Según las leyes penales de Nevada, la penetración sexual de un niño menor de 14 años es agresión sexual (NRS 200.366(1)(b)), la seducción sexual estatutaria (statutory sexual seduction) protege a las personas de 14 y 15 años (NRS 200.364 y 200.368), la conducta lasciva con un niño (lewdness with a child) protege a los niños menores de 16 años (NRS 201.230), y leyes separadas protegen a las personas de 16 y 17 años frente a posiciones de autoridad en escuelas, universidades y servicios para niños (NRS 201.540, 201.550 y 201.555); la mayor parte de la estructura está organizada por niveles.

Esta página cubre las leyes penales de Nevada sobre delitos sexuales que involucran a menores, principalmente los capítulos 200 y 201 de las NRS y las leyes de registro del capítulo 179D de las NRS. Cómo protege la ley de Nevada a los menores según la edad
Nevada protege a los menores mediante varias leyes, cada una con sus propias condiciones de edad y de relación. La tabla resume las principales disposiciones.

Menores de 14 años: agresión sexual
NRS 200.366 (Agresión sexual) se aplica a una persona que «comete una penetración sexual contra un niño menor de 14 años o hace que un niño menor de 14 años realice una penetración sexual sobre sí mismo o sobre otra persona». La sección establece que quien comete agresión sexual es culpable de un delito grave de categoría A, con la pena fijada por los incisos que se describen más adelante en Penas.
El inciso 5 establece que la sección no se aplica a una persona menor de 18 años que comete los actos del inciso 1(b) si no es más de 2 años mayor que la persona contra quien se cometió el acto, salvo que use fuerza o amenace con fuerza, o sepa o deba saber que la víctima es mental o físicamente incapaz de resistir o de comprender la naturaleza de la conducta. Está redactado como un límite a la aplicación de esa sección. Otras leyes de esta página, como NRS 201.230(5), tratan por separado a las personas menores de 18 años.
De 14 y 15 años: seducción sexual estatutaria
NRS 200.364 (Definiciones) define la seducción sexual estatutaria como «relaciones sexuales ordinarias, relaciones anales o penetración sexual cometidas por una persona de 18 años de edad o más con una persona que tiene 14 o 15 años de edad y que es al menos 4 años menor que el autor». Tanto la edad de 18 años o más del infractor como la diferencia de al menos 4 años están escritas en la definición del delito. NRS 200.368 (Seducción sexual estatutaria) fija la pena.
Menores de 16 años: conducta lasciva con un niño
NRS 201.230 (Conducta lasciva con un niño menor de 16 años) abarca a una persona de 18 años o más que «voluntaria y lascivamente comete cualquier acto lascivo o libidinoso, distinto de los actos que constituyen el delito de agresión sexual», con el cuerpo de un niño menor de 16 años. Una persona menor de 18 años que comete conducta lasciva con un niño menor de 14 años también está cubierta por la sección, y el inciso 5 dispone que dicha persona «comete un acto delictivo de menor» (delinquent act).
Posiciones de confianza y autoridad
Nevada tiene varias secciones dirigidas a personas en posiciones de autoridad sobre menores de más edad. Cada una exige que el infractor cumpla una edad mínima y desempeñe una función definida.

