Delaware failure to appear law
In Delaware, missing a required court date after release can be charged as its own crime. The statute grades it by the kind of case:
- Released on a felony charge: felony (up to 5 years, $5,000 fine, or both). Knowingly failing to appear after release on a felony charge is a felony punishable by up to 5 years, a $5,000 fine, or both. (11 Del. C. § 2113(c))
the defendant shall be guilty of a felony and punished by imprisonment not to exceed 5 years, or a fine of $5,000, or both
Note: Version effective until Feb. 1, 2027; from Feb. 1, 2027 the felony-release offense becomes a class E felony (85 Del. Laws c. 324). - Released on a misdemeanor charge: up to 1 year, $500 fine, or both. Knowingly failing to appear after release on a misdemeanor charge is punishable by a fine of up to $500, up to 1 year in prison, or both. (11 Del. C. § 2113(c))
the defendant shall be fined not more than $500, or imprisoned not more than 1 year, or both
Note: Version effective until Feb. 1, 2027; from Feb. 1, 2027 the misdemeanor-release offense becomes a class A misdemeanor (85 Del. Laws c. 324).
