Arkansas Eviction Notice Requirements
In Arkansas, a landlord must serve a written notice before filing for eviction under Ark. Code Ann. § 18-60-304; § 18-17-701 to -704; § 18-16-101. The required notice period depends on the reason:
- Nonpayment of rent: 3-day notice to pay or quit. 3 days (calendar) written notice to quit under § 18-60-304 before filing unlawful detainer. Unconditional -- no statutory cure-by-payment right. Note the separate § 18-17-701 rule that termination for nonpayment is permitted once rent is 5 days past due; the 5 days is the delinquency trigger, not the notice period.
- Curable lease violation: 14-day notice to cure or quit. 14 days to cure a remediable noncompliance with the rental agreement before termination (§ 18-17-701); same 14 days (or promptly in an emergency) for health/safety noncompliance under § 18-17-702.
- No-cause termination (month-to-month): 30-day notice. 30 days for month-to-month; 7 days for week-to-week (§ 18-17-704). Written notice given at least that many days before the specified termination date. AG: landlord may terminate for any reason.