- Empleados y voluntarios escolares, NRS 201.540. Una persona de 21 años o más que «es o fue empleada por una escuela pública o privada en una posición de autoridad o es o fue voluntaria en una escuela pública o privada en una posición de autoridad» y que incurre en conducta sexual con un alumno de 16 años o más que no ha recibido un diploma de escuela secundaria, un certificado de desarrollo educativo general o un documento equivalente. El alumno debe estar inscrito o asistir a la escuela o haber tenido contacto con la persona en el curso de sus funciones. Véase NRS 201.540.
- Empleados de colegios y universidades, NRS 201.550. Una persona de 21 años o más empleada en una posición de autoridad por un colegio o una universidad que incurre en conducta sexual con un estudiante de 16 años o más sin diploma o equivalente que está inscrito o asiste a ese colegio o universidad. El inciso 2 trata a la persona empleada como maestro, instructor o profesor, administrador, o entrenador principal o auxiliar como empleada en una posición de autoridad. Véase NRS 201.550.
- Entidades que prestan servicios a niños, NRS 201.555. Una persona de 25 años o más en una posición de autoridad como empleado o contratista de una entidad que presta servicios a niños, o voluntario de ella, que incurre en conducta sexual con una persona de 16 años o más pero menor de 18. Véase NRS 201.555.
- Comunicación ilícita, NRS 201.553. Una sección separada abarca la comunicación ilícita entre una persona en una posición de autoridad y un alumno. Define a la persona en una posición de autoridad como una persona de 18 años o más que es o fue empleada de una escuela pública o privada, o voluntaria en ella, y que ha tenido contacto con un alumno en el curso del desempeño de sus funciones. Otras leyes de Nevada que protegen a los menores
Los delitos anteriores no son los únicos. Las siguientes leyes adicionales de Nevada también se aplican a los menores.
- Incesto. NRS 201.180 abarca a las personas dentro del grado de consanguinidad en que los matrimonios se declaran por ley incestuosos y nulos que cometen fornicación o adulterio entre sí. No tiene elemento de edad y es un delito grave de categoría A: un mínimo de 2 años y un máximo de cadena perpetua con posibilidad de libertad condicional, y una multa de hasta $10,000. NRS 179D.097 enumera el incesto como delito sexual.
- Acercamiento engañoso a un niño (luring). NRS 201.560 abarca contactar a un niño menor de 16 años y al menos 5 años menor que la persona con la intención de atraerlo sin el consentimiento de un padre o tutor, y contactar a una persona que se cree que es ese niño con la intención de atraerla para incurrir en conducta sexual. La pena depende de si se usó una computadora y de si la intención era la conducta sexual o el suministro de material dañino.
- Abuso, negligencia o puesta en peligro de un niño. NRS 200.508 abarca causar voluntariamente que un niño menor de 18 años sufra dolor físico o sufrimiento mental injustificables como resultado de abuso o negligencia, incluso cuando el abuso involucra abuso sexual o explotación sexual.
- Material de abuso sexual infantil y representación sexual. NRS 200.710 (uso de un menor en una representación), NRS 200.720 (promoción de una representación de un menor), NRS 200.725 (preparación, publicidad o distribución de material), NRS 200.727 (uso de Internet para controlar una presentación visual que muestre a una persona menor de 16 años) y NRS 200.730 (posesión de una presentación visual que muestre a una persona menor de 16 años, y de material generado por computadora) abarcan este material. Los cambios de 2025 en Nevada sustituyeron «pornografía infantil» por «material de abuso sexual infantil» en las leyes.
- Trata sexual de un niño. NRS 201.300 abarca a los niños menores de 18 años, con penas distintas para niños menores de 14 años, de 14 o 15 años y de 16 o 17 años.
