Cómo protege la ley de Rhode Island a los menores según la edad

Catorce años o menos
La sección 11-37-8.1 dispone: «Una persona es culpable de agresión sexual por abuso de menores en primer grado si tiene penetración sexual con una persona de catorce (14) años de edad o menos». La sección 11-37-8.3 dispone: «Una persona es culpable de agresión sexual por abuso de menores en segundo grado si tiene contacto sexual con otra persona de catorce (14) años de edad o menos». Ninguna de las dos secciones contiene un elemento de edad del actor ni de diferencia de edad.
Mayor de 14 y menor de 16 años
La sección 11-37-6(b)(1) dispone que una persona es culpable de agresión sexual en tercer grado si «es mayor de dieciocho (18) años de edad y tuvo penetración sexual con otra persona mayor de catorce (14) años y menor de la edad de consentimiento, dieciséis (16) años de edad».
Mayor de 14 y menor de 18 años: poder de supervisión o posición de autoridad
La sección 11-37-6(b)(2) se aplica cuando la persona «es mayor de dieciocho (18) años de edad y tuvo penetración sexual o contacto sexual con otra persona mayor de catorce (14) años y menor de dieciocho (18) años de edad, en circunstancias en que: (i) el acusado tiene poder de supervisión o disciplinario sobre la víctima en virtud de la condición legal, profesional u ocupacional del acusado; o (ii) el acusado actúa de otro modo en una posición de autoridad con respecto a la víctima».
La sección 11-37-6(a) define «posición de autoridad» (position of authority) para incluir a una persona que actúa en el lugar de un padre y a quien se le encomienda cualquiera de los derechos, deberes o responsabilidades de un padre respecto de una persona menor de 18 años, o a una persona encargada de cualquier deber o responsabilidad por la salud, el bienestar o la supervisión de una persona menor de 18 años, ya sea de manera independiente o por medio de otra persona, sin importar cuán breve sea, en el momento del acto.
Cómo funcionan las condiciones de edad
La condición de edad del actor en 11-37-6(b)(1), que el actor sea mayor de 18 años, está escrita en el delito como un elemento. No es una regla de diferencia de años.

La sección 11-37-6(b)(2)(iii) es una disposición separada limitada al delito de autoridad del inciso (b)(2): «No será una infracción del inciso (b)(2) de esta sección si las partes: (A) tienen penetración o contacto sexual de manera consensuada; (B) tienen entre dieciséis (16) y veinte (20) años de edad; y (C) no se llevan más de treinta (30) meses de edad». Las tres condiciones se indican en conjunto. La disposición no se aplica a 11-37-6(b)(1), 11-37-8.1 ni 11-37-8.3.

