Consumer Rights in the Netherlands: Debt, Collection, Withdrawal and Warranty

Frequently Asked Questions

Which court handles a consumer dispute in the Netherlands?

The subdistrict court, the kantonrechter. Artikel 93 Rv assigns it ordinary money claims up to EUR 25,000, and, separately, cases about a consumer purchase (consumentenkoop) or consumer credit (consumentenkrediet) whatever the amount at stake. Employment and tenancy cases go there on the same regardless-of-amount basis.

Does the EUR 25,000 limit apply to a consumer case?

Not to a consumer-sale or consumer-credit claim. Artikel 93 sub a Rv gives the kantonrechter ordinary money claims up to EUR 25,000, but sub c sends consumer-sale, consumer-credit, employment and tenancy cases to the same court regardless of the amount. So a high-value defective-goods dispute is still a kantonrechter case, not one for the rechtbank.

Which page explains what a collection agency may charge?

The debt collection page sets out the fourteen-day payment reminder a consumer must receive first and the statutory scale (staffel) that caps out-of-court collection costs. See the debt collection page.

Which page covers statutory debt restructuring (WSNP)?

The debt restructuring page sets out the term of the schuldsanering (WSNP), how the rechtbank admits a debtor, and the clean slate (schone lei) at the end. See the debt restructuring page.

Which page explains returning something bought online?

The right of withdrawal page covers the fourteen-day cooling-off period (bedenktijd) for distance purchases, when it starts, and the exceptions. See the right of withdrawal page.

Which page explains the statutory and manufacturer's guarantees?

The warranty rights page sets out the statutory guarantee (wettelijke garantie), how it differs from a voluntary manufacturer's guarantee, and the first-year burden of proof. See the warranty rights page.

Which page covers protecting wages from a creditor?

The wage garnishment page explains loonbeslag and the protected minimum income (beslagvrije voet) that a creditor can never reach. See the wage garnishment page.

Do I need a lawyer for a consumer claim?

Not before the kantonrechter. Artikel 79 Rv lets a party conduct their own case in person there, so an advocaat is not required for a claim in that court. Het Juridisch Loket, the state-subsidised legal information service, can help a consumer prepare.
