Tobacco and Vapes Act 2026: What It Bans and When It Actually Comes Into Force

The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026, but its central rule, a generational ban on selling tobacco to anyone born on or after 1 January 2009, applies from 1 January 2027. The sale ban is not enforceable for any sale made before 1 January 2027, several of the Act's other powers took effect earlier or on different dates, and some of its biggest changes, including new smoke free places, need further regulations before they apply.
What the Act does
The Tobacco and Vapes Act 2026, cited as 2026 c. 18, creates a generational tobacco sale ban: from 1 January 2027, it is an offence to sell a tobacco product, herbal smoking product or cigarette papers to a person born on or after 1 January 2009, regardless of how old that person is at the time of the sale (legislation.gov.uk: Tobacco and Vapes Act 2026, section 1). Unlike the under 18 sale rule it replaces, the generational cut off date never moves forward, so the pool of people the ban protects grows by one birth year at a time rather than staying fixed at "under 18."
The England and Wales version, section 1, states it directly: "It is an offence to sell any of the following to a person born on or after 1 January 2009, (a) a tobacco product; (b) a herbal smoking product; (c) cigarette papers," with a defence in section 1(2) where the seller took reasonable steps to verify the customer was born before that date. Section 2, also from 1 January 2027, makes it an offence for an adult to buy tobacco on behalf of someone born on or after 1 January 2009, closing the obvious proxy purchase route, and section 3, from 29 October 2026, makes it an offence to manage or control premises where a tobacco vending machine is available for use, with a fine of up to level 4 on the standard scale (legislation.gov.uk: Tobacco and Vapes Act 2026, section 3).
Royal Assent was 29 April 2026, but the core ban starts 1 January 2027
The Act's official record gives the enactment date as 29 April 2026 (legislation.gov.uk: Tobacco and Vapes Act 2026, data). That is when the Act became law, not when its rules started applying to sellers.

Commencement runs on a separate timetable, set out in sections 175 and 176. Section 175(3) fixes the date for the generational sale ban directly, quoted here in full: "The following (which relate to the age of sale of tobacco etc) come into force on 1 January 2027... (a) sections 1, 2, 5, 6 and 44(2) and Schedule 7 [England and Wales]; (b) section 52 [Scotland]; (c) sections 72, 73, 76 and 90(2) and Schedule 15 [Northern Ireland]" (legislation.gov.uk: Tobacco and Vapes Act 2026, section 175). Nobody can be prosecuted under sections 1, 52 or 72 for a sale made before 1 January 2027. A page, or a retailer's own compliance notice, that describes the generational ban as applying to sales before that date is wrong.
One Act, three parallel nation specific Parts
The Tobacco and Vapes Act 2026 is not a single UK wide rulebook. It is built as separate, parallel Parts, each running its own numbering: Part 1 is sale and distribution for England and Wales, Part 2 is sale and distribution for Scotland, and Part 3 is sale and distribution for Northern Ireland. Each nation gets its own age of sale offence, proxy purchasing offence, vaping product rules, age verification requirement and retailer register provisions, inside the one Act.
The generational cut off date itself is identical in all three versions. Scotland's version, section 52(2)(a), works by amending the existing Tobacco and Primary Medical Services (Scotland) Act 2010 rather than creating a freestanding new section, substituting "under the age of 18" with the words "born on or after 1 January 2009" (legislation.gov.uk: Tobacco and Vapes Act 2026, section 52). Northern Ireland's version, section 72(1), is worded almost identically to the England and Wales section 1, with the same 1 January 2009 cut off and the same reasonable steps defence (legislation.gov.uk: Tobacco and Vapes Act 2026, section 72). So while the mechanism differs by nation, the birth year that matters, and the date the ban starts, do not.
Commencement, provision by provision
Section 175 governs Parts 1 to 4 (sale, distribution and related product rules), and section 176 governs Parts 5 to 8 (product and information requirements, advertising and sponsorship, and smoke free places). The timetable:

