Leyes de grabación de video de Oklahoma: reglas para espacios públicos, privados y consentimiento

Actualizaciones

Corrected the 21 O.S. 1171 penalty wording: the fine is a maximum of $5,000, and the court may impose prison, a fine, or both.

Corrected Peeping Tom penalties to state the $5,000 fine as a maximum that may be imposed instead of or alongside jail or prison.

We added Oklahoma's ban on secretly capturing images of private areas even in public (21 O.S. 1171(C), in the statute since 2008), restated the Peeping Tom elements and updated its penalties for the changes effective November 1, 2026, and corrected the intimate-image law: no intent to harass is required for real images, AI fakes are covered when shared, and the two 2025 versions were merged in April 2026. Corrected the 2025 HB 2104 description (the three-or-more-images felony already existed; HB 2104 reclassified it as Class D1), stated that every value-seeking conviction under 21 O.S. 1040.13b(G) requires sex-offender registration under 57 O.S. 582(F), and noted that 13 O.S. 176.3 allows a fine, prison, or both.

Corrected an overstatement of Oklahoma's one-party consent exception (state law voids it only for a criminal purpose, not a tortious one), updated the felony interception and voyeurism penalties to reflect their January 1, 2026 Class D1 reclassification, and added a second 2025 statutory amendment (HB 2104) to the non-consensual-imagery law that was previously unmentioned. Added UpdatesLog. Added HB 1364 of 2025 (signed May 5, 2025, effective November 1, 2025) expanding 21 O.S. section 1040.13b to cover AI-generated and computer-generated nonconsensual intimate imagery. Note: the $5,000 fine in the misdemeanor peeping row is a maximum under 21 O.S. section 1171(A), which is correctly stated as a cap; the not-less-than minimum applies only to 13 O.S. section 176.3 felony interception.
