Illinois Bill of Sale Requirements
Illinois does not strictly require a separate bill of sale to title a vehicle, but one is strongly recommended as proof of the sale. Notarization is not required for a Illinois vehicle bill of sale.
- A bill of sale is recommended but not legally required to title/register a vehicle in Illinois; the title's assignment-of-ownership section and the tax form carry the sale information the Secretary of State needs.
- Illinois does NOT require a vehicle bill of sale (or the title) to be notarized. Statute 625 ILCS 5/3-112 requires only an executed assignment and warranty of title in the space provided on the certificate.
- Illinois has no official, mandatory state bill-of-sale form. The SOS issues related transaction forms instead: Application for Vehicle Transaction(s) (Form VSD 190), Seller's Report of Sale (Form VSD-703), and the Illinois Department of Revenue Private Party Vehicle Use Tax form (RUT-50).
- Private-party buyers must file Form RUT-50 with the Illinois Department of Revenue to report and pay vehicle use tax; attaching a bill of sale or proof of purchase can help avoid later tax notices. Form RUT-49 (Vehicle Transaction Affidavit) may be used in lieu of a bill of sale with the RUT-50.
- The buyer must apply for the new title within 20 days of receiving the vehicle and assigned title.
Federal law (49 CFR Part 580, implementing the Truth in Mileage Act) requires the seller to disclose the odometer reading at transfer for most vehicles. Effective Jan 1, 2021, the federal disclosure requirement applies for 20 model years (vehicles of model year 2011 and newer require disclosure through 2031); vehicles 20+ model years old and those over 16,000 lbs GVWR are exempt. In Illinois the odometer disclosure is made in the designated section of the title assignment (per 625 ILCS 5/3-112.1); the SOS recommends a bill of sale also record the odometer reading.
