Where the Toyota IC Forklift Emissions Settlement Stands Right Now

As of July 2026, the Toyota IC Forklift Emissions Settlement has final court approval, and the window to file a claim is still open. The court granted final approval on July 10, 2026. The deadline to submit a claim is September 22, 2026. The court's signed final approval order sets that date; the settlement administrator's website lists September 23, 2026 in a few places, so treat September 22, 2026 as the real deadline and do not wait until the last day to file.

This is a business-equipment case, not a data breach. It covers internal-combustion (IC) forklifts, the propane- and gas-powered lift trucks used in warehouses, lumberyards, and distribution centers, not consumer vehicles and not exposed personal data. If your company owns or leases Toyota IC forklifts, this page is about whether your fleet is covered and what filing actually gets you.

What the Lawsuit Alleged

A group of forklift purchasers, including Broadmoor Lumber & Plywood Co., sued Toyota Industries Corp. and its North American material-handling units in the U.S. District Court for the Northern District of California. The case is Broadmoor Lumber & Plywood Co., et al. v. Toyota Industries Corp., et al., case number 3:24-cv-06640-JSC, before Judge Jacqueline Scott Corley.

The complaint alleged that certain Toyota IC forklift engines did not perform to the emissions standards or certifications Toyota represented to buyers. Nonroad industrial engines like these, forklifts, generators, and similar equipment over 25 horsepower, are subject to federal emissions certification rules the EPA administers for nonroad spark-ignition engines. California separately regulates emissions from large spark-ignition forklift engines through the California Air Resources Board. The lawsuit is a private class action over Toyota's own representations, not a government enforcement action, and Toyota has not admitted wrongdoing in agreeing to settle.

Who Is in the Settlement Class

You may be eligible if your business or you personally purchased or leased an eligible Settlement Class Forklift in the United States on or before January 20, 2026.

Eligible units fall into engine families 4Y, 1FS, 1KD, and 1ZS, covering specific model numbers including 8FGU, 8FGCU, 8FGC, 8FD, and 8FDU. The official eligibility notice narrows this further by emissions certification model year: 4Y covers 2007 through 2020, 1FS covers 2014 through 2020, and 1KD and 1ZS each cover 2014 through 2021. That is a specific list of model numbers and certification years, not a flat 2007-2021 range, so do not assume a Toyota forklift in your fleet is covered just because it looks similar to one on this list. Fleet managers with more than a handful of lift trucks should treat this as an inventory task: pull data plates, match model numbers against the four engine families above, and only then start claims for the units that actually match.

How Much You Can Realistically Expect

The settlement created a $299.5 million cash fund. You may also see press coverage citing a total deal value of about $436 million; that larger figure adds in the non-cash Service Plan and New Parts Warranty benefits described below, on top of the cash fund. The $299.5 million is the cash actually available to pay claims.

Payouts are pro-rata by forklift, not a flat amount per claimant. After fees, costs, and administrative expenses are deducted, the remaining cash is divided evenly across every eligible forklift with a valid claim. The official estimate is roughly $1,000 to $2,500 per eligible forklift. If every eligible forklift in the class files a claim, the per-forklift amount could fall to about $820. Fewer claims filed means more money per forklift; more claims filed means less. Nobody, including Toyota or the administrator, can promise you a specific number in advance.

If more than one person or entity has a claim tied to the same forklift, for example a business that later sold the unit to someone still within the class period, the original owner receives 60% of that forklift's payment and the remaining claimants split the other 40%.

Filing requires a completed claim form, and the settlement administrator says claimants may be asked to provide supporting documents, including proof of ownership or lease, in addition to the forklift's model and serial number. Have your purchase or lease records on hand along with each unit's model and serial number before you submit, in case they are requested.

The Free Service Plan and Parts Warranty

Separate from the cash payment, eligible owners get a free Service Plan visit and a New Parts Warranty on their qualifying forklift. This benefit does not require filing a cash claim; it is available to eligible owners regardless of whether they submit for money. If your business plans to keep an eligible forklift in service, this is worth using even if the pro-rata cash amount ends up modest.

Where the Case Stands: Approved, Not Yet Paid

The procedural path here matters. Class members had until June 1, 2026, to opt out of the settlement or object to its terms. Both of those deadlines have passed. The court held a final approval hearing on July 10, 2026, and granted final approval.

That sequence means two things at once. First, if you did not opt out by June 1, 2026, you cannot now start a separate lawsuit over these same claims; you are in the class. Second, approval being granted is not the same as checks going out. The claims window stays open through September 22, 2026 specifically so eligible owners who have not yet filed still have time to do so. Payment timing after the claim deadline closes has not been announced.
