Long Service Leave in Tasmania: Eligibility, Pro-Rata and TasBuild

The Long Service Leave Act 1976 (Tas) gives most Tasmanian employees 8⅔ weeks of paid leave after 10 years of continuous service, with a narrower set of pro-rata grounds from 7 to 10 years than most other states.

Who Qualifies for Long Service Leave in Tasmania

The Long Service Leave Act 1976 (Tas) is the general long service leave law for most private-sector employees in Tasmania who are not covered by a better entitlement under an award or agreement. It applies to full-time, part-time and most casual employees. Under section 8(2)(a)(i), an employee who completes 10 years of continuous service with the one employer becomes entitled to 8⅔ weeks, 8.6667 weeks, of paid leave. The Act contains separate, different provisions for mining employees, who should check the mining-specific rules rather than the general provisions described here. Where an award, enterprise agreement or contract provides a better long service leave entitlement than the Act, the more generous term applies, so the Act operates as a safety net rather than a ceiling.

How Much Leave Accrues and How It Grows in Tasmania

At the 10-year mark, a full-time Tasmanian employee holds 8⅔ weeks of paid long service leave. After that, a further 4⅓ weeks accrues for every additional 5 years of continuous service, the same structure used in New South Wales, Queensland and Western Australia. An employee who reaches 15 years therefore holds 13 weeks in total, and an employee at 20 years holds 17⅓ weeks. Leave accrued under the Act can be taken in a single block or, by agreement with the employer, split into shorter periods, and any leave that has accrued but not been taken remains payable if the employee later becomes entitled to a payout on termination.

Pro-Rata Long Service Leave on Termination in Tasmania

Tasmania's pro-rata rules use two separate bands, set out in section 8(2)(b) and section 8(3). Between 7 and 10 years of continuous service, a pro-rata payment is available only where the employee reaches retirement age, including a deemed retirement age recognised under section 8(3A), is terminated because an illness justifies ending the employment, resigns because of incapacity or a domestic or other pressing necessity, or is terminated by the employer for a reason other than serious and wilful misconduct. A plain resignation for reasons outside that list, before 10 years, does not attract a payout. Once an employee passes 10 years and starts building toward the next 5-year block, the position changes: a pro-rata payment for the partly-completed block becomes available on termination for any reason. Death is treated separately again, under a distinct 1/60th formula set out in section 9, rather than the pro-rata rule that applies to a living employee's termination.

What Counts as Continuous Service in Tasmania

Continuous employment generally means unbroken service with the same employer, though the Act treats some absences, including certain periods of leave, as not breaking continuity, while other kinds of breaks can affect the calculation depending on their length and cause. Casual employees can accrue long service leave in Tasmania where their engagement is otherwise regular, and a transfer of business between related or successive employers can, in defined circumstances, preserve continuity. Seasonal work, standing down without pay, and gaps between separate periods of engagement with the same employer are the situations most likely to raise a genuine question about whether service is continuous. An employee with a break in their service history should check their position directly with WorkSafe Tasmania rather than assume either outcome.

How Long Service Leave Pay Is Calculated in Tasmania

Long service leave in Tasmania is generally paid at the employee's ordinary rate of pay applying at the time the leave is taken, or at the date employment ends for a termination payment. Employees with pay that includes overtime, allowances or shift loadings that form part of ordinary pay should confirm with WorkSafe Tasmania how those components are treated, since the exact composition of "ordinary pay" can affect the final calculation. Part-time and casual employees are paid at a rate that reflects their ordinary hours, rather than being assumed to work full-time hours for the purpose of the calculation.

TasBuild and How Tasmania Compares

Outside the general Act, Tasmania's only portable long service leave scheme is TasBuild, covering the construction industry, unlike New South Wales, Victoria, Queensland and the ACT, which each run portable schemes reaching further into community services, cleaning or security work. Tasmania's 10-year qualifying period and 8⅔-week entitlement matches New South Wales, Queensland and Western Australia, but its list of early pro-rata grounds between 7 and 10 years is narrower and more itemised than Western Australia's broad test; compare it with Western Australia long service leave. Tasmania's separate death formula under section 9 is a feature shared structurally, though not numerically, with Victoria's separate death provision; see Victoria long service leave.
