Is the Disposable Vape Ban in Force? Dates for England, Wales, Scotland and NI
Independently fact-checked against primary sources (last audited September 28, 2026). · 12 primary sources cited on this page. How we verify our legal content

Disposable, single use vapes are banned across the whole UK, but not from the same date: Scotland's ban started on 1 April 2025, two months before England, Wales and Northern Ireland, all of which started on 1 June 2025. The ban targets sellers, not users, and it turns on whether a device is refillable or rechargeable, not on how it looks.
Four nations, four instruments, two dates
The disposable vape ban is not one UK wide law. Each nation made its own 2024 Regulations under its own environmental protection powers, and while all four ban the same kind of device in substance, they commenced on two different dates:
| Nation | Instrument | In force from |
|---|---|---|
| Scotland | Environmental Protection (Single-use Vapes) (Scotland) Regulations 2024 (SSI 2024/269) | 1 April 2025 |
| England | Environmental Protection (Single-use Vapes) (England) Regulations 2024 (SI 2024/1216) | 1 June 2025 |
| Wales | Environmental Protection (Single-use Vapes) (Wales) Regulations 2024 (WSI 2024/1324) | 1 June 2025 |
| Northern Ireland | Environmental Protection (Single-use Vapes) Regulations (Northern Ireland) 2024 (SR 2024/212) | 1 June 2025 |
Sources, at each instrument's commencement provision: Scotland, regulation 1 ("come into force on 1 April 2025"); England, regulation 1 ("come into force on 1st June 2025"); Wales, regulation 1 ("come into force on 1 June 2025"); Northern Ireland, regulation 1 ("come into operation on 1st June 2025"). Scotland's earlier start date is a genuine, confirmed difference, not a rounding or reporting error, so a claim that the ban started on the same day everywhere in the UK is wrong for Scotland specifically.
What counts as a single use vape
Each nation's Regulations define a single use vape in substantially the same way: a vape that is not designed or intended to be reused, which in practice covers a device that cannot be refilled, cannot be recharged, or both. A device that is genuinely designed to be reused falls outside the ban, even if its shape and marketing make it look similar to a disposable device. The Regulations go further than a charging port, though: a vape also counts as single use if its battery cannot be recharged, if its coil is not separately available and replaceable by the user, or if it has neither a container the user can refill nor separately available replacement pods (legislation.gov.uk: Scotland, regulation 3). England's, Wales's and Northern Ireland's Regulations use equivalent tests.

Who the ban actually targets
The offence in each nation's Regulations is aimed at the supply side, not at someone simply owning or using a vape. It covers supplying a single use vape, offering to supply one, or possessing one for the purpose of supply, so a retailer, wholesaler or importer is the person the ban is built to catch. Owning or using one is not an offence under the Regulations, because supply is defined as supply, whether by sale or not, in the course of a business. Penalties for the supply offence differ by nation. In England it is a fine on summary conviction, with no set maximum. In Scotland, Wales and Northern Ireland it is a fine on summary conviction (in Wales, a magistrates' court can also imprison) or, on conviction on indictment, up to 2 years' imprisonment, a fine, or both (Scotland, regulation 4; England, regulation 4; Wales, regulation 4; Northern Ireland, regulation 4). Regulators in England and Wales can also use civil sanctions, including fixed monetary penalties and stop notices (England, civil sanctions schedule).
The 2025 amendments changed enforcement, not the ban itself
Both Wales and Northern Ireland made amending regulations during 2025, and it is worth knowing what those amendments actually did, since neither touched the ban's substance or its date. Wales's amendment, in force from 19 June 2025, gave enforcement officers a power to retain a seized single use vape pending a Welsh Ministers' waste treatment direction, a narrow addition to the existing powers of entry and seizure (legislation.gov.uk: Wales amending regulations, 2025). Northern Ireland's amendment authorised district councils to act as an enforcement body and brought partnerships and unincorporated associations within the Regulations' scope, alongside a treat as waste direction and representations procedure, and made it an offence to fail, without reasonable excuse, to comply with that direction (legislation.gov.uk: Northern Ireland amending regulations, 2025). Neither amendment moved the original 1 April 2025 or 1 June 2025 commencement dates or changed what counts as a single use vape.

Not the same law as the Tobacco and Vapes Act 2026
The disposable vape ban and the Tobacco and Vapes Act 2026 are separate pieces of legislation covering different ground. The disposable vape ban is environmental waste legislation, made under each nation's own environmental protection powers, aimed at reducing single use vape waste. The Tobacco and Vapes Act 2026 is sale of tobacco and vaping products legislation, including the generational tobacco sale ban and vaping product age of sale rules. A retailer or reader researching one should not assume the dates, penalties or scope of the other apply to it.

Frequently Asked Questions
When did the disposable vape ban start in the UK?
Scotland's ban started on 1 April 2025. England, Wales and Northern Ireland each started later, on 1 June 2025. There is no single UK wide start date; each nation made its own 2024 Regulations.
Is it illegal to own a disposable vape I already bought?
No. Owning or using one is not an offence under the Regulations: the offence covers supplying, offering to supply, or possessing for supply in the course of a business.
Are rechargeable vapes with refill pods banned too?
No. The ban applies to a vape that is not designed or intended to be reused, meaning one that cannot be refilled, cannot be recharged, or both. A device falls outside that definition if its battery can be recharged, its coil (or the pod containing it) is sold separately and can be replaced by the user, and it can be refilled or takes separately sold replacement pods, even if it looks similar to a disposable vape.
What is the penalty for selling a banned disposable vape?
It depends on the nation. In England it is a fine on summary conviction, with no set maximum. In Scotland, Wales and Northern Ireland the offence can also be prosecuted on indictment, with up to 2 years' imprisonment. Regulators in England and Wales can also impose civil sanctions such as monetary penalties.
Is the disposable vape ban the same law as the Tobacco and Vapes Act 2026?
No. The disposable vape ban is separate environmental waste legislation that came into force in 2025. The Tobacco and Vapes Act 2026 is a different Act covering the generational tobacco sale ban and other tobacco and vaping product rules.
