Kansas E-Scooter Laws: Sidewalk, Helmet & Age Rules (2026)

Are e-scooters legal in Kansas?

Yes. Kansas has a dedicated statute, K.S.A. 8-15,113, but instead of writing scooter-specific speed limits, age rules, or equipment requirements, it takes a different approach: Section 8-15,113(b) states that "traffic regulations applicable to bicycles shall apply to electric-assisted scooters." Kansas essentially folds e-scooters into its existing bicycle law rather than building a parallel rulebook, which is a genuinely different regulatory model than Texas, Oklahoma, or Arkansas use in this same region.

The operative statute itself is short, just five subsections, and nothing else at the state level adds to it. There is no statewide minimum age, no statewide helmet requirement, and no license, registration, or insurance requirement anywhere in the text.

What counts as an e-scooter in Kansas

K.S.A. 8-126(h) defines an "electric-assisted scooter" as "every self-propelled vehicle, other than an electric-assisted bicycle, that has at least two wheels in contact with the ground, an electric motor, handlebars, a brake and a deck that is designed to be stood upon when riding." Notably, the definition itself does not set a wattage or maximum-speed cap the way many other states' statutes do; a device only needs to meet these structural features to count as a scooter under Kansas law.

Where you can ride

Section 8-15,113(a) makes it unlawful to operate an e-scooter on "any interstate, federal, or state highway." Subsection (d) clarifies that a scooter may still cross a federal or state highway, it just cannot travel along one.

Beyond that highway restriction, where you can ride follows Kansas's bicycle traffic rules under Section 8-15,113(b), since the statute applies those rules wholesale rather than setting separate scooter rules for roads, bike lanes, or sidewalks. Section 8-15,113(c) also lets a city or county governing body further restrict or prohibit scooter use on any public highway, street, or sidewalk within its jurisdiction, so the statewide bicycle-rule default can be narrowed locally.

Rider rules

• Age: No statewide minimum age. Kansas has not set one for e-scooters.
• Helmet: No statewide helmet requirement.
• License: Not required.
• Registration and insurance: Not required.

A bill, HB 2459, introduced in the 2025 to 2026 legislative session, would change this by setting a minimum age of 14 (barring operation by anyone 13 or under) and requiring a helmet for riders under 18. As of this page's last verification, that bill has only been referred to committee and has not passed; it is proposed legislation, not current Kansas law, and should not be treated as an existing rule.

Penalties

K.S.A. 8-15,113 does not set out its own statewide fine schedule beyond making highway operation and violations of a local restriction unlawful. Because the statute applies bicycle traffic regulations to scooters, a violation would generally be handled the way a comparable bicycle traffic violation is handled, and a city or county that has adopted its own restriction under Section 8-15,113(c) would enforce that under its own local penalty structure.

Enforcement in practice

No statewide e-scooter enforcement data was verified for this page. Because Kansas gives cities and counties room to add their own restrictions, and because Wichita in particular applies a materially different rule (an 18-plus age floor for shared scooters, when the state itself sets no age floor at all), enforcement expectations can vary meaningfully from one Kansas city to another. Enforcement patterns do not change what the state statute or a local ordinance actually requires.

Wichita e-scooter rules

Wichita's shared-scooter program, laid out directly on the city's own site, applies only to shared or company-operated scooters, not privately owned ones. Under the city's rules:

• Minimum age is 18, stricter than the state, which sets no age floor at all
• Sidewalk riding is not allowed; riders may use bike paths and roadways posted 35 mph or under
• No helmet, insurance, license, or registration is required
• Operating hours run until 9pm or dusk
• Riders may not ride more than two abreast, must keep one rider per scooter, and may not cling to another vehicle

Because these rules apply specifically to Wichita's shared-scooter program, they may not reach a privately owned scooter the same way; the city's page does not address private ownership directly.
