Cómo protege la ley de Iowa a los menores según su edad
Las principales protecciones de Iowa dependen de tres líneas de edad: menores de 14 años (un «niño» conforme al Código de Iowa 702.5), 14 y 15 años, y menores de 18 años para las disposiciones basadas en relaciones y otras. Niños menores de 14 años
Conforme al Código de Iowa 709.1(3), «any sex act between persons is sexual abuse by either of the persons» (cualquier acto sexual entre personas es abuso sexual por cualquiera de ellas) cuando «such other person is a child» (esa otra persona es un niño). La sección 709.3(1)(b) tipifica el abuso sexual en segundo grado como delito grave de clase B cuando «the other person is a child» (la otra persona es un niño). Ninguna de las dos secciones establece una edad mínima para la otra persona ni una condición sobre la diferencia de edad.
La sección 709.8 (actos lascivos con un menor) se aplica a «any person sixteen years of age or older» (toda persona de dieciséis años o más) que realiza actos específicos con un niño, «with or without the child's consent» (con o sin el consentimiento del niño). La sección 709.12 (contacto indecente con un menor) se aplica a una persona de 18 años o más, y también a una persona de 16 o 17 años que comete los actos enumerados con un niño que es al menos cinco años menor que ella, en cuyo caso el tribunal de menores tiene jurisdicción conforme al capítulo 232.
Edades de 14 y 15 años
La sección 709.4(1)(b)(2) abarca un acto sexual con una persona de «fourteen or fifteen years of age» (catorce o quince años de edad) cuando «any of the following are true» (se cumple cualquiera de lo siguiente): (a) la persona es miembro del mismo hogar que la otra persona; (b) la persona está emparentada con la otra persona por consanguinidad o afinidad hasta el cuarto grado; (c) la persona está en una posición de autoridad sobre la otra persona y usa esa autoridad para coaccionarla a que se someta; o (d) la persona es cuatro o más años mayor que la otra persona. Estas cuatro circunstancias son alternativas. La diferencia de edad del inciso (d) es una de las vías para configurar el delito y no la única.
Este es un elemento del delito, no una defensa ni una regla de calificación. El abuso sexual en tercer grado es un delito grave de clase C.
La sección 709.14 (conducta lasciva con un menor) se aplica a una persona de 18 años o más «who is in a position of authority over a minor» (que se encuentra en una posición de autoridad sobre un menor), donde, para los incisos 3 y 4, «menor» significa una persona de 14 o 15 años. Cubre los actos de tocamiento (un delito menor grave, serious misdemeanor) y los actos más graves (un delito menor agravado, aggravated misdemeanor), cada uno «with or without consent» (con o sin consentimiento). El inciso 1 tipifica por separado como delito menor grave que una persona de 18 años o más en una posición de autoridad sobre un menor lo obligue, persuada o coaccione a desvestirse total o parcialmente con el fin de excitar o satisfacer deseos sexuales.
Posiciones de confianza y autoridad
La sección 709.15 cubre tres grupos. Un «empleado escolar» incluye al personal escolar con licencia o autorización, a los empleados del distrito escolar, a ciertos voluntarios y contratistas con autoridad de supervisión directa sobre el estudiante y a los empleados de colegios comunitarios que instruyen a estudiantes de secundaria. Un «estudiante» es una persona que está actualmente matriculada o asiste a una escuela primaria o secundaria pública o no pública, o que lo estuvo en los 30 días anteriores, y la sección no establece un límite de edad. Un «adulto que brinda capacitación o instrucción» es una persona de al menos 18 años y cuatro o más años mayor que un menor que recibe capacitación o instrucción remunerada fuera de un entorno escolar. La conducta sexual con un estudiante o un menor es un delito menor agravado, y un patrón, práctica o esquema de dicha conducta es un delito grave de clase D. La misma sección cubre por separado a consejeros y terapeutas (definidos de modo que incluyen a miembros del clero que prestan o pretenden prestar servicios de salud mental) y a sus pacientes o clientes emocionalmente dependientes, sin un elemento de edad.
