What happened

Emanate Health operates a network of hospitals and medical facilities in the San Gabriel Valley area of Los Angeles County, California. A class action lawsuit filed in Los Angeles County Superior Court, case number 22STCV28142, alleges that Emanate Health's website ran the Meta Pixel, a tracking tool many websites embed to measure visitor activity and support advertising, and that this code picked up and sent information to Meta, the company that owns Facebook.

The concern is not a hacked database. It is website code allegedly capturing what a patient did on the site itself: logging into the patient portal, filling out an online form, or scheduling an appointment. The lawsuit alleges that activity, tied to a visitor's Meta account through browser identifiers, was transmitted to Meta without patients' knowledge or separate consent.

To understand why this matters on a hospital website specifically: the same pixel technology that helps a retailer see whether an ad led to a purchase can, on a health system's site, capture which department a page belongs to, what a patient typed into an appointment-request field, or that a specific browser just logged into a portal tied to a real patient account. None of that requires a name typed into a form to be identifying; a logged-in session and a device identifier can be enough to connect the activity back to a person.

Emanate Health has not admitted wrongdoing. Like most settlements of this kind, the agreement resolves the claims without either side proving its case at trial.

This case is part of a broader wave. Starting in 2022, federal regulators put hospitals on notice that tracking tools on patient-facing web pages can raise both privacy and data-security concerns.