- Lascivia abierta o grosera y exhibicionismo indecente. Conforme a NRS 201.210 y NRS 201.220, un delito cometido por una persona de 18 años o más en presencia de un niño menor de 18 años es un delito grave de categoría D.
- Solicitación de un niño para prostitución. NRS 201.354 abarca la solicitación de un niño.
- Imágenes sexuales de un menor. NRS 200.737 regula el uso por un menor de un dispositivo de comunicación electrónica para transmitir o distribuir una imagen sexual de sí mismo. Una primera infracción del inciso 1 se trata como la de un niño necesitado de supervisión, las infracciones posteriores como acto delictivo de menor, y la sección establece que el menor no se considera delincuente sexual ni está sujeto a registro. Registro de delincuentes sexuales
Conforme a NRS 179D.097 (Delito sexual), los delitos sexuales enumerados incluyen la agresión sexual (NRS 200.366), la seducción sexual estatutaria (NRS 200.368), la conducta lasciva con un niño (NRS 201.230) y los delitos por posición de autoridad en escuelas y universidades (NRS 201.540 y 201.550). La lista también incluye el acercamiento engañoso a un niño conforme a NRS 201.560 «si se castiga como delito grave», el abuso o la negligencia conforme a NRS 200.508 si el abuso involucró abuso sexual o explotación sexual, el material de abuso sexual infantil conforme a NRS 200.710 a 200.730 y la trata sexual de un niño conforme a NRS 201.300.
El inciso 2 dispone que, salvo por los delitos de los párrafos (o) y (p) (los delitos escolares y universitarios), el término no incluye un delito «que involucre conducta sexual consensuada si la víctima era» un adulto que no estaba bajo la autoridad de custodia del infractor, o «tenía al menos 13 años de edad y el infractor no era más de 4 años mayor que la víctima». Se establece que una condena conforme a NRS 201.555 no está sujeta a los requisitos de registro ni de notificación a la comunidad del capítulo 179D. NRS 201.553 y NRS 201.354 no se nombran en NRS 179D.097(1), que también incluye «cualquier otro delito que tenga como elemento un acto sexual o conducta sexual con otra persona» (párrafo (s)).
NRS 179D.490 fija períodos de registro de 15 años para un delincuente de Nivel I, 25 años para uno de Nivel II y de por vida para uno de Nivel III. NRS 179D.117 enumera la agresión sexual conforme a NRS 200.366 como delito de Nivel III, y NRS 179D.113 establece el Nivel I como el nivel de los delincuentes que no son de Nivel II ni de Nivel III. El nivel correspondiente a la seducción sexual estatutaria y a la conducta lasciva con un niño depende de cómo se apliquen las leyes de niveles, lo cual el texto de la ley por sí solo no resolvió. Un delincuente de Nivel I puede solicitar una reducción de 5 años después de 10 años consecutivos de cumplimiento y otras condiciones de NRS 179D.490.
Cambios recientes
Las leyes de la sesión de 2025 de Nevada (Proyecto de Ley de la Asamblea 35, Assembly Bill 35) sustituyeron el término «pornografía infantil» por «material de abuso sexual infantil» en todos los Estatutos Revisados de Nevada, incluso en NRS 179D.097 y 179D.115, y no cambiaron los elementos de edad de las secciones anteriores. NRS 200.725 y 200.730 ahora abarcan el material de abuso sexual infantil generado por computadora, según las reformas de 2025 y del Proyecto de Ley de la Asamblea 4 de la 36.ª Sesión Especial. § 200.368Statutory sexual seduction: Penalties.Vigente
A person who commits statutory sexual seduction shall be punished: 1. If the person is 21 years of age or older at the time of the commission of the offense, for a category B felony by imprisonment in the state prison for a minimum term of not less than 1 year and a maximum term of not more than 10 years, and may be further punished by a fine of not more than $10,000. 2. Except as otherwise provided in subsection 3, if the person is under the age of 21 years, for a gross misdemeanor. 3. If the person is under the age of 21 years and has previously been convicted of a sexual offense, as defined in NRS 179D.097, for a category D felony as provided in NRS 193.130.

