How Pennsylvania Calculates Child Support

  • •Pennsylvania uses the Income Shares model under 231 Pa. Code Rule 1910.16-3, combining both parents' monthly net incomes to determine the basic child support obligation.
  • •The basic obligation is determined from a schedule table and each parent's share is proportional to their percentage of the combined net income.
  • •Shared custody applies when the obligor has 40% or more overnights per year (146+ nights — 40% of 365). Under Rule 1910.16-4(c), the reduction scales proportionally above the 40% threshold. The guidelines schedule already assumes the obligor has the child ~30% of the time (~109 nights); the shared parenting adjustment only applies when custody exceeds 40%.
  • •Health insurance premiums and work-related childcare costs are added to the basic obligation and divided proportionally between parents.
  • •For combined monthly net income above $30,000, the court has discretion to determine the support amount. The schedule amount at $30,000 serves as the minimum.
  • •Pennsylvania calculates net income by deducting federal, state, and local taxes; FICA; mandatory union dues; and alimony paid to the other party.
  • •Courts may deviate from the guidelines based on factors in Rule 1910.16-5, including unusual needs, extraordinary expenses, and other relevant circumstances.

Independently fact-checked against the cited primary sources

Corrected the source of Pennsylvania's income-imputation rule to Pa.R.C.P. 1910.16-2(d) (mandatory, not discretionary), fixed the civil contempt ceilings to a $1,000 fine and one year of probation under 23 Pa.C.S. 4345(a), removed the unsupported age-19 cap on support, and clarified that the six-month average applies to gross income.

Corrected the criminal-nonsupport penalty table — 23 Pa.C.S. 4354's grading is binary (a summary offense by default, escalating only to a third-degree misdemeanor in the narrow out-of-state-avoidance scenario), not the three-tier 1/2/5-year misdemeanor structure previously described. Added the official Title 18 sentencing sections that set the actual maximums (90 days for a summary offense, 1 year for a third-degree misdemeanor).
