Are fireworks legal in Montana?

Permissible fireworks, Montana's term for the federal consumer-fireworks category defined at 27 CFR 555.11 and 16 CFR parts 1500 and 1507, are legal statewide during two sale windows, under Mont. Code Ann. § 50-37-105.

When can you buy fireworks in Montana?

Retail sale is limited to June 24 through July 5 and December 29 through December 31 each year, under Mont. Code Ann. § 50-37-106.

Is there an age minimum to buy fireworks in Montana?

The statute restricts who may sell, not who may buy: no one under 18 may possess for sale, sell, or offer for sale permissible fireworks, under Mont. Code Ann. § 50-37-103(2). No confirmed statewide purchaser age minimum appears in the fireworks chapter.

Can Montana cities or towns ban fireworks even though state law allows them?

Yes. A city or town council may regulate or prohibit the sale, use, or explosion of fireworks within its limits under Mont. Code Ann. § 7-33-4206, and the state fireworks chapter itself says nothing in it authorizes a sale in a city or town that has banned it, under § 50-37-102(3).

What is the penalty for illegal fireworks in Montana?

A violation of Montana's fireworks chapter is a misdemeanor under Mont. Code Ann. § 50-37-110, punishable by a fine of $100 to $500, imprisonment in the county jail for 30 days to 6 months, or both. The chapter also requires a fire official to seize illegal fireworks stock at the owner's expense, under § 50-37-109. A city or town ordinance adopted under § 7-33-4206 can set its own additional local penalty.

Where can't you set off fireworks in Montana?

Not within a state forest, park, or recreation area, not within 100 feet of a fireworks retail location, not from or into a motor vehicle, and not near a person, group, or animal in a way likely to cause injury, under Mont. Code Ann. § 50-37-103(6). Fireworks also cannot be sold within 300 feet of a hospital or church.
