Windshield Mounting Rules
No Specific Mounting Statute
Idaho does not have a statute that names dashcams or phone mounts specifically, but a general windshield-obstruction law still applies to where you place one. Idaho Code Section 49-943 prohibits driving with any sign, poster, or other nontransparent material on the front windshield, side wings, or side or rear windows that obstructs the driver's clear view of the highway. Idaho Code Section 49-944 is a separate statute governing window tinting film and sunscreening devices, not mounted equipment. Avoid placements that materially obstruct your view to stay compliant with both.

Audio Recording and One-Party Consent
How Idaho Code Section 18-6702 Applies
The statute makes it illegal to intentionally intercept wire, oral, or electronic communications without the consent of at least one party. As the driver, you are a party to conversations you take part in, but not to a private conversation between passengers.

Rideshare Drivers
Idaho rideshare drivers can record conversations they take part in under one-party consent. Riders talking privately with each other are a different matter, so drivers who record cabin audio should post a clear notice or tell riders that audio is being captured. A notice bears on whether riders can expect privacy, but it is not the same as a party's consent. The Idaho Transportation Department does not specifically regulate dashcam use.
Cabin-facing video of passengers is a separate question from audio. Idaho Code Section 18-6701 defines interception as the acquisition of the contents of a wire, electronic, or oral communication, so the one-party consent rule governs what the camera's microphone captures, not silent images of the cabin. No Idaho statute specifically addresses interior video in a rideshare vehicle.
The main criminal limit on interior video is Idaho Code Section 18-6605, the video voyeurism law. It applies when someone uses an imaging device at a place where a person has a reasonable expectation of privacy, without that person's knowledge or consent, for sexual gratification, lascivious entertainment or prurient interest, or to sexually degrade or abuse them. It also covers disseminating an identifiable image of someone whose intimate areas are exposed, or who is engaged in a sexual act, with intent to harass or humiliate, when the sharer knew or reasonably should have known the person depicted understood the image should remain private and did not consent to its dissemination. Never share passenger footage of that kind.
