Louisiana Marriage and Divorce Records: Orleans Parish Is Different

Louisiana's marriage records system turns on one split: the state registry issues certified marriage copies for exactly one parish, Orleans. For a marriage licensed in any other parish, and for a divorce decree granted anywhere in the state, the parish Clerk of Court is the office to contact.

The Orleans Parish Split

Louisiana's marriage records system has an unusual shape, and the state's own request page makes it visible. Before it will take a request, LDH asks a single routing question: "Was the marriage license obtained in Orleans Parish or another Parish?" The two answers lead to two entirely different processes, because the state only holds one of them.

For Orleans Parish, LDH explains the rule and its time limit together: "Under Louisiana law, the Louisiana Vital Records Registry maintains Orleans Parish marriage records for 50 years. Orleans Parish marriage records older than 50 years are available at the Louisiana State Archives."

So the Orleans file is a rolling 50-year window. A marriage recorded in Orleans Parish in 2010 is at the Registry. One recorded in 1958 is at the State Archives in Baton Rouge, and every year another year's worth of records crosses that line.

For any other parish, the Clerk of Court that issued the marriage license holds the record and is the office that issues certified copies to the public. The state is not entirely outside the chain, though. R.S. 9:253(C) requires every clerk of court in Louisiana to forward one copy of each certificate of marriage filed with him to the state registrar of vital records on or before the fifteenth day of the following month, and R.S. 40:36(A) makes the state registrar the custodian of the vital records it receives. What the Orleans split really governs is where a member of the public can buy a certified copy, not whether the state ever sees the record. There is no publicly searchable statewide Louisiana marriage index to fall back on if you do not know the parish, which makes identifying the licensing parish the first real task in any Louisiana marriage records search.

Divorce Records: The Decree and the Divorce Certificate

Most states split a divorce into two documents: the court's decree, and a health-department certificate confirming the divorce happened. Louisiana has both, and the difference between them matters when you are told the state cannot help you.

LDH says so plainly: "The Louisiana Vital Records Registry can not issue a certified copy of a divorce decree. You must obtain a certified copy of a divorce decree by contacting the Clerk of Court in the parish where the divorce was granted."

Read that sentence closely, because it is narrower than it first looks. It says the Registry cannot issue the court's decree, which is a court record. It does not say the state holds nothing about the divorce. Under R.S. 40:57, for every divorce and every annulment decreed by any court, the clerk of court must prepare within ten days after the decree becomes final "a certificate of the decree on forms furnished by the state registrar," and forward those certificates to the state registrar by the fifteenth of each month. R.S. 40:40(16) then sets a fee of ten dollars for each certified copy of a divorce certificate, and R.S. 40:33(A) lists divorce judgments among the records the vital records registry is established to keep.

So Louisiana does have a state-level divorce certificate, and it is a different document from the decree. Which one you need depends on who is asking. A court, an opposing lawyer, or an immigration filing normally wants the certified decree, and only the parish Clerk of Court can issue that. An agency that simply needs confirmation the divorce happened may accept the state's divorce certificate. LDH's public-facing request pages are built around the decree question, so if the divorce certificate is what you want, ask the Vital Records Registry for it by name rather than reading the decree answer as the whole story.

The practical route for the decree is short. Identify the parish where the divorce was granted, contact that Clerk of Court, and ask for a certified copy of the judgment of divorce. Each clerk sets its own copy and certification fees, so ask for the current schedule rather than assuming a statewide figure. How to Order an Orleans Parish Marriage Copy

If the license came from Orleans Parish and the marriage is within the 50-year window, LDH offers three channels, as of August 2026.

In person, at the Vital Records Central Office at 1450 Poydras Street in New Orleans. By mail, to the Vital Records Registry at PO Box 60630. Or remotely, through the state's named vendor: "Use a major credit card to place internet, fax or telephone orders through VitalChek Network, an authorized service provider. There are additional fees when using this service provider or requesting expedited services."

On price, LDH's service fee schedule lists the Orleans Parish marriage certificate at $5.00 per copy, as of August 2026, on a fee basis it attributes to LSA-R.S. 40:40. Two add-ons apply. A $0.50 state charge "must be added to each mail-in or VitalChek order," and internet, phone, or kiosk orders placed through VitalChek carry an additional security fee. Walking in avoids both.

A note on sourcing, because it matters if you go looking yourself. LDH's older service-fee PDF is still reachable and still shows $5.00 per copy, but it carries a 2007 revision date. Use the current fee page rather than the PDF, and confirm before sending payment if any figure looks stale.

Older Orleans Records and Genealogy Research

Once an Orleans Parish marriage record passes the 50-year mark, it becomes an archives record rather than a vital record, and the access rules loosen accordingly.

The Louisiana State Archives maintains an Orleans Parish Marriage Records Index Database covering marriages more than 50 years from the end of the current calendar year, and it sells copies by mail: photocopies of marriage licenses at $5 each and certified copies at $10 each, as of August 2026. Researchers who visit the Erbon and Marie Wise Genealogical Library in person can do their own searching in the Archives' holdings.

Outside Orleans, historical marriage records generally stayed with the parish Clerk of Court, following the same custody pattern that applies to current records. Church records matter more in Louisiana than in most states for the earliest periods, since civil registration came later than sacramental recordkeeping in many parishes.

The Archives does not present an equivalent statewide divorce collection. For an older Louisiana divorce, the parish Clerk of Court remains the starting point.

Checking Whether Someone Is Married or Divorced

Louisiana's structure makes casual status checking genuinely difficult, and not because of a privacy rule. It is the fragmentation. With 64 parishes each issuing their own marriage and divorce records and no public statewide index to search, there is no single place to look.

If you have a legitimate personal reason to confirm a marital history and you know the parish, the Clerk of Court is the honest route. Two limits are worth stating. Commercial background-check products are unreliable for marriage and divorce data, and Louisiana's parish-level fragmentation makes them worse here than in most states; treat any result as a lead to verify with the clerk, not an answer. And none of this may be used to screen someone for employment, housing, or credit, which are regulated uses under the federal Fair Credit Reporting Act.