Otras leyes de Rhode Island que protegen a los menores
Las siguientes leyes adicionales se aplican a los menores y pueden aplicarse incluso cuando ninguno de los delitos anteriores se aplica.
- Solicitación indecente de un niño. La sección 11-37-8.8 se aplica a una persona que solicita a sabiendas a otra persona menor de 18 años, o a quien la persona cree que es menor de 18 años, con el propósito de participar en un acto de prostitución o en cualquier acto que viole los capítulos 9, 34 o 37 del Título 11. Conforme a 11-37-8.9, la pena es de prisión de no menos de cinco años.
- Incitación de niños (enticement). La sección 11-26-1.5 establece como delito grave intentar persuadir, o persuadir, a un niño menor de 16 años, con palabras o acciones, con la intención de incurrir en conducta delictiva grave contra ese niño, para que deje su hogar o su escuela, entre a un vehículo o edificio, o entre a un área con la intención de que el niño quede oculto a la vista del público, mientras se actúa sin la autoridad del padre con custodia, del Estado o de una persona con custodia legal. La pena es de prisión de no más de cinco años, una multa de no más de $5,000, o ambas.
- Explotación de un niño menor de 18 años. La sección 11-9-1 abarca exhibir, usar o emplear a un niño menor de 18 años para la prostitución o cualquier otro acto lascivo o indecente (inciso (c), prisión que no exceda de 20 años, una multa que no exceda de $20,000, o ambas) y permitir que un niño menor de 18 años sea usado en una publicación, película, fotografía o representación pictórica que sugiera un acto sexual (inciso (b), hasta 10 años en una primera infracción y hasta 15 años en una infracción posterior).
- Pornografía infantil. La sección 11-9-1.3 abarca la producción, la transferencia y la posesión que involucran a un menor en conducta sexualmente explícita. La producción, la transferencia y la reproducción conllevan hasta 15 años, y la posesión hasta cinco años, con una multa de no más de $5,000, o ambas.
- Difusión electrónica de material indecente a menores. La sección 11-9-1.5 prohíbe usar a sabiendas e intencionalmente una computadora o un dispositivo de telecomunicaciones para transmitir una representación visual indecente a una persona que el remitente sabe que es un menor, o cree que lo es, es decir, una persona menor de 18 años. Es un delito grave que conlleva hasta cinco años, una multa de no más de $5,000, o ambas. El inciso (d) dispone que «ninguna persona será acusada conforme a esta sección si el menor a quien se transmitió la representación visual indecente tenía quince (15) años de edad o más y la persona que transmitió la representación visual indecente no era más de cuatro (4) años mayor que el menor». - Desnudez infantil en publicaciones. La sección 11-9-1.1 abarca publicar o distribuir una publicación, fotografía, imagen o película que muestre a un niño que se sabe menor de 18 años en un entorno que sugiera un acto sexual, o que realice un acto sexual enumerado. Una primera infracción conlleva hasta 10 años, una multa de no más de $10,000, o ambas.
- Erotismo infantil (child erotica). La sección 11-9-1.6 se aplica a una persona de 18 años o más que a sabiendas y voluntariamente, sin amenaza ni coacción, produce, posee, exhibe o distribuye representaciones visuales de menores parcialmente vestidos, cuando las representaciones se usan con el propósito específico de gratificación o excitación sexual. Es un delito menor punible con hasta un año de cárcel, una multa de no más de $1,000, o ambas.
- Contribuir a la delincuencia. La sección 11-9-4 abarca alentar, ayudar o contribuir a sabiendas o voluntariamente a que un niño menor de 16 años sea culpable de conducta viciosa o inmoral. Es un delito menor punible con una multa que no exceda de $500 o prisión que no exceda de un año.
- Puesta en peligro de un niño. La sección 11-9-5.4 abarca a un padre, tutor u otra persona con custodia o control de un niño menor de 18 años que, de manera injustificada o imprudente, incurre en conducta que crea un riesgo sustancial de lesión corporal grave o de abuso sexual del niño, o que no toma medidas razonables para aliviar ese riesgo cuando tiene el deber de actuar. Es un delito grave que conlleva hasta tres años, una multa que no exceda de $1,000, o ambas, en una primera infracción.
- Voyerismo en video. La sección 11-64-2 conlleva hasta tres años y una multa de hasta $5,000, y es un delito sujeto a registro cuando la víctima es menor de 18 años.
- Trata y sexo comercial que involucran a un menor. La sección 11-67.1-3(b) (trata de un menor) y 11-67.1-5 (servidumbre sexual de un menor, incluido mantener o poner a disposición a un menor para actividad sexual comercial) son delitos graves punibles con hasta 50 años y una multa de hasta $40,000, o ambas; la sección 11-67.1-5(b) establece que no es una defensa que el menor haya consentido a la actividad sexual comercial. La sección 11-67.1-6(b) (contratación de un menor en servidumbre sexual) conlleva hasta 20 años y una multa de hasta $20,000, y 11-67.1-7 (contratación de un menor para actividad sexual comercial) hasta 10 años y una multa de hasta $20,000.