| Date | What it covers |
|---|---|
| 29 April 2026, Royal Assent | Regulation making powers in Parts 1 to 3; section 67, aligning Scotland's tobacco product definition; Part 5 product and information requirements; section 138 of Part 6 |
| 29 June 2026, two months after Assent | Sections 131, 140 and 141 of Part 6, on advertising and sponsorship |
| 29 October 2026, six months after Assent, the default date for Parts 1 to 4 | Any Part 1 to 4 provision not given a more specific date by section 175 |
| 29 October 2026, by commencement instruments | Scotland's retailer register extension, section 69 and Schedule 9 (SSI 2026/210, with some registration offence changes from 29 April 2027); Northern Ireland's retailer register extension, section 87 and Schedule 10 (SR 2026/152) |
| 1 January 2027 | The generational sale ban: sections 1, 2, 5, 6 and 44(2) and Schedule 7 for England and Wales; section 52 for Scotland; sections 72, 73, 76 and 90(2) and Schedule 15 for Northern Ireland |
| No date fixed as of September 2026 | England and Wales retail licensing schemes; Wales's handing over provisions, section 43 and Schedule 5, which extend the Welsh offence of handing over tobacco to underage people to vaping products and to people born on or after 1 January 2009; Scotland's age verification section; Northern Ireland's licensing scheme; all of Part 7; the remaining Part 6 advertising provisions |

Each of the "no date fixed" items requires the relevant minister or department, the Secretary of State for the England items, Welsh Ministers for Wales's licensing scheme and handing over provisions, Scottish Ministers, or Northern Ireland's Department of Health, to make a further commencement regulation before it takes effect. The "smoking ban" is a power, not a ready made list
Part 7 of the Act, covering smoke free places, vape free places and heated tobacco free places, runs its own section blocks for England, Scotland, Wales and Northern Ireland. It does not itself name new smoke free locations such as playgrounds, school gates or hospital grounds. Instead, it gives the relevant nation's health minister or department a power to make regulations designating such places later, restricted to workplaces or places open to the public. As of September 2026, no section of Part 7 had been commenced by any nation, so any report of a specific new outdoor smoking ban under this Act should be checked against an actual made regulation, not assumed from the Act's existence alone.

For the underlying age of sale rule this Act builds on for people already over 18, see the UK everyday law hub for related topics.
Frequently Asked Questions
Is the Tobacco and Vapes Act 2026 in force yet?
Partly. It received Royal Assent on 29 April 2026, and some provisions, mainly regulation making powers, took effect that day or shortly after. Most of the rest of Parts 1 to 4 comes into force by default on 29 October 2026. The central generational sale ban applies from 1 January 2027, and as of September 2026 the retail licensing schemes and all of Part 7 still had no date fixed.
When does the generational tobacco sale ban start?
1 January 2027, in England and Wales, Scotland and Northern Ireland together. Before that date the existing under 18 tobacco sale ban applies, and a sale to someone born on or after 1 January 2009 who is 18 or over is not an offence under this Act. From 1 January 2027 the generational rule replaces the under 18 rule.
Who will never legally be sold tobacco under this Act?
Anyone born on or after 1 January 2009, from 1 January 2027, when the ban commences. The cut off date is fixed and does not move forward, so the group covered grows by one birth year each year rather than staying at a fixed age like 18.
Does the Tobacco and Vapes Act 2026 apply the same way across the UK?
The policy is coordinated but the Act is not one shared rulebook. It runs separate, parallel Parts for England and Wales, Scotland and Northern Ireland, each with its own sections, though the 1 January 2009 birth year cut off and the 1 January 2027 start date are identical in all three.
Does the Act ban smoking in new outdoor places like parks?
Not by itself. Part 7 of the Act gives ministers a power to designate additional smoke free, vape free and heated tobacco free places by regulation, restricted to workplaces or places open to the public, but it does not name specific locations in the Act's own text, and no section of Part 7 had been commenced as of September 2026.