La sección 709.16 tipifica como delito menor agravado que un agente del orden, o un oficial, empleado, contratista, proveedor, voluntario o agente de un centro de colocación de menores, realice un acto sexual con un menor alojado en el centro.
Otros delitos de Iowa que protegen a los menores
- Captación (grooming). La sección 709.8A dispone que una persona comete captación «when the person knowingly performs an act in person or by conduct through a third party, uses a computer, internet service, or any other electronic storage or transmission device, or uses written communication to seduce, solicit, lure, or entice, or attempt to seduce, solicit, lure, or entice, a child or a person believed to be a child to commit any unlawful sex act or to otherwise engage in unlawful sexual conduct» (cuando a sabiendas realiza un acto en persona o mediante una conducta a través de un tercero, usa una computadora, un servicio de internet o cualquier otro dispositivo electrónico de almacenamiento o transmisión, o usa comunicación escrita para seducir, solicitar, atraer o persuadir, o intentar seducir, solicitar, atraer o persuadir, a un niño o a una persona que se cree que es un niño a cometer cualquier acto sexual ilícito o a participar de otro modo en conducta sexual ilícita). - Incesto. La sección 726.2 tipifica como delito grave de clase D que una persona, distinta de un niño menor de 14 años, realice un acto sexual con otra persona que sabe que es su pariente como ascendiente, descendiente, hermano o hermana de sangre completa o media, tía, tío, sobrina o sobrino. No tiene un límite de edad, por lo que se aplica cuando la otra persona tiene 16 o 17 años, y la sección 692A.102 enumera el incesto cometido contra un menor como un delito de nivel II, reclasificado como nivel III conforme al inciso 5 cuando se comete contra una persona menor de 13 años.
- Abuso sexual continuo de un niño. La sección 709.23 abarca a una persona de 18 años o más que comete tres o más actos de abuso sexual con el mismo niño durante al menos 30 días, un delito grave de clase B con reclusión de no más de cincuenta años.
- Incitación de un menor (enticing a minor). La sección 710.10 tipifica como delito grave de clase C incitar o intentar incitar a una persona que se cree razonablemente menor de 13 años con la intención de cometer abuso sexual o explotación sexual, y como delito grave de clase D incitar o intentar incitar a una persona que se cree razonablemente menor de 16 años con la intención de cometer un acto sexual ilícito o explotación sexual.
- Explotación sexual de un menor. La sección 728.12 tipifica como delito grave de clase B emplear, usar, persuadir, inducir, atraer o coaccionar a un menor para que participe en un acto sexual prohibido o su simulación cuando pueda ser fotografiado, filmado o conservado de otro modo en una representación visual, y cubre por separado la promoción y la posesión de ese material.
- Compra de servicios sexuales que involucran a una persona menor de 18 años. La sección 725.1(2)(b) tipifica como delito grave de clase D comprar u ofrecer comprar servicios como participante en un acto sexual a una persona menor de dieciocho años, o que se cree razonablemente menor de dieciocho años. La sección 725.2 (proxenetismo, pimping) y la sección 725.3 (intermediación, pandering) tienen disposiciones para personas menores de 18 años o menores, y la sección 710A.2A tipifica como delito grave de clase D atraer, coaccionar o reclutar a una persona menor de 18 años para participar en actividad sexual comercial.
- Trata de personas. La sección 710A.2 dispone un delito grave de clase A cuando la víctima es menor de dieciocho años por la conducta de trata enumerada en la mayoría de sus incisos.

