Según el artículo 130 del Código Penal (Penal Law) de Nueva York, se considera que una persona menor de 17 años es incapaz de dar su consentimiento (Penal Law 130.05(3)(a)), y los delitos sexuales se organizan por niveles según la edad de la víctima (menor de 11, 13, 14, 15 y 17 años) y, en la mayoría de los niveles, la edad del actor (18 o 21 años).

Cómo protege la ley de Nueva York a los menores según la edad
Los delitos de Nueva York dependen de tres variables: la edad de la víctima, la edad del actor y el tipo de contacto sexual. Desde el 1 de septiembre de 2024, el artículo 130 define la violación mediante contacto sexual vaginal, oral o anal.

Menores de 13 años
Penal Law 130.35 establece que la violación en primer grado es un delito grave de clase B cuando la persona tiene contacto sexual vaginal, oral o anal con otra persona «que tiene menos de once años de edad» o «que tiene menos de trece años de edad y el actor tiene dieciocho años de edad o más». La sección 130.96 establece que la agresión sexual depredadora contra un niño es un delito grave de clase A-II cuando el actor tiene 18 años o más, comete violación en primer grado, abuso sexual agravado en primer grado o conducta sexual continuada contra un niño en primer grado, y la víctima es menor de 13 años.
En cuanto al contacto sexual, la sección 130.65 establece que el abuso sexual en primer grado es un delito grave de clase D «cuando la otra persona tiene menos de once años de edad» o «cuando la otra persona tiene menos de trece años de edad y el actor tiene veintiún años de edad o más». La sección 130.60(2) establece que el abuso sexual en segundo grado es un delito menor de clase A cuando la persona sometida al contacto sexual tiene menos de 14 años de edad.
Menores de 15 años
Penal Law 130.30 establece que la violación en segundo grado es un delito grave de clase D cuando el actor, «teniendo dieciocho años de edad o más», tiene contacto sexual vaginal con otra persona «menor de quince años de edad», y la sección cubre del mismo modo el contacto sexual oral y anal en sus otros incisos.
Menores de 17 años
Penal Law 130.25 establece que la violación en tercer grado es un delito grave de clase E cuando el actor, «teniendo veintiún años de edad o más», tiene contacto sexual vaginal con otra persona «menor de diecisiete años de edad» (los incisos 4 a 6 cubren el contacto sexual vaginal, oral y anal). La sección 130.05(3)(a) dispone que se considera a una persona incapaz de dar su consentimiento cuando es «menor de diecisiete años de edad». Entornos de custodia y otras disposiciones
Las disposiciones de incapacidad de Nueva York en Penal Law 130.05(3)(e) a (k) se aplican a cualquier edad a personas en entornos de custodia y tratamiento enumerados, como la custodia correccional estatal o local, el cuidado residencial encomendado a la Oficina de Servicios para Niños y Familias cuando el actor es empleado, el tratamiento de salud o de salud mental, ciertas instalaciones residenciales con licencia estatal, la custodia policial y la supervisión de libertad a prueba local. Otras leyes de Nueva York que protegen a los menores
Las siguientes leyes adicionales se aplican a los menores y pueden aplicarse incluso cuando ninguno de los delitos anteriores se aplica.
