Leyes de grabación en el lugar de trabajo de Oklahoma: derechos de empleados y empleadores

Actualizaciones

Removed an inaccurate description of the NLRB Stericycle burden (the employer must justify a rule only after it is shown to tend to chill protected activity) and corrected the Peeping Tom felony penalty to up to five years, a fine of up to $5,000, or both.

Corrected the description of the NLRB's Stericycle standard: it is a presumption the employer must rebut, not a balancing test.

Pointed the Oklahoma Security of Communications Act links (13 O.S. 176.3 and 176.4) to the official OSCN statute text.

We corrected the description of the NLRB's February 2025 General Counsel memo and the current status of the Stericycle standard, noted that the NLRA does not cover government employees or supervisors, clarified that Oklahoma has no statute banning workplace cameras by room (the Peeping Tom law punishes secret, improper-purpose filming), and fixed the wiretap penalty description.

Replaced four broken OSCN citation links (the one-party-consent statute, the interception-penalty statute, the Peeping Tom statute, and the Evidence Code authentication citation) with verified Justia mirrors, and updated the illegal-interception penalty description to reflect Oklahoma's Class D1 felony reclassification effective January 1, 2026, including the 20 percent mandatory-minimum-service requirement.

Added UpdatesLog. Corrected NLRB section: added Stericycle, Inc., 372 NLRB No. 113 (2023) as the controlling Board standard for workplace rules. Added that NLRB GC 25-05 (February 2025) rescinded a set of earlier General Counsel memos, and that Stericycle remains the Board's standard for workplace rules. Corrected section 176.3 penalty from fines up to $5,000 to fine of not less than $5,000.
