Minnesota Bill of Sale Requirements
Minnesota does not strictly require a separate bill of sale to title a vehicle, but one is strongly recommended as proof of the sale. Notarization is not required for a Minnesota vehicle bill of sale.
- For titled vehicles (cars, trucks, motorcycles, large trailers), ownership transfers by the owner executing the assignment and warranty of title on the back of the Minnesota certificate of title and delivering it to the buyer -- a separate bill of sale is not required and the title assignment is NOT notarized (Minn. Stat. 168A.10; Minn. DVS 'Buying or Selling a Motor Vehicle / Just the Facts').
- Minnesota DVS does not publish a standalone official motor-vehicle bill-of-sale form; the seller lists the sale price and date in the sales-tax declaration area on the back of the title and completes the odometer and damage disclosures there.
- A bill of sale IS an accepted proof of ownership for vehicles NOT subject to titling (e.g., small trailers at/under the state titling-exemption weight) -- it must identify the vehicle, the date of sale, and the buyer's name, accompanied by the Application to Title and Register a Motor Vehicle; still no notary required.
- No notarization is required for a vehicle bill of sale or title assignment in Minnesota; notarization is only required for a lien release form when a lien is recorded on the title (DVS lien-release guidance).
- Odometer disclosure is made on the title and, per current DVS/federal guidance, is required for the first 20 years for vehicles model year 2011 or newer, exempting vehicles over 16,000 lbs GVWR and vehicles that are not self-propelled -- consistent with the updated federal 49 CFR Part 580 rule.
Federal law (49 CFR Part 580) requires an odometer disclosure on transfer for vehicles within a 20-year window; under the rule effective January 1, 2021, this begins with model year 2011 vehicles, which remain subject to disclosure for the first 20 years. Minnesota implements this on the certificate of title's odometer disclosure section: odometer disclosure is required for model year 2011 or newer vehicles, except vehicles with a GVWR over 16,000 lbs or vehicles that are not self-propelled (e.g., trailers); model year 2010 and older vehicles are exempt. The seller completes the disclosure in the title's assignment area; a separate bill of sale is not the odometer-disclosure vehicle in Minnesota. Source: Minn. Stat. 168A.10 (transfer of vehicle by owner -- assignment/warranty of title); Minnesota DVS, 'Buying or Selling a Motor Vehicle' (Just the Facts); Minn. Stat. ch. 168A (titling).
