New York requires a bill of sale to title or register a vehicle. Notarization is not required for a New York vehicle bill of sale. New York publishes an official form (Form MV-912 (Vehicle Bill of Sale)).
- New York's DMV publishes an official Vehicle Bill of Sale, Form MV-912 (dmv.ny.gov/forms/mv912.pdf), used for private sales of vehicles, boats, snowmobiles, and ATVs.
- No notarization is required for the New York bill of sale, and a New York Certificate of Title does not require the transfer section to be notarized when sold (the MV-912 form contains no notary block).
- The original bill of sale must be given to the DMV as proof of ownership when the new owner titles and registers the vehicle; an acceptable bill of sale must show year and make, VIN/HIN, date of sale, purchase price, and the names and signatures of buyer and seller.
- Notarization of the title transfer section is only required when the proof of ownership is an out-of-state title from certain states (Alaska, Arizona, Hawaii, Kentucky, Louisiana, Mississippi, Montana, Nevada, North Carolina, Ohio, Oklahoma, Pennsylvania, Washington, Wyoming, or Puerto Rico) -- not for NY titles.
- Sales/use tax is reported on Form DTF-802 (Statement of Transaction) at registration, and gifts are noted by marking the purchase price as $0 on the bill of sale.
Federal law (49 CFR 580) requires a written odometer disclosure at transfer for vehicles under 20 model years old. New York implements this on the certificate of title: the NY DMV states that for motor vehicles manufactured in or after the 2011 model year that are 20 model years old or newer, the seller must complete the odometer disclosure statement on the back of the title certificate; odometer disclosure is not required for older vehicles.
