Las protecciones penales de Luisiana basadas en la edad cubren a toda víctima menor de 13 años conforme a la violación en primer grado (R.S. 14:42(A)(4)), y a las víctimas de 13 a 16 años conforme a delitos que incluyen R.S. 14:42.1, 14:80, 14:80.1, 14:81 y 14:81.2, cada uno con su propio elemento de diferencia de edad, y R.S. 14:92(A)(7), que no tiene ninguno. Cómo protege la ley de Luisiana a los menores según su edad
Las protecciones de Luisiana usan varias líneas de edad y, para personas de 13 a 16 años, un elemento de diferencia de edad que varía según el delito. Para menores de 13 años, el estatuto de violación en primer grado no tiene condición sobre la edad de la otra persona. Niños menores de 13 años
El R.S. 14:42(A)(4) dispone que la violación en primer grado se comete «when the victim is under the age of thirteen years» (cuando la víctima es menor de trece años), y agrega que «lack of knowledge of the victim's age shall not be a defense» (el desconocimiento de la edad de la víctima no será una defensa). El párrafo no establece una edad mínima ni una diferencia de edad para la otra persona. Cuando el fiscal de distrito no solicita un veredicto capital, el R.S. 14:42(D)(2)(b) fija la pena en cadena perpetua con trabajos forzados sin beneficio de libertad condicional, período de prueba ni suspensión de la sentencia. El párrafo (D)(2)(a) contiene una disposición sobre veredicto capital, y la página oficial del estatuto señala que la sección fue incluida en el Informe Bienal de Estatutos Inconstitucionales a la Legislatura con fecha del 14 de marzo de 2016.
Edades de 13 a 16 años
Para víctimas de 13 a 16 años, cada delito de esta lista establece su propio elemento de diferencia de edad, salvo el R.S. 14:81.3(A)(3) como se señala más abajo, y el elemento forma parte de la definición de ese delito. Algunas otras disposiciones, incluidos el R.S. 14:92(A)(7) y el párrafo de pena R.S. 14:89(B)(2) (cuya situación se indica en esa sección), no establecen un elemento de diferencia de edad; se describen en «Otros delitos de Luisiana que protegen a los menores».
- Violación en segundo grado. El R.S. 14:42.1(A)(3) se aplica «when the offender acts without the consent of the victim, the victim is thirteen years of age or older but less than seventeen years of age, and the difference between the age of the victim and the age of the offender is three years or greater» (cuando el delincuente actúa sin el consentimiento de la víctima, la víctima tiene trece años o más pero menos de diecisiete, y la diferencia entre la edad de la víctima y la del delincuente es de tres años o más). Educadores y posiciones de supervisión
El R.S. 14:81.4 cubre un rango de edad distinto. Un «educador» (educator) que tiene relaciones sexuales con un estudiante de «seventeen years of age or older, but less than twenty-one years of age» (diecisiete años o más pero menos de veintiuno), o comete un acto lascivo o libidinoso sobre él o en su presencia, cuando «there is an age difference of greater than four years» (hay una diferencia de edad mayor de cuatro años), comete conducta sexual prohibida entre un educador y un estudiante. La sección define «educador» como «any administrator, coach, instructor, paraprofessional, student aide, teacher, teacher aide, school resource officer, or security guard at any public or private school» (cualquier administrador, entrenador, instructor, paraprofesional, auxiliar estudiantil, maestro, auxiliar de maestro, oficial de recursos escolares o guardia de seguridad de cualquier escuela pública o privada) en la escuela donde el estudiante está matriculado. Dispone que «the consent of a student, whether or not that student is seventeen years of age or older, shall not be a defense to any violation of this Section» (el consentimiento de un estudiante, tenga o no diecisiete años o más, no será una defensa ante ninguna infracción de esta sección). La Ley de 2026, núm. 207, modificó la definición de «educador».