Para una segunda infracción o una posterior conforme a 11-37-8.1 u 11-37-8.3 (la sección no enumera 11-37-6), 11-37-10 dispone que la pena «no será inferior al doble del número mínimo de años de la pena por el delito más reciente». Conforme a 11-37-8.2.1, una persona que comete agresión sexual por abuso de menores en primer grado el 1 de enero de 2007 o después, cuando la víctima tiene 12 años de edad o menos, será monitoreada electrónicamente de por vida mediante un sistema activo de posicionamiento global. Registro de delincuentes sexuales
El registro se rige por la Ley de Registro de Delincuentes Sexuales y Notificación a la Comunidad, capítulo 37.1. La sección 11-37.1-2(f) enumera el «delito penal contra una víctima que es un menor» al que se aplica el registro. La lista incluye cualquier infracción de 11-37-6, 11-37-8, 11-37-8.1 u 11-37-8.3, la incitación con la intención de infringir esas secciones, 11-9-1(b) y (c), 11-9-1.3, 11-9-1.5, 11-37-8.8, 11-64-2 cuando la víctima es menor de 18 años, y 11-67.1-3(b), 11-67.1-5(c), 11-67.1-6(b) y 11-67.1-7(b).
Conforme a 11-37.1-4, una persona obligada a registrarse anualmente se registra «durante un período de diez (10) años desde la expiración de la pena por el delito». Una persona que tiene una o más condenas previas por un delito enumerado, o ha sido condenada por un delito agravado, se registra anualmente en persona durante toda su vida. Una persona determinada como depredador sexualmente violento conforme a 11-37.1-6 también se registra de por vida (11-37.1-4(b)). Un «delito agravado» incluye «delitos que involucran penetración sexual de víctimas de cualquier edad mediante el uso de fuerza, o la amenaza de uso de fuerza, o delitos que involucran penetración sexual de víctimas que tienen catorce (14) años de edad o menos».
Un menor con obligación de registrarse conforme al inciso (b) o (c) de 11-37.1-4 se registra anualmente en persona durante 15 años después de su liberación del confinamiento o de su colocación en la comunidad o libertad a prueba por el delito (11-37.1-4(j)). Para un menor declarado delincuente conforme a 11-37-8.1 u 11-37-8.3, el tribunal evalúa la totalidad de las circunstancias. Si determina que la conducta de las partes es delictiva solo por la edad de la víctima, tiene discreción para ordenar que el menor se registre como delincuente sexual mientras el tribunal lo considere apropiado para proteger a la comunidad y rehabilitar al menor infractor. Esta es una disposición de registro y no cambia si la conducta subyacente es un delito.

La reforma más reciente de 11-37-6 (agresión sexual en tercer grado, incluida la disposición de 30 meses del inciso (b)(2)(iii)) se hizo mediante P.L. 2022, cap. 153 y cap. 154, vigente desde el 27 de junio de 2022. The following words and phrases, when used in this chapter, have the following meanings: (1) “Accused” means a person accused of a sexual assault. (2) “Force or coercion” means when the accused does any of the following: (i) Uses or threatens to use a weapon, or any article used or fashioned in a manner to lead the victim to reasonably believe it to be a weapon. (ii) Overcomes the victim through the application of physical force or physical violence. (iii) Coerces the victim to submit by threatening to use force or violence on the victim and the victim reasonably believes that the accused has the present ability to execute these threats. (iv) Coerces the victim to submit by threatening to at some time in the future murder, inflict serious bodily injury upon or kidnap the victim or any other person and the victim reasonably believes that the accused has the ability to execute this threat. (3) “Intimate parts” means the genital or anal areas, groin, inner thigh, or buttock of any person or the breast of a female. (4) “Mentally disabled” means a person who has a mental impairment which renders that person incapable of appraising the nature of the act.

§ 11-37-8.2.1Penalty for first degree child molestation sexual assault — Jessica Lunsford Child Predator Act of 2006Vigente
(a) Title and Legislative Intent. The title of this section shall be “The Jessica Lunsford Child Predator Act of 2006.” In enacting this section the general assembly intends that in order to ensure the safety of victims the most dangerous child predators be electronically monitored via an active global positioning system in order to ensure that their whereabouts can be easily ascertained by law enforcement and other responsible authorities at all times while providing treatment to offenders. (b) Every person who shall violate the provisions of subdivisions 11-37-8.2.1(b)(1) — 11-37-8.2.1(b)(2) listed herein shall be electronically monitored via an active global positioning system for life and, as a condition of parole and probation, and for the duration of any period of his or her probation following his or her parole shall attend a sex offender treatment program to address his or her criminally offensive behavior, as determined by the department of probation and parole.

(a) A person is guilty of indecent solicitation of a child if he or she knowingly solicits another person under eighteen (18) years of age or one whom he or she believes is a person under eighteen (18) years of age for the purpose of engaging in an act of prostitution or in any act in violation of chapter 9, 34, or 37 of this title. (c) For purposes of this section, such wanton and reckless behavior occurs when a person is aware of and consciously disregards a substantial and unjustifiable risk that their acts, or omissions where there is a duty to act, would result in a substantial risk of serious bodily injury to the child or sexual abuse of the child for whom they have custody or control.