- Conducta sexual continuada contra un niño. Penal Law 130.75 (primer grado, clase B) se aplica cuando, durante un período no inferior a tres meses, un actor de 18 años o más incurre en dos o más actos de conducta sexual, incluido al menos un acto de contacto sexual vaginal, oral, anal o agravado, con un niño menor de 13 años, y su otro párrafo se refiere a un niño menor de 11 años. La sección 130.80 (segundo grado, clase D) se aplica, durante un período no inferior a tres meses, a dos o más actos de conducta sexual con un niño menor de 11 años, o por un actor de 18 años o más con un niño menor de 13 años.
- Abuso sexual agravado. La sección 130.66 (tercer grado, clase D) se aplica cuando la persona es menor de 11 años, o menor de 13 y el actor tiene 18 años o más. La sección 130.67 (segundo grado, clase C) y la sección 130.70 (primer grado, clase B) se aplican cuando la persona es menor de 11 años.
- Incesto. El incesto en primer grado (sección 255.27, clase B) y en segundo grado (sección 255.26, clase D) se aplican cuando una persona comete violación en primer grado contra un niño menor de 11 años, o menor de 13 por parte de un actor de 18 años o más (130.35), o violación en segundo grado (130.30), contra una persona que el actor sabe que es su ascendiente, descendiente, hermano o hermana de sangre completa o media, tío, tía, sobrino o sobrina, ya sea por matrimonio o no. El incesto en tercer grado (sección 255.25, clase E) abarca contraer matrimonio o tener contacto sexual vaginal, oral o anal con dicho pariente y no tiene elemento de edad.
- Representación sexual de un niño. Sección 263.05 (uso de un niño menor de 17 años, clase C), sección 263.15 (promoción, clase D) y sección 263.16 (posesión, clase E, conducta sexual de un niño menor de 16 años); las secciones 263.10 y 263.11 abarcan la promoción (clase D, niño menor de 17 años) y la posesión (clase E, niño menor de 16 años) de una representación sexual obscena de un niño, y 263.30 abarca facilitar una representación sexual de un niño menor de 17 años con una sustancia controlada o alcohol (clase B). La sección 235.21(3) (segundo grado, clase E) abarca el uso de un sistema de comunicación por computadora para iniciar o sostener con un menor una comunicación dañina para menores.
- Material indecente y acercamiento engañoso. La sección 235.22 abarca la difusión de material indecente a menores en primer grado, donde un menor es toda persona menor de 17 años (clase D). La sección 120.70 abarca el acercamiento engañoso a un niño menor de 17 años (clase E, con una clase superior cuando el delito previsto es un delito grave de clase A o clase B).
- Delitos de prostitución. La sección 230.05 y las secciones relacionadas 230.06 y 230.11 a 230.13 abarcan la contratación de una persona para prostitución (patronizing) cuando la persona es menor de 11, 13, 15 o 17 años, la mayoría con una condición de edad del actor de 18 o 21 años. La sección 230.34-a abarca la trata sexual de un niño por parte de un actor de 21 años o más cuando el niño es menor de 18 años (clase B). La promoción de la prostitución también depende de la edad: 230.25(2) (una persona menor de 19 años, clase D), 230.30(2) (menor de 18, clase C) y 230.32 (menor de 13, o menor de 15 cuando el actor tiene 21 años o más, clase B); la sección 230.33 establece que coaccionar a una persona menor de 18 años a la prostitución mediante fuerza o intimidación, por parte de un actor de 18 años o más, es un delito grave de clase B.

