Actualizaciones

Described Vermont's telehealth recording rule as two statutory provisions rather than one statute.

We noted that video telehealth consultations need both patient and provider consent and softened a statement that Vermont has only one statute on call recording.

Corrected the page to reflect Vermont law, as amended by Act 80 of 2026, which allows a telemedicine or telephone health care consultation to be recorded only with both patient and provider consent; also noted that it is unsettled which state's law governs an interstate call, that the FCC has no call-recording rules, and that federal statutory damages are discretionary.

Restated the federal civil-damages formula under 18 U.S.C. 2520 as the greater of $100 a day of violation or $10,000, rather than a flat $10,000 minimum.
