Oklahoma's minimum wage is $7.25 per hour. 40 O.S. 197.2 requires employers to pay the current federal minimum wage for all hours worked, and the state act does not apply to FLSA-covered employers who pay the FLSA minimum. Oklahoma cities cannot set their own minimum wage.

What is the Oklahoma minimum wage?
The Oklahoma Minimum Wage Act, 40 O.S. 197.2, provides that, except as otherwise provided in the act, no employer within the State of Oklahoma shall pay any employee a wage of less than the current federal minimum wage for all hours worked. The rate is therefore $7.25 per hour, the federal figure that has applied since July 24, 2009. Because the state rate follows the federal rate, the statute schedules no step for 2027.

Who the Oklahoma act covers, and the $2.00 figure
Under 40 O.S. 197.4(d), "employer" means one that hires more than ten full-time employees or the equivalent at one location, or grosses more than $100,000 annually. The definition also makes the act inapplicable to employers subject to the FLSA who pay the FLSA minimum. Section 197.4(e) excludes farm workers, domestic service, United States employees, nonprofit volunteers, newspaper vendors and carriers, interstate carrier employees, employees of FLSA-covered employers paying the minimum wage, executive, administrative, professional and outside sales employees, part-time employees under 25 hours a week who are not on permanent status, persons under 18 who are not high school graduates, persons under 22 who are enrolled students, feedstore employees and reserve deputy sheriffs.
Section 197.5 still contains a $2.00 per hour figure for employees 18 or older, and DOL's July 1, 2026 state table lists $2.00 for employers outside the size thresholds. How sections 197.2 and 197.5 apply together to an employer outside the FLSA is not spelled out in the text reviewed, so ask the Oklahoma Department of Labor before relying on $2.00. Any FLSA-covered employer owes $7.25 (29 U.S.C. 206 and 218(a)).
Tipped workers in Oklahoma
Under 40 O.S. 197.16(A), an employer may take a tip credit if it pays a cash wage of not less than the amount in the federal regulation at 29 CFR 531.50(a)(1). Section 197.16(B) provides that if the state minimum exceeds the federal minimum, a credit may be given for tips. The section was amended by Laws 2025, chapter 401, effective November 1, 2025.

DOL's tipped table lists a $2.13 cash wage and a $5.12 maximum credit for Oklahoma. As amended, 197.16(A) ties the state minimum cash wage to the federal figure in 29 CFR 531.50(a)(1), which is $2.13. Employers may not keep employees' tips under federal law (29 U.S.C. 203(m)(2)(B)).
Youth rates
The state act excludes some young workers altogether (persons under 18 who are not high school graduates and persons under 22 enrolled as students, 197.4(e)). For FLSA-covered employers, the federal rule permits $4.25 per hour for a newly hired employee under 20 during the first 90 consecutive calendar days, if the work does not displace other workers (29 U.S.C. 206(g)).
Can Oklahoma City or Tulsa set a higher minimum wage?
No. 40 O.S. 160, added by Laws 2014, chapter 40 and effective July 1, 2014, provides that no municipality or other political subdivision shall establish a minimum wage rate that an employer would be required to pay employees. There are no local minimum wage rates to list.

State Question 832 (rejected June 16, 2026)
State Question 832, an initiative to raise Oklahoma's minimum wage, was on the June 16, 2026 primary election ballot. Its ballot title, posted on the State Election Board's question page, describes a phased increase to $15 in 2029, then indexing to the CPI-W, ending several exemptions, effective January 1 following approval.
Voters rejected it. The State Election Board's official results show 349,102 votes against the proposal and 281,386 for it. The statute in force, 40 O.S. 197.2, still ties the rate to the federal minimum wage, so Oklahoma's rate stays at $7.25.
How to file a minimum wage claim in Oklahoma
The Oklahoma Department of Labor's Wage and Hour Unit takes wage claims through the online form on its wage claim page. Under 40 O.S. 197.7 the Commissioner investigates a verified complaint about a failure to pay the minimum wage under section 197.5. If the Commissioner finds wages due, 197.8 adds a 10 percent penalty, and under 197.9 a court that finds underpayment awards double the full wages owed, less any amount the employer actually paid, plus court costs and reasonable attorney fees of at least $100. The state limitations period and a state retaliation provision were not verified for this page.
For FLSA-covered workers, DOL takes complaints at 1-866-487-9243. An employer that violates the federal minimum wage owes unpaid wages plus an equal amount as liquidated damages (29 U.S.C. 216(b)); a suit generally must start within two years, or three for a willful violation (29 U.S.C. 255(a)), and 29 U.S.C. 215(a)(3) bars retaliation. § 197.2Minimum wages establishedIn force
It shall be unlawful to employ workers in any industry or occupation within the State of Oklahoma under conditions of labor detrimental to their health or morals and it shall be unlawful to employ workers in any industry within the State of Oklahoma at wages which are not adequate for their maintenance. Except as otherwise provided in the Oklahoma Minimum Wage Act, no employer within the State of Oklahoma shall pay any employee a wage of less than the current federal minimum wage for all hours worked. § 197.4DefinitionsIn force
As used in this act: (a) "Commissioner" means the Commissioner of Labor; (b) "Wage" means compensation due to an employee by reason of his employment, payable in legal tender of the United States or checks on banks convertible into cash on demand at full face value, subject to such deductions, charges or allowances as may be permitted by law; (c) "Employ" includes to suffer or to permit to work; (d) "Employer" means any individual, partnership, association, corporation, business trust, or any person or group of persons, hiring more than ten full-time employees or equivalent at any one location or place of business; provided, however, if an employer has less than ten full-time employees or equivalent at any one location or place of business but does a gross business of more than One Hundred Thousand Dollars ($100,000.00) annually, said employer shall not be exempt under the provisions of this act. This act shall not apply to employers subject to the Fair Labor Standards Act of 1938, as amended, and who are paying the minimum wage under the provisions of said act, nor to employers whose employees are exempt under paragraph (e) of this section.