§ 200.364Definitions.Vigente
As used in NRS 200.364 to 200.3788, inclusive, unless the context otherwise requires: 1. “Forensic laboratory” has the meaning ascribed to it in NRS 176.09117. 2. “Forensic medical examination” has the meaning ascribed to it in NRS 217.300. 3. “Genetic marker analysis” has the meaning ascribed to it in NRS 176.09118. 4. “Offense involving a pupil or child” means any of the following offenses: (a) Sexual conduct between certain employees of a school or volunteers at a school and a pupil pursuant to NRS 201.540. (b) Sexual conduct between certain employees of a college or university and a student pursuant to NRS 201.550. (c) Sexual conduct between certain employees or contractors of or volunteers for an entity which provides services to children and a person under the care, custody, control or supervision of the entity pursuant to NRS 201.555. 5. “Perpetrator” means a person who commits a sexual offense, an offense involving a pupil or child or sex trafficking. 6. “Sex trafficking” means a violation of subsection 2 of NRS 201.300. 7. “Sexual assault forensic evidence kit” means the forensic evidence obtained from a forensic medical examination.

§ 200.366Sexual assault: Definition; penalties; exclusions.Vigente
1. A person is guilty of sexual assault if the person: (a) Subjects another person to sexual penetration, or forces another person to make a sexual penetration on themselves or another, or on a beast, against the will of the victim or under conditions in which the perpetrator knows or should know that the victim is mentally or physically incapable of resisting or understanding the nature of the perpetrator’s conduct; or (b) Commits a sexual penetration upon a child under the age of 14 years or causes a child under the age of 14 years to make a sexual penetration on themselves or another, or on a beast. 2. Except as otherwise provided in subsections 3 and 4, a person who commits a sexual assault is guilty of a category A felony and shall be punished: (a) If substantial bodily harm to the victim results from the actions of the defendant committed in connection with or as a part of the sexual assault, by imprisonment in the state prison: (1) For life without the possibility of parole; or (2) For life with the possibility of parole, with eligibility for parole beginning when a minimum of 15 years has been served.

Nevada Revised Statutes, Chapter 179D: REGISTRATION OF SEX OFFENDERS AND OFFENDERS CONVICTED OF A CRIME AGAINST A CHILD
§ 179D.097“Sexual offense” defined.Vigentecitada en 2 de nuestros artículos
1. “Sexual offense” means any of the following offenses: (a) Murder of the first degree committed in the perpetration or attempted perpetration of sexual assault or of sexual abuse or sexual molestation of a child less than 14 years of age pursuant to paragraph (b) of subsection 1 of NRS 200.030. (b) Sexual assault pursuant to NRS 200.366. (c) Statutory sexual seduction pursuant to NRS 200.368. (d) Battery with intent to commit sexual assault pursuant to subsection 4 of NRS 200.400. (e) An offense involving the administration of a drug to another person with the intent to enable or assist the commission of a felony pursuant to NRS 200.405, if the felony is an offense listed in this subsection. (f) An offense involving the administration of a controlled substance to another person with the intent to enable or assist the commission of a crime of violence, if the crime of violence is an offense listed in this section. (g) Abuse of a child pursuant to NRS 200.508, if the abuse involved sexual abuse or sexual exploitation. (h) An offense involving child sexual abuse material pursuant to NRS 200.710 to 200.730, inclusive.

“Tier III offender” means an offender convicted of a crime against a child or a sex offender who has been convicted of: 1. Murder of the first degree committed in the perpetration or attempted perpetration of sexual assault or of sexual abuse or sexual molestation of a child less than 14 years of age pursuant to paragraph (b) of subsection 1 of NRS 200.030; 2. Sexual assault pursuant to NRS 200.366; 3. Battery with intent to commit sexual assault pursuant to subsection 4 of NRS 200.400; 4. Abuse of a child pursuant to NRS 200.508, if the abuse involved sexual abuse or sexual exploitation and if the victim of the offense was less than 13 years of age when the offense was committed; 5. Kidnapping pursuant to NRS 200.310 to 200.340, inclusive, if the victim of the offense was less than 18 years of age when the offense was committed, unless the offender is the parent or guardian of the victim; 6. Any sexual offense or crime against a child after the person becomes a Tier II offender; 7. Any other offense that is comparable to or more severe than the offenses described in 42 U.S.C.

§ 179D.490Duration of duty to register; termination of duty; procedure; exceptions.Vigente
1. An offender convicted of a crime against a child or a sex offender shall comply with the provisions for registration for as long as the offender or sex offender resides or is present within this State or is a nonresident offender or sex offender who is a student or worker within this State, unless the period of time during which the offender or sex offender has the duty to register is reduced pursuant to the provisions of this section. 2. Except as otherwise provided in subsection 3 and NRS 62F.340, the full period of registration is: (a) Fifteen years, if the offender or sex offender is a Tier I offender; (b) Twenty-five years, if the offender or sex offender is a Tier II offender; and (c) The life of the offender or sex offender, if the offender or sex offender is a Tier III offender, Ê exclusive of any time during which the offender or sex offender is incarcerated or confined.
