Leyes de Georgia sobre Grabar a la Policía: Sus Derechos de la Primera Enmienda (2026)

Actualizaciones

Clarified in the traffic-stop FAQ that Georgia law allows a participant's recording while the First Amendment is the source of protection for recording police.

Revised the FAQ on stop-recording orders to advise complying and challenging the order later, and added the obstruction felony for throwing bodily fluids at an officer (O.C.G.A. § 16-10-24(c)).

We corrected the page to say that police generally need a warrant to search your phone but may hold it while they get one, that Crocker v. Beatty denied the deputy immunity for taking the phone (immunity covered only the First Amendment claim), that an officer's order to stop recording is judged on the facts, that the federal circuits are not unanimous on a right to record police, and that obstruction involving violence is a felony.

Fixed a mischaracterization of Crocker v. Beatty, which the page cited as confirming an unconditional right to record police; the Eleventh Circuit actually granted the officer qualified immunity in that case because the right was not clearly established on its specific facts. Also repointed three dead or overly generic case-law citation links.
