario or Alberta's more automatic suspension rules.
