W. Va. Code 21-5C-2(a)(5) exige que, después del 31 de diciembre de 2015, todo empleador pague a cada empleado al menos $8.75 por hora. A quiénes cubre la tarifa estatal
Según W. Va. Code 21-5C-1(e), un "empleador" es quien emplea a seis o más empleados durante cualquier semana calendario en un lugar o establecimiento comercial separado, distinto y permanente. Antes de 2015, quedaban excluidas de la definición las unidades donde el 80 por ciento de los empleados estaba cubierto por la FLSA. Después del 31 de diciembre de 2014, esa excepción se aplica solo a la sección de horas extra, de modo que el salario mínimo estatal alcanza a los empleadores cubiertos por la FLSA con seis o más empleados en un lugar. La sección 21-5C-1(f) excluye de "empleado", entre otros:

- Estudiantes de medio tiempo en una escuela o universidad reconocida, y personas de 62 años o más que reciben beneficios de vejez o de sobrevivientes del Seguro Social.
- Empleados de un padre, hijo, hija o cónyuge, empleados de campamentos de verano, aprendices en el trabajo, y ciertos bomberos estatales, acomodadores de teatro y empleados de transportistas de autobús.
¿Cambiará el salario mínimo de Virginia Occidental en 2027?
No hay ningún cambio programado. Virginia Occidental no tiene indexación, y la línea de historial del Código para 21-5C-2 no muestra ninguna reforma después de 2014. La tarifa cambia solo por una ley de la Legislatura o si la tarifa federal supera $8.75.
HB 5485 (Sesión Ordinaria de 2026), "Relacionado con el aumento del salario mínimo estatal", reformaría 21-5C-2 para agregar $11.00 por hora a partir del 1 de enero de 2027. Empleados que reciben propinas en Virginia Occidental
Según la Division of Labor, un empleador puede pagar a un empleado que recibe propinas un salario en efectivo (cash wage) de $2.62 por hora siempre que el salario en efectivo más las propinas declaradas sumen $8.75. Eso es un crédito por propinas (tip credit) del 70 por ciento del salario mínimo, o $6.13, según W. Va. Code 21-5C-4 y la hoja informativa de la División. La regla se aplica a los empleadores cubiertos; de lo contrario, puede aplicarse el salario en efectivo federal de $2.13.

Según la regla legislativa de la División, a un empleado que dedica más del 20 por ciento de la semana laboral a tareas sin propinas se le debe pagar el salario mínimo completo por ese tiempo, y el empleado firma y fecha el informe de propinas. Un empleador que aplica un crédito por propinas y permite un fondo común de propinas debe limitar el fondo a los empleados de servicio y a los empleados con doble función que trabajan como empleados de servicio, y no puede recibir ninguna propina del fondo. Estas reglas están en la regla legislativa de la División, 42 CSR 8-12.1 (vigente desde el 1 de mayo de 2024); el límite del fondo común de propinas se aplica cuando el empleador aplica un crédito por propinas. La ley federal prohíbe por separado que los empleadores se queden con las propinas (29 U.S.C. 203(m)(2)(B)).
Según 21-5C-4 y 42 CSR 8-12.2 a 12.4, un empleador puede acreditar $4 por día por una comida que el empleado consuma en una jornada de ocho horas o más (50 centavos por hora en una jornada más corta) y el 33 por ciento del salario mínimo por hora por el alojamiento obligatorio, pero no puede aplicar ningún crédito por los uniformes exigidos ni por su limpieza.
Salario de capacitación para trabajadores menores de 20 años
W. Va. Code 21-5C-2(b) permite un salario de capacitación de $6.40 por hora para un empleado contratado por primera vez después del 31 de diciembre de 2014. No puede pagarse a nadie de 20 años o más, y dura un período acumulado de no más de 90 días por empleado. Un negocio que no lleve más de 90 días en operación al contratar puede usarlo hasta por 90 días adicionales. Si el salario de capacitación federal según 29 U.S.C. 206(g)(1) es igual o mayor, se aplica el monto federal.
Salarios mínimos locales
Ningún estatuto de Virginia Occidental establece expresamente la prelación estatal (preemption) de un salario mínimo local ni lo autoriza expresamente (se revisaron los Capítulos 7 y 8, incluido el Programa de Autonomía Municipal en 8-1-5a, y el Capítulo 21), y no se identificó ningún salario mínimo de ciudad o condado, por lo que esta página no toma posición sobre si los gobiernos locales pueden fijar uno. (a) Minimum wage: (1) After June 30, 2006, every employer shall pay to each of his or her employees wages at a rate not less than $5.85 per hour. (2) After June 30, 2007, every employer shall pay to each of his or her employees wages at a rate not less than $6.55 per hour. (3) After June 30, 2008, every employer shall pay to each of his or her employees wages at a rate not less than $7.25 per hour. (4) After December 31, 2014, every employer shall pay to each of his or her employees wages at a rate not less than $8.00 per hour. (5) After December 31, 2015, every employer shall pay to each of his or her employees wages at a rate not less than $8.75 per hour. (6) When the federal minimum hourly wage as prescribed by 29 U.S.C. §206 (a) (1) is equal to or greater than the wage rate prescribed in the applicable provision of this subsection, every employer shall pay to each of his or her employees wages at a rate of not less than the federal minimum hourly wage as prescribed by 29 U.S.C. §206 (a) (1). The minimum wage rates required under this subsection shall be thereafter adjusted in accordance with adjustments made in the federal minimum hourly rate.

