South Dakota Workplace Recording Laws

Updates

Stated the full intent element of the South Dakota voyeuristic-recording statute and described the NLRB Stericycle standard as a presumption the employer can rebut, not a balancing test.

We corrected the description of NLRB memos GC 25-05 (which rescinded earlier guidance including the electronic-monitoring memo) and GC 25-07 (secretly recording bargaining sessions), added the limits of NLRA protection, removed the claims that platform recording notices avoid consent issues and that the stricter state law always applies, clarified how SDCL 22-21-1 and 22-21-4 apply to workplace restrooms and locker rooms, fixed the email-interception statement, and corrected the Rule 403 test. Corrected the hidden-camera bullet to state the consent element and that a shared restroom or locker room may not be a private place, noted SDCL 22-21-4, and clarified that recording a conversation you take part in is not a crime rather than a legal right.
