Northern Ireland E-Scooter Laws: Status and Penalties (2026)

Northern Ireland runs on its own statute book

This page is part of RecordingLaw's United Kingdom driving laws coverage, within the broader United Kingdom law hub. England, Scotland and Wales share one legal mechanism for e-scooters: the Electric Scooter Trials and Traffic Signs (Coronavirus) Regulations and General Directions 2020 (SI 2020/663). That instrument's own extent clause says it applies to "England and Wales and Scotland" only. Northern Ireland is not named, and no separate Northern Ireland version of it has been made.

Instead, Northern Ireland regulates motor vehicles, including e-scooters, through its own body of law: the Road Traffic (Northern Ireland) Order 1995 for definitions and driving offences, and the separate Road Traffic (Northern Ireland) Order 1981 for vehicle seizure powers. Vehicle licensing runs through DVLNI (Driver & Vehicle Licensing Northern Ireland), a distinct body from GB's DVLA. This is not a small administrative difference. It means the England-page rules on trial categories, category Q licences and rental scheme insurance simply do not apply here at all.

The legal position: private e-scooters

Article 3(1) of the Road Traffic (Northern Ireland) Order 1995 defines a "motor vehicle" as "a mechanically propelled vehicle...which is intended or adapted for use on roads." An e-scooter meets that definition the same way a car does, and the same baseline duties follow.

PSNI's own guidance sets out what road use of an e-scooter would legally require: a driving licence from age 16 (minimum Category AM), at least third-party insurance for road use, registration with DVLNI with a number plate displayed, a Vehicle Excise Licence when used on the road, obligatory lamps, reflectors and rear markings, compliance with the Motor Vehicles (Construction and Use) Regulations 1999, and a protective helmet in some cases. PSNI states plainly that e-scooters "do not generally comply with construction and use legislation and vehicle standards so are therefore restricted to off-road use only."

In practice, no UK insurer currently offers a third-party motor policy for a privately owned e-scooter, which is the same practical bar that applies in England, Scotland and Wales under different legislation. Without that insurance, riding on a road or other public place in Northern Ireland is a criminal offence under the 1995 Order framework, independent of anything else.

The legal position: rental e-scooters

There is no rental e-scooter scheme, trial or pilot operating anywhere in Northern Ireland, and none has ever run here. This is a different story from Scotland and Wales, where SI 2020/663 at least extends the legal exemption even though no trial has followed. In Northern Ireland the exemption itself was never extended, so there is no legal mechanism currently in place that a future trial could simply switch on without new legislation.

Enforcement in practice

PSNI can seize an e-scooter under Article 180B of the Road Traffic (Northern Ireland) Order 1981, the "power to seize vehicles driven without insurance." Two separate sets of PSNI-linked figures describe how that power has been used, and they measure different things. Neither should be read as a total for "e-scooter seizures in Northern Ireland."

Dataset one: insurance-focused seizures (Irish News)

The Irish News reported, based on a Freedom of Information response, that officers are increasingly using the insurance route to tackle illegal e-scooter and e-bike use. The reported totals: 2 seizures in 2023, 4 in 2024, 24 across all of 2025, and 37 in the first five months of 2026 alone, already exceeding the entire prior year. Most were insurance cases: 29 of the 2026 figure were specifically for lack of insurance; 23 of 2025's total were as well.

Dataset two: total seizures by year and district (NI Policing Board)

The Northern Ireland Policing Board separately publishes its own disclosed totals for combined e-bike, e-scooter and e-scrambler seizures (excluding electrically-assisted pedal cycles and combustion scramblers), broken down by district. Its figures, covering e-scooters specifically: 4 in 2024, 25 in 2025, and 22 in the 2026 fiscal year to date. Belfast City recorded the most seizures in 2025 (16 of the 25); Ards & North Down led the 2026 year-to-date figures (5 of 22).

These two sets of numbers cannot be merged or compared directly. The Irish News figures are a narrower insurance-specific slice; the Policing Board figures are a broader category covering a different measure across different reporting periods. Reported enforcement activity, whichever dataset is used, does not change the underlying legal position described above, and a rise or fall in seizures in either dataset is not a signal about whether e-scooter use is becoming more or less legal.

Penalties

The fixed penalty route and the court route are alternatives, not additions to each other, and PSNI or the Public Prosecution Service decides which applies to a given case. An uninsured e-scooter may also be seized under Article 180B of the 1981 Order regardless of which penalty route is used.

The Justice Bill: what is proposed, not law

Article 65 of the Criminal Justice (Northern Ireland) Order 2008 already lets a constable seize a vehicle being used in a way that causes "alarm, distress or annoyance" in breach of Articles 12 or 48 of the 1995 Order. As it currently stands, Article 65(4) requires PSNI to give a prior warning before seizing the vehicle, with narrow exceptions listed in Article 65(5).

DUP MLA Paul Frew, chair of the Assembly's Justice Committee, tabled an amendment to the Justice Bill, working with Alliance and SDLP colleagues, that would remove the prior-warning requirement so officers "can act immediately where appropriate." Frew has described the change as intended to help PSNI address e-scooters and scramblers "being driven inappropriately and recklessly" on streets and pavements.

This amendment is not law. The Northern Ireland Assembly's own bill tracker shows: First Stage completed 17 September 2024, Second Stage completed 1 October 2024, Committee Stage completed 26 March 2026, Consideration Stage completed 30 June 2026, with Further Consideration Stage still to be scheduled and Royal Assent not yet given. Some press coverage has described the change as having "passed and will become law." That framing is not accurate as of this writing. The bill must still complete Further Consideration Stage and Final Stage before Royal Assent is possible, and no date for either has been set.

One further point of caution: the Assembly's Marshalled List of Amendments (21 April 2026) contains an e-scooter-related amendment, but its wording concerns drone-team resourcing and seizure, retention and disposal powers modelled on a comparable GB bill provision, described differently from the Article 65 warning-removal change reported by the Irish News. It is not fully clear from public records whether these are the same proposal described two different ways, or two distinct e-scooter-related amendments moving through the same bill. Readers should treat this as an open question rather than a settled single mechanism, and should not assume either amendment has taken effect.

Looking ahead: what the Department for Infrastructure is watching

The Department for Infrastructure (DfI) ran a public awareness campaign in May 2026 reinforcing the current legal position, jointly with PSNI. Infrastructure Minister Liz Kimmins acknowledged "increasing concern around the illegal use of e-scooters on our public roads and spaces," including the impact on people with mobility or visual impairments. She has separately said DfI is monitoring both the pilot rental scheme in Great Britain and the effect of e-scooter legalisation in Ireland, where the Republic legalised e-scooter use in May 2024, as inputs into any future decision on registration and regulation in Northern Ireland. No timeline for a Northern Ireland regulatory change has been announced, and readers considering riding an e-scooter in the Republic of Ireland should check the separate rules that apply there rather than assume Northern Ireland's law has changed.

How Northern Ireland compares with the rest of the UK

England is the only UK nation with a live rental trial. Scotland and Wales are legally within the scope of SI 2020/663 but have never had a trial, for reasons specific to each nation's devolved legislative requirements. Northern Ireland sits outside that instrument altogether, regulated instead through its own Road Traffic Orders and its own Assembly, which is also why it is the only nation of the four with an active, named piece of e-scooter-related legislation moving through its own legislature right now.
