Illinois Camera Ticket Laws: Red Light, Speed & License Rules

If you have heard that unpaid Illinois camera tickets can get your license suspended, that is out-of-date information. The law that allowed it was repealed in 2021. What remains true is that Illinois camera enforcement is limited to a specific set of counties and, for speed cameras, to Chicago alone, and that ignoring a ticket still leads somewhere real: a debt that can become a court judgment and, eventually, a booted vehicle.

Where Are Red Light and Speed Cameras Legal in Illinois?

Illinois camera enforcement is not statewide, and getting this wrong is the source of a lot of confusion. Red light cameras, authorized under 625 ILCS 5/11-208.6, are limited by statute to eight named counties and the municipalities within them: Cook, DuPage, Kane, Lake, Madison, McHenry, St. Clair, and Will. Outside those counties, there is no statutory authorization for red light camera ticketing. The same section also expressly forbids using a red-light camera system to record speed; it is a red-light-only device by law.

Speed cameras are narrower still. Under 625 ILCS 5/11-208.8, Illinois's speed camera authorization «applies only to municipalities with a population of 1,000,000 or more inhabitants,» which as a practical matter means Chicago and no other city. Even within Chicago, the cameras are restricted to «safety zones,» defined as areas within 1/8 mile of school or park property.

The Repealed License Suspension: What Changed in 2021

This is the single most important correction for anyone researching Illinois camera tickets. For years, Illinois law allowed the state to suspend a driver's license after the owner accumulated a certain number of unpaid automated traffic-camera violations, under 625 ILCS 5/6-306.5. That statute is gone. Illinois's own legislative database lists it as «Repealed by P.A. 101-652, eff. 7-1-21,» meaning it was struck from the books effective July 1, 2021.

Content describing a Chicago-area driver's license getting suspended after five unpaid camera tickets is describing a regime that no longer exists. It has not been in effect since mid-2021. Illinois still has real consequences for ignoring a camera ticket, covered below, but license suspension for camera-ticket nonpayment specifically is not one of them under current law.

Points, Insurance, and Your Driving Record

Both Illinois camera programs are structured as civil penalties, not moving violations. Section 11-208.6(j) states directly: «A violation for which a civil penalty is imposed under this Section is not a violation of a traffic regulation governing the movement of vehicles and may not be recorded on the driving record of the owner of the vehicle.» The speed camera statute contains a parallel clause. In practice, this means an Illinois camera ticket does not add points to your license and is not reported to your insurer through the driving-record channel that ordinary moving violations use.

What Happens If You Don't Pay

While license suspension is off the table, Illinois camera tickets do not simply disappear if ignored. Under 625 ILCS 5/11-208.3, once a violation reaches final determination and any judicial review is exhausted, the unpaid fine or penalty «will constitute a debt due and owing the municipality or county,» and the municipality can sue on it to obtain an ordinary money judgment, enforceable the same way any other civil judgment is.

Before that, statutory late add-ons apply: red light violations can add up to $100 more for failure to pay, and speed camera violations carry their own tiered late penalties up to $50 to $100. Separately, once an owner accumulates the number of unpaid final determinations set by local ordinance, the vehicle becomes eligible for immobilization, commonly known as booting, though the law requires advance notice and «a right to a hearing to challenge the validity of the notice» before the boot goes on.

Two vendor safeguards that readers often assume are Chicago program policy are statewide Illinois law, passed after a political-contribution corruption scandal involving a Chicago-area camera vendor. Under 625 ILCS 5/11-208.3(b-5), an automated speed enforcement or automated traffic law ordinance «shall require that the determination to issue a citation be vested solely with the municipality or county and that such authority may not be delegated to any vendor retained by the municipality or county,» and «any contract or agreement violating such a provision in the ordinance is null and void.» Separately, 10 ILCS 5/9-50 bars any vendor that offers or provides automated traffic law enforcement or automated speed enforcement equipment or services to municipalities or counties, any political action committee created by such a vendor, and any vendor-affiliated person from making a campaign contribution to a political committee established to promote a candidate or public official. Those two protections apply wherever camera enforcement is authorized in Illinois, not only in Chicago.

Owner Liability and Defenses

The registered owner is liable for an Illinois camera violation, and the affidavit people most often ask about does less than its reputation suggests. Section 11-208.6(j) makes the owner «subject to a civil penalty not exceeding $100 or the completion of a traffic education program, or both.» The affidavit in 11-208.6(j-5) reaches only the second half of that sentence. The subsection opens: «For purposes of the required traffic education program only, a registered owner may submit an affidavit to the court or hearing officer swearing that at the time of the alleged violation, the vehicle was in the custody and control of another person.» The affidavit must name that person and give a current address, and if that person completes the traffic education program, the owner does not have to. The fine itself does not move.

The defenses that actually defeat liability are narrow and sit in subsections (h) and (i): the vehicle or its registration plates were stolen before the violation and were not in the owner's control, the vehicle was hijacked, or the driver entered on red to yield the right-of-way to an emergency vehicle or as part of a funeral procession. A theft or hijacking defense requires proof that a report was filed with a law enforcement agency in a timely manner. «Someone else was driving» is not on that list.
