Nebraska Bill of Sale Requirements
Nebraska requires a bill of sale to title or register a vehicle. Notarization is recommended but not required for a Nebraska vehicle bill of sale. Nebraska publishes an official form (Nebraska DMV Bill of Sale (billofsale.pdf, Rev. 1/2014)).
- Nebraska requires the seller to provide the buyer with a Bill of Sale OR a completed Nebraska Department of Revenue Form 6 (Sales/Use Tax and Tire Fee Statement) at the time of sale; the buyer must apply for a certificate of title within 30 days of purchase.
- Use of the official DMV Bill of Sale form is NOT mandatory — the form itself states individuals must complete a bill of sale at the time of sale but are 'NOT, however, required to use this Bill of Sale form' (form is provided 'as a courtesy').
- The notarized item in an ordinary sale is the assignment of ownership on the certificate of title itself; absent notarization of the seller's signature on the title, the certificate is not duly executed and ownership may not yet pass to the buyer (Neb. Rev. Stat. § 60-140 and its case annotations).
- Nebraska's official Bill of Sale form does include two notary acknowledgment blocks ('Subscribed and sworn before me ... Signature of Notary Public or Designated County Official'); a notarized bill of sale is specifically required only in fallback situations such as no-title transfers or pre-1940 vehicles (Neb. Rev. Stat. §§ 60-142, 60-142.01).
