We checked three weird Delaware claims from popular lists against the Delaware Code and, because two of the claims name a town, against the Rehoboth Beach and Lewes city codes, as of October 21, 2026. Two of the three turn out to be real, and both live in the same beach town's code. Our weird laws by state guide has the same check for every other state.
Weird laws in Delaware: the verdicts
Each claim below was checked against the Delaware code and, where it names a town, the local code. 3 claims checked.
The claim: Whispering during church services is illegal.
What the law says: This is a city ordinance, not Delaware state law. Rehoboth Beach's code bars disrupting a religious gathering 'by noise, talking or whispering' inside the place of worship or within 300 feet of it; violation is a civil offense. Delaware's statewide disorderly conduct law covers disturbing a lawful assembly but does not mention whispering.

Rehoboth Beach wrote the words itself
The pretend-sleeping claim sounds invented, but the phrase is in the ordinance. Rehoboth Beach Code § 198-30 says:
No person shall sleep, lie or occupy as a sleeping quarter, or under the guise of pretending to sleep on the boardwalk, any bench located on the boardwalk in any pavilion located at the end of any street or on any bench located on any street.
The section covers boardwalk benches, benches in the pavilions at street ends and benches on any street. A violation is declared a civil offense under chapter 126 of the city code, not a crime under state law.
Whispering near a place of worship
The church claim names no town, but the rule behind it is a Rehoboth Beach ordinance, § 198-23, titled Disturbing religious worship and lawful assemblies:
No person shall disrupt or disturb any congregation or assembly met for religious worship by noise, talking or whispering, or by rude or indecent behavior, or by profane language within their place of worship, or within 300 feet of the place of worship.
Violation is a civil offense, with the fine set by the city fee schedule. Delaware's statewide disorderly conduct law does cover disturbing a lawful assembly, but it does not mention whispering.
The two Rehoboth Beach rules share a date. Section 198-23 was added, and § 198-30 amended, on June 16, 2008, by the same ordinance, Ord. 0608-02.
Sagging pants in Lewes
No Delaware statute bans sagging pants, and no chapter of the Lewes City Code addresses clothing or dress, as of October 21, 2026. For the state, we searched the full Delaware Code for any rule on sagging pants or undergarments and read the section headings of the public order and decency offenses in Title 11, which include disorderly conduct, loitering and lewdness.
For the city, we read the chapter list of the Lewes City Code along with its peace-and-good-order chapter (chapter 140) and its beaches chapter (chapter 63).