Prior to January 1, 2015, in determining whether an employer is paying an employee wages and overtime compensation as provided in sections two and three of this article, there shall be provided in accordance with the regulations which shall be promulgated by the commissioner a credit to the employer of twenty percent of the hourly rate of the amount paid an employee customarily receiving gratuities, and a reasonable credit for board and lodging furnished to an employee: Provided, That after December 31, 2014, in determining whether an employer is paying an employee wages and overtime compensation as provided in sections two and three of this article, there shall be provided in accordance with the legislative rules proposed for promulgation by the commissioner a credit to the employer of seventy percent of the hourly rate of the amount paid an employee customarily receiving gratuities, and a reasonable credit for board and lodging furnished to an employee.

§ 21-5C-8Civil remedy of employee; limitation of actions.Vigente
(a) Any employer who pays an employee less than the applicable wage rate to which such employee is entitled under or by virtue of this article shall be liable to such employee for the unpaid wages; an agreement by an employee to work for less than the applicable wage rate is hereby declared by the Legislature of West Virginia to be against public policy and unenforceable. (b) Any person whose wages have not been paid in accord with this article, or the commissioner or his designated representative, upon the request of such person, may bring any legal action necessary to collect a claim under this article. With the consent of the employee, the commissioner shall have the power to settle and adjust any claim to the same extent as might the employee. (c) The court in any action brought under this article may, in the event that any judgment is awarded to the plaintiff or plaintiffs, assess costs of the action, including reasonable attorney fees against the defendant. Such attorney fees in the case of action brought under this section by the commissioner shall be remitted by the commissioner to the treasurer of the state.

Any person who willfully violates any of the provisions of section 215 of this title shall upon conviction thereof be subject to a fine of not more than $10,000, or to imprisonment for not more than six months, or both. No person shall be imprisoned under this subsection except for an offense committed after the conviction of such person for a prior offense under this subsection. Any employer who violates the provisions of section 206 or section 207 of this title shall be liable to the employee or employees affected in the amount of their unpaid minimum wages, or their unpaid overtime compensation, as the case may be, and in an additional equal amount as liquidated damages. Any employer who violates the provisions of section 215(a)(3) or 218d of this title shall be liable for such legal or equitable relief as may be appropriate to effectuate the purposes of section 215(a)(3) or 218d of this title, including without limitation employment, reinstatement, promotion, and the payment of wages lost and an additional equal amount as liquidated damages.

No provision of this chapter or of any order thereunder shall excuse noncompliance with any Federal or State law or municipal ordinance establishing a minimum wage higher than the minimum wage established under this chapter or a maximum work week lower than the maximum workweek established under this chapter, and no provision of this chapter relating to the employment of child labor shall justify noncompliance with any Federal or State law or municipal ordinance establishing a higher standard than the standard established under this chapter. No provision of this chapter shall justify any employer in reducing a wage paid by him which is in excess of the applicable minimum wage under this chapter, or justify any employer in increasing hours of employment maintained by him which are shorter than the maximum hours applicable under this chapter.
