Michigan Bill of Sale Requirements
Michigan does not strictly require a separate bill of sale to title a vehicle, but one is strongly recommended as proof of the sale. Notarization is not required for a Michigan vehicle bill of sale.
- The Michigan Secretary of State (SOS) does NOT require a bill of sale to title/register a vehicle in a private sale. The transfer is accomplished by the seller completing and signing the assignment on the back of the certificate of title and recording the odometer reading; the original signed title is the controlling document and a bill of sale cannot substitute for it.
- Michigan does NOT publish an official motor-vehicle bill of sale form. Form TR-207 is the SOS 'Bill of Sale for a Trailer, Watercraft, or Snowmobile' (also used for ORVs/mobile homes) and is not a car bill of sale. A bill of sale for a car sale is optional and may use any private template.
- No notarization is required for a Michigan vehicle bill of sale or for the title assignment. SOS guidance requires only the buyer and seller signatures; no notary acknowledgment is needed.
- Sellers must keep a record of the sale for at least 18 months (a photocopy of the reassigned title, or a document with the buyer's name, address, driver's license number, signature, plus the price and date of sale); a seller with proof of sale is shielded from liability if the buyer fails to transfer the title.
- Title must be transferred within 15 days of the sale or a late fee applies; buyer presents the signed title, proof of insurance, and a driver's license or state ID at a Secretary of State office (transfer can also be started online).
Federal law (49 CFR Part 580) requires the seller to disclose the odometer reading on transfer; under the 2021 federal rule the disclosure must accompany title transfers for vehicles up to 20 model years old (vehicles model year 2011 and newer are covered until 20 years past their model year). Michigan codifies this in MCL 257.233a: a vehicle MY 2011 or newer is exempt only when transferred at least 20 years after Jan 1 of its model year, while 2010-and-prior vehicles use the legacy 10-year exemption, and vehicles with a GVWR over 16,000 lbs are exempt. For a private sale, completing the odometer fields on the certificate of title satisfies the requirement; if the title lacks space, an SOS odometer mileage statement (Form BDVR-108) is used.
