Arizona Bill of Sale Requirements
Arizona requires a bill of sale to title or register a vehicle. Notarization is recommended but not required for a Arizona vehicle bill of sale. Arizona publishes an official form (Title Transfer Bill of Sale (Form #38-1306); general Bill of Sale (Form #48-2004)).
- Arizona MVD publishes two official forms: the Title Transfer Bill of Sale (Form #38-1306), used in place of a signed/assigned Arizona title to transfer ownership when a paper title is unavailable or the title is electronic, and a general Bill of Sale (Form #48-2004).
- CORRECTED: A notarized signature is NOT required to transfer/title a vehicle in Arizona. Effective with the eTitle rollout on September 24, 2022, Arizona dropped the notarization requirement for the seller's signature on titles and on Form #38-1306. The primary statute (A.R.S. 28-2058) contains no notary/acknowledgment requirement; the owner simply endorses an assignment with warranty of title. Form #38-1306 still prints a legacy 'Acknowledged before me' notary block, but completing it is optional.
- Notarization remains RECOMMENDED (not required) when the buyer will register the vehicle in another state, because other states' agencies may still expect a notarized title and the Arizona change may not be recognized.
- A bill of sale is not always needed: the normal path is the seller assigning/signing the certificate of title. Form #38-1306 substitutes for the title when a properly signed/assigned title is unavailable, and the buyer has 15 days to apply for a new title to avoid penalties.
- Odometer disclosure is required on transfer. Per the federal Truth in Mileage Act (49 CFR 580) and A.R.S. 28-2058(B), model year 2011 and newer vehicles require disclosure (for 20 years from the model year), while model year 2010 and older vehicles are exempt (after 10 years).
