Maryland Marriage and Divorce Records: Verification vs the Decree

Maryland's Division of Vital Records issues two very different documents. For a marriage it issues a certificate, and only for marriages from 2007 forward. For a divorce it issues a verification, never the decree, which stays with the Circuit Court that granted it.

Divorce Records: Verification Is Not the Decree

Start here, because this is where most Maryland requests go wrong.

The decree, formally a Decree of Divorce and Annulment of Marriage, is the court's judgment. It contains the terms of the divorce: the dissolution itself, property division, alimony, custody, and support. DVR's own answer on this is flat: "Can I request a copy of a Decree of Divorce and Annulment from the Division of Vital Records? No. This must be requested from the Circuit Court that granted the decree." The divorce page repeats it: "A copy of the actual Decree of Divorce and Annulment of Marriage can only be obtained from the Circuit Court that granted the decree."

That division is written into the statute, not just into agency practice. Md. Code, Health-General section 4-206 makes the Secretary the custodian who must "collect, index, and safeguard the marriage, divorce, and annulment records that clerks of court file as provided by law," and then provides that "The Secretary may not provide a certified copy of any record of divorce or annulment." The same section adds that where the state file and the clerk's file disagree, "the record of the clerk of court shall be considered correct."

The verification is the health-agency product. It carries the names of the persons divorced, the county where the divorce took place, the date of the decree, and the type of divorce action, and that is the extent of it. A verification is often enough to satisfy a name change, a remarriage license, or a benefits administrator that wants proof a marriage ended. It is not enough for anything that turns on what the judge actually ordered.

So the question to answer before ordering is what the receiving agency wants. If it wants proof the divorce happened, DVR can help. If it wants the terms, write to the Clerk of the Circuit Court for the county where the case was heard. The Date Conflict in Maryland's Own Pages

Maryland publishes two different start dates for divorce verification, and both pages are live.

The dedicated divorce page states the rule in operative prose: "The Division of Vital Records (DVR) of the Maryland Department of Health (MDH) verifies divorces and annulments that occurred on or after January 1, 1992." The department's FAQ page, answering "For what years am I able to order a verification of divorce?", answers "2007 - Present."

We have opened both pages and the conflict is real, not a caching artifact. This page uses the 1992 figure, on the reasoning that the dedicated divorce page states the operative rule in detail while the FAQ is a summary, and that the 2007 date matches the marriage boundary in a way that suggests it may have been carried across. That is an inference rather than a resolution.

The practical consequence is narrow but it matters for divorces between 1992 and 2006. If yours falls in that window, call DVR and confirm coverage before paying, since the $12 certificate fee is not refunded when a record cannot be located. If DVR cannot verify it, the Circuit Court that granted the decree still can.

Marriage Records and the 2007 Boundary

DVR issues certified copies of marriage certificates for marriages that occurred on or after January 1, 2007. MDH states the boundary as an issuing rule and gives the alternative in the same breath: "For marriages performed before January 1, 2007, contact the circuit court of the Maryland county where the marriage took place, or the Maryland State Archives."

Read that as a limit on what DVR issues rather than as a claim that older Maryland marriages never reached the state. The statutes point the other way. Md. Code, Family Law section 2-503 directs that "each clerk shall send to the Secretary: a copy of the record of each marriage that the clerk licenses and records," with no start date attached, and Health-General section 4-217 still speaks of the Secretary providing a certified copy of "the certificate of a marriage performed after June 1, 1951." Whatever the state file contains for the earlier decades, the practical instruction from MDH is the one to follow: for a pre-2007 marriage, go to the clerk or the Archives.

For a pre-2007 Maryland marriage, then, the record to request is with the Clerk of the Circuit Court in the county, or in Baltimore City, where the license was issued. That is the office that issued the license in the first place, so it holds the original application and the recorded return. The Maryland State Archives is the other route, particularly for older records and for index searching, though its coverage and its indexes vary by county and era.

The license-issuing county is the piece of information you need, and Maryland ties it to the ceremony rather than to residence. Under Md. Code, Family Law section 2-401, a license is issued by "the clerk for the county in which the marriage is performed." So the license is obtained in the county where the ceremony will be performed, and the record is in that county's circuit court. Section 2-402 assumes the same arrangement when it lets parties who do not live in "the county where the marriage ceremony is to be performed" apply by sworn affidavit rather than appearing in person.

Who Can Order and What It Costs

Maryland restricts both record types to the same short list. DVR names it identically on the marriage and divorce pages: "Either spouse named on the record"; a "Representative of either spouse named on the record," which requires a notarized letter of permission; and an "Attorney representing either spouse named on the record," who must provide proof of representation.

That is narrower than many states. Adult children, siblings, and parents of a spouse are not on the list, so a request from one of them needs the notarized permission letter that turns them into a representative.

Fees, as of August 2026, are the same for both record types: $12.00 for a marriage certificate and $12.00 for a divorce verification. Online orders add a $13.00 internet processing charge, and expedited shipping is $20.00. One warning DVR prints and that people miss: "If a record cannot be located, the certificate fee is not refunded." A search you are unsure about is a $12 gamble, which is a reason to confirm the year range and the county first.

How to Order

Three channels are open, as of August 2026. Older Records and Genealogy Research

Because DVR issues certified marriage certificates only from 2007 forward, essentially all Maryland genealogy work on marriages runs through the Clerk of the Circuit Court and the Maryland State Archives. The Archives organizes its marriage guidance by county and publishes a series of statewide indexes, several of which are available online: separate statewide female and male indexes for 1951 to 1968, further indexes for 1969 to 1972, a 1973 to 1977 statewide index that also contains 1951 to 1972, statewide marriage indexes for 1978 to 1989, and a statewide index covering 1990 to 2011. Those statewide series are themselves a reminder that the 2007 date is about what DVR will issue today, not about when Maryland began keeping marriage records centrally.

Earlier material is thinner and more often searchroom-only, though some pre-1951 indexes are online, including an 1885 to 1900 female index. One structural detail from the Archives explains a lot of confusion about old Maryland records: the state "did not begin creating full-page (single-page) marriage certificates until 1914." Before that, the record is a register entry rather than a certificate, which is why an early request often produces something that does not look like the document people expect.

Divorce genealogy in Maryland is court work throughout. Circuit Court case files are the source, and older files may have been transferred to the Archives on the same retention schedule that applies to other court records.

Checking Whether Someone Is Married or Divorced

Maryland's eligibility list closes the vital-records route for anyone who is not a spouse, a documented representative, or an attorney. There is no lawful way to order a stranger's Maryland marriage certificate or divorce verification simply out of interest.

The court layer is the more realistic path, since Circuit Court civil case files, including divorce cases, are court records with their own access rules and case-search indexes. What a case search reveals is that a case exists, not the certified document, and individual files or documents may be shielded by court order. Two limits are worth stating. Commercial background-check products are unreliable for marriage and divorce data, since these records are county-scattered and unevenly digitized nationwide; treat any hit as a lead to verify with the clerk, not an answer. And none of this may be used to screen someone for employment, housing, or credit, which are regulated uses under the federal Fair Credit Reporting Act.
