Code 5-16-101(d)(2) para el 'monitoreo de seguridad' operado por un residente, cuyos límites los tribunales de Arkansas no han aclarado. También se corrigió la viñeta de la multa por delito grave de Clase C: Ark. Code 5-4-201 limita las multas a $10,000 tanto para delitos de Clase C como de Clase D; solo la prisión y la clasificación aumentan en una tercera ofensa, no la multa.
Ley aplicable revisada en busca de cambios recientes
Propagación de spoke: se reemplazaron los enlaces de estatutos de Justia para AR por arkleg.state.ar.us. Se agregó Ark. Code Ann. § 5-41-211 (HB 1529 / Ley 827 de 2025, firmada el 17 de abril de 2025), primer estatuto integral de deepfakes de AR (delito menor de Clase A primera ofensa, delito grave de Clase D posterior, derecho civil privado de acción). Se confirmó que el estatuto de NCII es § 5-26-314 (NO § 5-26-313 que es agresión doméstica en tercer grado). Se anoto que la § 5-26-314 no alcanza por sí misma el contenido de deepfake con IA. Se agregó la Ley TAKE IT DOWN (Pub. L. No. 119-12, 19 de mayo de 2025) como capa federal para NCII, incluidos deepfakes con IA, con deber de retiro en 48 horas para plataformas vigente el 19 de mayo de 2026.

Whoever, in the special maritime and territorial jurisdiction of the United States, has the intent to capture an image of a private area of an individual without their consent, and knowingly does so under circumstances in which the individual has a reasonable expectation of privacy, shall be fined under this title or imprisoned not more than one year, or both. Except as provided in section 2511(2)(a)(ii), any person whose wire, oral, or electronic communication is intercepted, disclosed, or intentionally used in violation of this chapter may in a civil action recover from the person or entity, other than the United States, which engaged in that violation such relief as may be appropriate. In an action under this section, appropriate relief includes— such preliminary and other equitable or declaratory relief as may be appropriate; damages under subsection (c) and punitive damages in appropriate cases; and a reasonable attorney’s fee and other litigation costs reasonably incurred.
