Missed Court in Georgia: What Happens Next
What Georgia law says can follow a missed court date: whether it is a separate crime, the driver’s license rule for traffic cases, what happens to bail, and the court’s own next steps. It runs in your browser and nothing is stored.
Pick the state, the kind of case and how the person was released to see what that state’s law says.
Georgia failure to appear law
In Georgia, missing a required court date after release can be charged as its own crime. The statute grades it by the kind of case:
- Released on any charge: bail jumping (grade not confirmed at the current official code). The Judicial Council of Georgia lists prosecution for bail jumping under O.C.G.A. 16-10-51 among the consequences of a missed court date. (Judicial Council of Georgia, Misdemeanor Bail Practices Bench Card (July 2024))
and the defendant may be prosecuted for bail jumping. OCGA §§ 16-10-51
When a date is missed, the court’s order is called a arrest warrant (Judicial Council of Georgia, Misdemeanor Bail Practices Bench Card (July 2024)).
Driver’s license after a missed traffic date in Georgia
After a missed traffic court date the court asks the Department of Driver Services to suspend the license until the case is resolved; since 2024 the clerk must first mail a notice giving 30 days to resolve or reschedule. (Georgia.gov: Prepare for a traffic violation court appearance)
If you miss your court date, the court will ask the Georgia Department of Driver Services to suspend your driver’s license until the case is resolved.
Note: 2024 HB 926 amended O.C.G.A. 17-6-11 and 40-5-56: the clerk mails a failure-to-appear notice and allows 30 days before forwarding the license number to DDS.
How to deal with a missed date in Georgia
Only the court that set the date can recall a warrant or give a new date. Contact that court’s clerk, or the lawyer or public defender on the case, who can ask the court to recall or quash the warrant.

- It does not check whether a warrant was issued in any case or whether anyone will be arrested.
- Whether a separate failure-to-appear charge is filed is the prosecutor’s decision; what happens to bail is the court’s.

- It collects nothing; your choices stay in your browser.