Dentro del abuso sexual de un menor (víctimas de 13 a 16 años), el R.S. 14:81.2(B) fija rangos de pena más altos cuando el delincuente tiene control o supervisión sobre el menor, o está en un rol de supervisión que incluye un fin religioso, benéfico, científico, educativo, atlético o de servicio a jóvenes, o es un educador del menor.
Otros delitos de Luisiana que protegen a los menores
- Trata de niños con fines sexuales. El R.S. 14:46.3 define «niño» como una persona menor de 18 años. Tipifica como ilícito reclutar, albergar, transportar, proporcionar, vender, recibir, aislar, atraer, obtener o mantener el uso de un niño para actividad sexual comercial y, conforme al párrafo (A)(7), «knowingly solicit or purchase a person under the age of eighteen years for the purpose of engaging in commercial sexual activity» (solicitar o comprar a sabiendas a una persona menor de dieciocho años con el fin de participar en actividad sexual comercial). La sección establece que el consentimiento del menor no es una defensa y que el desconocimiento de la edad de la víctima tampoco lo es. El R.S. 14:82.1(A)(1) cubre por separado a una persona mayor de 17 años que tiene relaciones sexuales con una persona menor de 18 años que recibe o acuerda recibir algo de valor, cuando la diferencia de edad es mayor de dos años.
- Contribuir a la delincuencia de menores. El R.S. 14:92(A)(7) cubre «the intentional enticing, aiding, soliciting, or permitting, by anyone over the age of seventeen, of any child under the age of seventeen» (la persuasión, ayuda, solicitación o permiso intencionales, por cualquier persona mayor de diecisiete años, de cualquier niño menor de diecisiete años) a «perform any sexually immoral act» (realizar cualquier acto sexualmente inmoral). No establece un elemento de diferencia de edad, y el desconocimiento de la edad del menor no es una defensa. La pena es una multa de hasta $1,000, prisión con o sin trabajos forzados de hasta 2 años, o ambas, y el R.S. 15:541 enumera el R.S. 14:92(A)(7) como un delito sexual.
- Crimen contra natura agravado. El R.S. 14:89.1(A)(1)(f) cubre un acto definido en el R.S. 14:89(A)(1) «when the victim is under the age of seventeen years and the offender is at least three years older than the victim» (cuando la víctima es menor de diecisiete años y el delincuente es al menos tres años mayor que la víctima), punible con de 3 a 15 años con trabajos forzados sin beneficio de suspensión de la sentencia, período de prueba ni libertad condicional. El R.S. 14:89.1(A)(2) cubre los actos sexuales prohibidos con una persona menor de 18 años que el delincuente sabe que es su hijo, nieto, hermano, hermana, medio hermano, media hermana, tío, tía, sobrino o sobrina biológicos, adoptivos o por vínculo de padrastro o madrastra (step), como hijastro o hermanastro, y establece que el consentimiento no es una defensa; la pena es una multa de hasta $50,000, de 5 a 20 años, o ambas, o de 25 a 99 años con trabajos forzados cuando la víctima es menor de 13 años y el delincuente tiene 17 años o más.
- Crimen contra natura. El R.S. 14:89(B)(2) y (3) fijan las penas del crimen contra natura conforme al párrafo (A)(1) «with a person under the age of eighteen years» (con una persona menor de dieciocho años) (multa de hasta $50,000, de 15 a 50 años con trabajos forzados, o ambas) y con una persona menor de 14 años (multa de hasta $75,000, de 25 a 50 años con trabajos forzados, o ambas). Estos párrafos no establecen un elemento de diferencia de edad. La página oficial del estatuto del R.S. 14:89 señala que la sección fue incluida en el Informe Bienal de Estatutos Inconstitucionales a la Legislatura con fecha del 14 de marzo de 2016. Los Informes Bienales de Estatutos Inconstitucionales del Instituto de Derecho del Estado de Luisiana (Louisiana State Law Institute) incluyen el texto del párrafo (A)(1) entre las disposiciones declaradas inconstitucionales, y el informe de 2022 del Instituto, que examinó la reforma de 2018 del párrafo (A)(1), recomienda derogar el párrafo (A)(1) y los párrafos (B)(1) a (3), por lo que la guía de leyes sobre la edad de consentimiento por estado no cuenta el R.S. 14:89(B)(2) ni el (3). - Material de abuso sexual infantil. El R.S. 14:81.1 es el estatuto sobre material de abuso sexual infantil, y dispone que el estatuto sobre sexting rige cierta conducta de una persona menor de 17 años. El texto completo de esa sección debe leerse directamente para conocer sus elementos de edad.

