How do I find the exact boundary of my property in the Netherlands?

The boundary that counts in law is the registered kadastrale grens held by the Kadaster, not the fence or hedge on the ground. If you are unsure where it runs, the Kadaster can carry out a grensreconstructie, in which a surveyor (landmeter) re-marks the original registered line from the Kadaster's measurement data. In 2026 that service starts from EUR 559, and you should confirm the current price with the Kadaster before ordering.

What is the difference between artikel 5:46 and artikel 5:47 BW?

Artikel 5:46 BW is about marking a boundary that is not really in dispute: either owner may demand that boundary markers (afpalingstekens) be placed or renewed, and the cost is shared equally. Artikel 5:47 BW applies when the course of the boundary is genuinely uncertain, and it lets either owner ask the court to determine the line. In that case the presumption that the possessor is the owner does not apply.

Who pays for marking the boundary between two gardens?

Under artikel 5:46 BW the two owners contribute to the cost of placing or renewing the boundary markers in equal shares (voor gelijke delen). One neighbour cannot be left to pay the whole amount, and the other cannot refuse to take part, because co-operation is a demandable right.

Can I force my neighbour to have the boundary marked?

Yes. Artikel 5:46 BW gives every owner the right to demand at any time (te allen tijde) that clearly perceptible boundary markers be set on the shared boundary, or that existing ones be renewed. The neighbour cannot refuse, and the cost is split equally between the two owners.

What happens if my neighbour and I disagree about where the boundary runs?

A Kadaster grensreconstructie often settles it by showing where the registered line lies. Where a genuine legal dispute remains, artikel 5:47 BW lets either owner ask the court to determine the boundary. In that uncertainty the usual presumption that the possessor is the owner falls away, and the court may divide the disputed strip or award it to one party, with or without compensation.

Which court decides a boundary dispute in the Netherlands?

Most boundary claims, such as a demand to fix the line under artikel 5:47 BW, are claims of undetermined value and go to the rechtbank. A purely monetary neighbour claim of EUR 25,000 or less, for example compensation for damage, can instead go to the kantonrechter under the ordinary money threshold in artikel 93 Rv. Neighbour law has no special forum rule, so it is routed by the value of the claim.

Can my neighbour become the owner of part of my garden just by using it?

It is possible through verjaring (acquisitive prescription). Possession in good faith can lead to acquisition after ten years under artikel 3:99 BW, while possession that is not in good faith can still result in acquisition once the original owner's claim to recover the land has lapsed, which under artikel 3:105 and artikel 3:306 BW turns on a twenty-year period. Verjaring is fact-heavy and is a separate question from where the registered boundary runs.