Cómo funcionan las disposiciones de diferencia de edad
Dos secciones contienen disposiciones de diferencia de edad redactadas como defensas afirmativas. La sección 130.30 establece que «será una defensa afirmativa al delito de violación en segundo grado según se define en los incisos uno, dos y tres de esta sección que el acusado era menos de cuatro años mayor que la víctima en el momento del acto». La sección 130.55 establece que, en un proceso por abuso sexual en tercer grado, es una defensa afirmativa que la falta de consentimiento de la otra persona se debió únicamente a la incapacidad de consentir por ser menor de 17 años, que la otra persona tenía más de 14 años y que el acusado era menos de cinco años mayor.
Las disposiciones de registro de la Ley Correccional no establecen una exclusión separada por cercanía de edad.
Penas
Nueva York fija penas determinadas para los delitos graves violentos conforme a Penal Law 70.02 y para los delitos graves sexuales conforme a 70.80. La supervisión posterior a la liberación se fija conforme a 70.45, y las multas por un delito grave no pueden exceder el mayor de $5,000 o el doble de la ganancia del acusado (80.00).

Registro de delincuentes sexuales
Conforme a Correction Law 168-a, la definición de delincuente sexual incluye las condenas conforme a Penal Law 120.70, 130.20, 130.25, 130.30, 130.60, 230.34, 230.34-a, 255.25, 255.26, 255.27 y el artículo 263, los delitos de contratación de prostitución (patronizing) conforme a 230.04 (cuando la persona contratada es menor de 17 años), 230.05, 230.06 y 230.11 a 230.13, los delitos de promoción y coacción conforme a 230.30(2), 230.32 y 230.33 y conforme a 230.25 cuando la persona prostituida es menor de 17 años, y 235.22. Una condena conforme a 130.55 cuenta cuando la víctima es menor de 18 años. La lista de «delito sexualmente violento» incluye 130.35, 130.65, 130.66, 130.67, 130.70, 130.75, 130.80, 130.95 y 130.96. La puesta en peligro del bienestar de un niño conforme a 260.10 no figura en 168-a, y el nivel de riesgo de un delincuente se fija mediante una evaluación de riesgo y no por el delito.
Conforme a Correction Law 168-h, la verificación del registro es anual durante 20 años desde el registro inicial para un delincuente de nivel uno que no tiene designación, y anual de por vida para los delincuentes de nivel dos y nivel tres y para los depredadores sexuales, los delincuentes sexualmente violentos y los delincuentes sexuales reincidentes. Conforme a 168-o, un delincuente de nivel dos que no tiene designación y que ha estado registrado durante al menos 30 años puede solicitar alivio al tribunal que dictó la sentencia. Cambios recientes
El capítulo 777 de las Leyes de 2023, según fue reformado por el capítulo 23 de las Leyes de 2024, redefinió la violación mediante contacto sexual vaginal, oral o anal e incorporó los antiguos delitos de acto sexual criminal a los grados de violación, con vigencia desde el 1 de septiembre de 2024. Los umbrales de edad de 11, 13, 15 y 17 años y las condiciones de edad del actor de 18 y 21 años no cambiaron. Las páginas de las leyes del capítulo no se volvieron a abrir para esta verificación, y el texto vigente de la sección que se leyó es coherente con ellas. Los proyectos de ley presentados en 2025 que tocan el artículo 130 (proyectos de la Asamblea A490, A6230 y A6214) figuraban en comité de la Asamblea y no han sido promulgados. El texto oficial de las secciones 263.10, 263.11, 263.15 y 263.16 muestra una revisión de 2025 que incluye una representación «creada o alterada mediante digitalización según se define en la sección 245.15». Penal Law 130.65-a (abuso sexual agravado en cuarto grado, clase E) se aplica cuando la otra persona es incapaz de consentir por algún factor distinto de ser menor de 17 años, por lo que no depende de la edad.

Luring a child. 1. A person is guilty of luring a child when he or she lures a child into a motor vehicle, aircraft, watercraft, isolated area, building, or part thereof, for the purpose of committing against such child any of the following offenses: an offense as defined in section 70.02 of this chapter; an offense as defined in section 125.25 or 125.27 of this chapter; a felony offense that is a violation of article one hundred thirty of this chapter; an offense as defined in section 135.25 of this chapter; an offense as defined in sections 230.30, 230.33, 230.34 or 230.34-a of this chapter; an offense as defined in sections 255.25, 255.26, or 255.27 of this chapter; or an offense as defined in sections 263.05, 263.10, or 263.15 of this chapter. For purposes of this subdivision "child" means a person less than seventeen years of age. Nothing in this section shall be deemed to preclude, if the evidence warrants, a conviction for the commission or attempted commission of any crime, including but not limited to a crime defined in article one hundred thirty-five of this chapter. 2.

A person is guilty of incest in the first degree when he or she commits the crime of rape in the first degree, as defined in paragraph (c) or (d) of subdivision one, paragraph (c) or (d) of subdivision two or paragraph (c) or (d) of subdivision three of section 130.35 of this part, rape in the first degree as defined in former subdivision three or four of section 130.35 of this part, or a crime formerly defined in subdivision three or four of section 130.50 of this part, against a person whom he or she knows to be related to him or her, whether through marriage or not, as an ancestor, descendant, brother or sister of either the whole or half blood, uncle, aunt, nephew or niece. Incest in the first degree is a class B felony.