§ 197.5Employees covered by actIn force
Every employer shall pay to each of his employees who have reached eighteen (18) years of age wages at a rate of not less than Two Dollars ($2.00) per hour. Regardless of other provisions of the Oklahoma Minimum Wage Act, every employee of the State of Oklahoma or any lessee or concessionaire thereof is hereby specifically covered by the Oklahoma Minimum Wage Act. § 197.16Tips, gratuities, meals or lodging - Credit forIn force
A. To compute the minimum wage of any employee coming within the purview of the Oklahoma Minimum Wage Act, credit toward the minimum required wage shall be given for any tips or gratuities, meals, or lodging received by the employee provided that the employer pays a cash wage of not less than what is required under 29 C.F.R., Section 531.50(a)(1). B. To compute the minimum wage of any employee coming within the purview of the Oklahoma Minimum Wage Act should the minimum wage exceed the current federal minimum wage, credit toward the minimum required wage may be given for any tips or gratuities, meals, or lodging received by the employee. § 197.9Findings by court - Double damages - Costs and attorneyIn force
fees - Defenses. Any employer who is found by a court of competent jurisdiction to have paid an employee wages less than those to which such employee is entitled, under or by virtue of this act, shall be liable to such employee for double the full amount of such wages, less any amount actually paid to such employee by the employer, and for court costs, and such reasonable attorney fees as may be allowed by the court, which in no case shall be less than One Hundred Dollars ($100.00). § 197.7Investigation of complaintsIn force
Upon verified complaint by an employee or former employee that an employer has violated the provisions of Section 197.5 of this title by failure to pay the minimum wage thereby established, the Commissioner, or his authorized representative, is hereby empowered to make such investigation as deemed necessary to ascertain the facts concerning such charge. The Commissioner shall have the power to administer oaths and affirmations, require sworn statements, certify to official acts, and issue subpoenas to compel the attendance of witnesses and the production of books, papers, correspondence memoranda, and other records deemed necessary as evidence in connection with the investigation of any alleged violation of Section 197.5 of this title. All information obtained by the Commissioner, or his duly authorized representatives, shall be confidential and, except for the finding of the need for additional wages, as provided by Section 197.8 of this title, and information which is necessarily disclosed in court proceedings provided by Section 197.9 or 197.10 of this title, such information shall not be disclosed to any person. § 197.8Findings - Payment of amount dueIn force
The Commissioner, after investigation, shall promptly make his finding in writing as to whether or not additional wages are due the employee. If the Commissioner finds that additional wages are due, ten percent (10%) of such amount due shall be added as penalty for such wage deficiency. The Commissioner shall mail said findings to the employer and to the employee by certified mail. Payment by the employer and acceptance by the employee of the amount so determined by the Commissioner shall absolve the employer of any further liability to the employee with respect to wages claimed by the employee for the period he was employed by the employer. § 160Mandated minimum wage - Minimum number of vacation or sickIn force
leave days. As a matter of public policy and due to an overriding state interest, the Legislature hereby occupies and preempts the entire field of legislation in this state touching in any way mandated minimum wage and employee benefits regarding mandatory minimum number of vacation or sick leave days. Notwithstanding any exemption from state statutes previously allowed for certain municipalities pursuant to Section 1-101 of Title 11 of the Oklahoma Statutes, no municipality or other political subdivision of this state shall establish a mandatory minimum number of vacation or sick leave days, whether paid or unpaid, or a minimum wage rate which an employer would be required to pay or grant employees. Any existing or future ordinances, orders or regulations in this field, except as may be specifically provided in this section, are null and void. The provisions of this section shall not affect the minimum number of vacation or sick leave days, whether paid or unpaid, authorized by a municipality for its employees as a benefit of employment.