Penas
Las secciones de los delitos establecen la clase, y los capítulos 902 y 903 del Código de Iowa fijan las penas. El capítulo 903B agrega sentencias especiales.

Conforme a la sección 902.14, un delito segundo o posterior que implique cualquier combinación de abuso sexual en segundo grado, abuso sexual en tercer grado, actos lascivos con un menor conforme al 709.8(1)(a) o (b), o abuso sexual continuo de un niño es un delito grave de clase A, lo que conforme a la sección 902.1 significa reclusión por el resto de la vida del acusado. Una persona condenada por un delito grave de clase C o superior conforme al capítulo 709 o a la sección 728.12 también es sentenciada conforme a la sección 903B.1 a una sentencia especial de custodia de por vida con elegibilidad para libertad condicional, y un delito menor o un delito grave de clase D conforme al capítulo 709 conlleva una sentencia especial de diez años conforme a la sección 903B.2.
Registro de delincuentes sexuales
El capítulo 692A del Código de Iowa clasifica los delitos en tres niveles. La sección 692A.102 enumera el abuso sexual en tercer grado conforme al 709.4(1)(b)(2) como un delito de nivel I, el contacto indecente con un menor y la explotación sexual conforme al 709.15 como nivel II cuando el niño o la víctima tiene 13 años o más y nivel III cuando es menor de 13 años, y enumera el abuso sexual en segundo grado conforme al 709.3(1)(b) como nivel III cuando lo comete una persona de 14 años o más. Enumera la captación (709.8A) como un delito de nivel I y la conducta lasciva con un menor (709.14) como un delito de nivel II, y también enumera los actos lascivos con un menor (709.8) y la explotación sexual de un menor (728.12), con el nivel de cada uno indicado allí.
De manera predeterminada, la sección 692A.106 fija el registro por diez años, y dispone el registro de por vida tras la condena por un delito agravado o en caso de un segundo registro. La sección 692A.106(2) también exige que un delincuente sexual sentenciado a una sentencia especial conforme al 903B.1 o 903B.2 se registre durante un período igual al plazo de esa sentencia especial, que conforme al 903B.1 es el resto de la vida de la persona para un delito grave de clase C o superior conforme al capítulo 709. La sección 692A.128 permite que un delincuente sexual solicite la modificación de los requisitos de registro. Para el registro iniciado el 1 de julio de 2022 o después, una solicitud de un delincuente de nivel I que tenía menos de 20 años al momento de una infracción del 709.4(1)(b)(2)(d) puede concederse después de al menos cinco años desde el registro inicial, en lugar de diez, y solo si se cumplen las demás condiciones establecidas en esa sección.
Cambios recientes
El Código de Iowa 2026 compilado en el sitio de la legislatura lleva una fecha de impresión de diciembre de 2025. Las modificaciones más recientes que muestran las líneas de historial de las secciones son las Leyes de 2021, cap. 37 (secciones 709.3 y 709.4), las Leyes de 2013, cap. 30 (sección 709.12) y las Leyes de 2023, cap. 19 (sección 709.15). La captación (709.8A) muestra las Leyes de 2024, cap. 1123, y la sección 725.1 muestra las Leyes de 2025, cap. 97.
Para las secciones 709.1, 709.3, 709.4, 709.12, 709.15 y 702.5 y para el capítulo 692A, se revisó el texto de las leyes de la sesión de 2026 en busca de modificaciones, y ninguna modifica esas secciones de delitos. La ley de Iowa de 2026, cap. 1079 (S.F. 2379) modifica los procedimientos de reporte del registro en el capítulo 692A y fue firmada el 6 de mayo de 2026. No. La sección 709.4(1)(b)(2) enumera cuatro circunstancias alternativas para una persona de 14 o 15 años: mismo hogar, parentesco por consanguinidad o afinidad hasta el cuarto grado, uso coercitivo de una posición de autoridad o una persona cuatro o más años mayor. Any sex act between persons is sexual abuse by either of the persons when the act is performed with the other person in any of the following circumstances: 1. If the consent or acquiescence of the other is procured by threats of violence toward any person or if the act is done while the other is under the influence of a drug inducing sleep or is otherwise in a state of unconsciousness, the act is done against the will of the other. 2. A person eighteen years of age or older is upon conviction guilty of an aggravated misdemeanor if the person commits any of the following acts with a child, not the person’s spouse, with or without the child’s consent, for the purpose of arousing or satisfying the sexual desires of either of them: a. Fondle or touch the inner thigh, groin, buttock, anus, or breast of the child. b. Touch the clothing covering the immediate area of the inner thigh, groin, buttock, anus, or breast of the child. c. Solicit or permit a child to fondle or touch the inner thigh, groin, buttock, anus, or breast of the person. d. Solicit a child to engage in any act prohibited under section 709.8, subsection 1, paragraph “a”, “b”, or “e”. 2. The provisions of this section shall also apply to a person sixteen or seventeen years of age who commits any of the enumerated acts with a child who is at least five years the person’s junior, in which case the juvenile court shall have jurisdiction under chapter 232.

