Dog Control Act 1996: Registration, Dangerous Dogs, and Owner Liability

The Dog Control Act 1996 makes registering a dog with your local council compulsory, gives councils the power to classify individual dogs as menacing or dangerous with legal conditions attached, and sets out an owner's liability if their dog attacks a person or animal.

Registering your dog is compulsory

Under the Dog Control Act 1996, every dog owner must register their dog with the local council once the dog is around three months old, and then renew that registration annually. Registration is how councils, and the national dog database that sits behind them, keep track of who owns which dog, which matters for reuniting lost dogs with owners and for tracking dogs that have been classified as menacing or dangerous.

Most dogs must also be microchipped the first time they are registered, with limited exceptions such as working farm dogs used for stock control. Failing to register a dog is an offence under the Act, and councils can issue an infringement fee for it.

Menacing and dangerous classifications

A council can classify an individual dog as menacing or dangerous under the Dog Control Act 1996, and each classification carries its own legal conditions.

A menacing classification can be applied either because of a specific dog's behaviour, for example if it has threatened or rushed at someone, or because it belongs to a breed or type the Act itself treats as menacing. A dog classified as menacing generally must be muzzled whenever it is in a public place, and a council can also require it to be neutered.

A dangerous classification is more serious and generally applies where a council has reason to believe a dog is a threat to public safety, including where an owner has been convicted of an offence connected to the dog's behaviour. A dog classified as dangerous generally must be muzzled and leashed in public, kept within a securely fenced part of the owner's property when at home, and neutered.

Owner liability if a dog attacks

The owner of a dog that attacks a person or another animal commits an offence under the Dog Control Act 1996. A standard attack carries a fine, and separately, the owner can also be held liable for the damage or injury the attack caused, on top of any criminal penalty.

Where an attack causes serious injury, the penalties step up significantly, including a potential prison term. If a court finds a dog has committed an attack, it is generally required to order the dog destroyed unless it is satisfied the circumstances were exceptional enough not to warrant that.

Your council's role

Day-to-day dog control, registration, responding to complaints, investigating attacks, and applying menacing or dangerous classifications, is carried out by your local council through its dog control officers, not by a national agency. If you have a problem with a neighbour's dog, your council is the first point of contact, alongside the police for a serious attack.

A law under review

On 21 March 2026, the government ordered a full review of the Dog Control Act 1996, following a series of serious dog attacks, including a fatal attack in Northland. The review, announced jointly by the Minister of Local Government, the Minister of Police, and the Minister for Conservation, is looking at legislative barriers that may be limiting councils, stronger enforcement powers for council dog control officers, penalties for non-compliant owners, and desexing obligations. Alongside the review, the government announced updated enforcement guidance for councils and funding support for dog desexing programmes. The review's outcome had not been settled at the time of writing, so the rules described above reflect the Act as it currently stands.