El R.S. 14:81.2 fue modificado por última vez por la Ley de 2024, núm. 597, y el texto vigente fija un plazo mínimo de diez años en (B)(2) y (3)(a). Las disposiciones sobre delincuentes habituales y otras reglas de sentencia no se investigaron para esta página.
Registro de delincuentes sexuales
Conforme al R.S. 15:541, la definición de «sex offense» (delito sexual) enumera los R.S. 14:42, 14:42.1, 14:43.1, 14:80, 14:81, 14:81.2 y 14:81.4, y un adulto condenado por un delito sexual se registra conforme al R.S. 15:542. El conocimiento carnal como delito menor conforme al R.S. 14:80.1 no figura en la lista, y el R.S. 14:80.1(F) establece que el delincuente «shall not be subject to any of the provisions of law which are applicable to sex offenders, including but not limited to the provisions which require registration of the offender and notice to the neighbors of the offender» (no estará sujeto a ninguna de las disposiciones legales aplicables a los delincuentes sexuales, incluidas, entre otras, las disposiciones que exigen el registro del delincuente y la notificación a sus vecinos).
El R.S. 15:542 permite que el tribunal de la condena exima del registro a una persona condenada por conocimiento carnal como delito grave (R.S. 14:80) «when the victim is at least thirteen years of age and the offender was not more than four years older than the victim» (cuando la víctima tiene al menos trece años y el delincuente no era más de cuatro años mayor que la víctima), a petición conjunta del fiscal de distrito y el peticionario con prueba documental de las edades. Es una exención que otorga el tribunal y no es automática.
Conforme al R.S. 15:544, el registro es de quince años desde el registro inicial, de veinticinco años por un delito sexual contra una víctima menor de edad, y de por vida por un delito agravado según se define en el R.S. 15:541 y en los demás casos establecidos.

- Ley de 2026, núm. 207 (SB 98). Modificó la definición de «educador» en el R.S. 14:81.4(B)(1); la página de estado del proyecto indica una fecha de vigencia del 1 de agosto de 2026.
- Ley de 2026, núm. 103 (HB 92), vigente desde el 1 de agosto de 2026. Agregó el R.S. 14:42(A)(8) (fuerza que supera la capacidad de resistir). La sección 3 de la Ley derogó el R.S. 14:43.3 (agresión sexual oral). El párrafo (A)(4) no cambia.

Felony carnal knowledge of a juvenile is committed when: (1) A person who is seventeen years of age or older has sexual intercourse, with consent, with a person who is thirteen years of age or older but less than seventeen years of age, when the victim is not the spouse of the offender and when the difference between the age of the victim and the age of the offender is four years or greater; or (2) A person commits a second or subsequent offense of misdemeanor carnal knowledge of a juvenile, or a person who has been convicted one or more times of violating one or more crimes for which the offender is required to register as a sex offender under R.S. 15:542 commits a first offense of misdemeanor carnal knowledge of a juvenile. B. As used in this Section, "sexual intercourse" means anal, oral, or vaginal sexual intercourse. C. Lack of knowledge of the juvenile's age shall not be a defense. Emission is not necessary, and penetration, however slight, is sufficient to complete the crime.

(ii) First degree rape (R.S. 14:42) which occurred on or after August 1, 2015. (b)(i) Forcible rape (R.S. 14:42.1) which occurred prior to August 1, 2015.

A. The following persons shall be required to register and provide notification as a sex offender or child predator in accordance with the provisions of this Chapter: (1) Any adult residing in this state who has pled guilty to, has been convicted of, or where adjudication has been deferred or withheld for the perpetration or attempted perpetration of, or any conspiracy to commit either of the following: (a) A sex offense as defined in R.S. 15:541, with the exception of those convicted of felony carnal knowledge of a juvenile as provided in Subsection F of this Section. (b) A criminal offense against a victim who is a minor as defined in R.S. 15:541. (2) Any juvenile who has pled guilty or has been convicted of a sex offense or second degree kidnapping as provided for in Children's Code Article 305 or 857, with the exception of simple or third degree rape but including any conviction for an offense under the laws of another state, or military, territorial, foreign, tribal, or federal law which is equivalent to the offenses listed herein for which a juvenile would have to register.

§ 15:544Duration of registration and notification periodVigente
A. Except as provided for in Subsection B of this Section, a person required to register and provide notification pursuant to the provisions of this Chapter shall comply with the requirement for a period of fifteen years from the date of the initial registration in Louisiana, or the duration of the lifetime of the offender as provided in Subsection E of this Section, unless the underlying conviction is reversed, set aside, or vacated, except for those convictions that were reversed, set aside, or vacated pursuant to Code of Criminal Procedure Article 893 or 894, or a similar provision of federal law or law from another state or military jurisdiction. The requirement to register shall apply to an offender who receives a pardon as a first-time offender pursuant to Article IV, Section 5(E)(1) of the Constitution of Louisiana and R.S. 15:572(B)(1). B.(1) A person required to register pursuant to this Chapter who was convicted of a sexual offense against a victim who is a minor as defined in R.S.