Notwithstanding section 902.9, the court may assess a fine of not more than twenty-five thousand dollars for each offense under this subsection in addition to imposing any other authorized sentence. 3.

1. A person commits a class “A” felony if the person commits a second or subsequent offense involving any combination of the following offenses: a. Sexual abuse in the second degree in violation of section 709.3. b. Sexual abuse in the third degree in violation of section 709.4. c. Lascivious acts with a child in violation of section 709.8, subsection 1, paragraph “a” or “b”. d. Continuous sexual abuse of a child in violation of section 709.23. 2. In determining if a violation charged is a second or subsequent offense for purposes of criminal sentencing in this section, each previous violation on which conviction or deferral of judgment was entered prior to the date of the violation charged shall be considered and counted as a separate previous offense, regardless of whether the previous offense occurred before, on, or after July 1, 2005. Convictions or the equivalent of deferred judgments for violations in any other states under statutes substantially corresponding to the offenses listed in subsection 1 shall be counted as previous offenses.

1. The maximum sentence for any person convicted of a felony shall be that prescribed by statute or, if not prescribed by statute, if other than a class “A” felony shall be determined as follows: a. A class “C” felon, not an habitual offender, shall be confined for no more than ten years, and in addition shall be sentenced to a fine of at least one thousand three hundred seventy dollars but not more than thirteen thousand six hundred sixty dollars. e. A class “D” felon, not an habitual offender, shall be confined for no more than five years, and in addition shall be sentenced to a fine of at least one thousand twenty-five dollars but not more than ten thousand two hundred forty-five dollars. 2. The surcharges required by sections 911.1, 911.2A, and 911.5 shall be added to a fine imposed on a class “C” or class “D” felon, as provided by those sections, and are not a part of or subject to the maximums set in this section.

If a person eighteen years of age or older is convicted of a simple or serious misdemeanor and a specific penalty is not provided for or if a person under eighteen years of age has been waived to adult court pursuant to section 232.45 on a felony charge and is subsequently convicted of a simple, serious, or aggravated misdemeanor, the court shall determine the sentence, and shall fix the period of confinement or the amount of fine, which fine shall not be suspended by the court, within the following limits: a. For a simple misdemeanor, there shall be a fine of at least one hundred five dollars but not to exceed eight hundred fifty-five dollars. The court may order imprisonment not to exceed thirty days in lieu of a fine or in addition to a fine. b. For a serious misdemeanor, there shall be a fine of at least four hundred thirty dollars but not to exceed two thousand five hundred sixty dollars. In addition, the court may also order imprisonment not to exceed one year. 2. When a person is convicted of an aggravated misdemeanor, and a specific penalty is not provided for, the maximum penalty shall be imprisonment not to exceed two years.

The board of parole shall determine whether the person should be released on parole or placed in a work release program. The special sentence imposed under this section shall commence upon completion of the sentence imposed under any applicable criminal sentencing provisions for the underlying criminal offense and the person shall begin the sentence under supervision as if on parole or work release. The person shall be placed on the corrections continuum in chapter 901B, and the terms and conditions of the special sentence, including violations, shall be subject to the same set of procedures set out in chapters 901B, 904, 906, and 908, and rules adopted under those chapters for persons on parole or work release.
