Antecedentes Penales in Spain: What Shows, Who Sees It, How to Get the Certificate (2026)
The phrase «antecedentes penales» carries more fear than information. What actually creates a Spanish criminal record is narrow, what the certificate reveals is narrower than people assume, and the whole system points toward eventual erasure. What creates the record, and what does not
An entry in the Registro Central de Penados requires a firm criminal conviction: a sentence no longer open to appeal. Nothing else qualifies. A detention, an investigation as investigado, a case that was archived, an acquittal: none of these creates antecedentes penales, whatever anxiety the process caused.
The modern trap runs the other way. Since the 2015 reform abolished the old faltas, minor offences are delitos leves, and a conviction for one does create antecedentes. The penalties of that tier contain no prison at all (small fines, localización permanente, short community work, per art. 33.4 CP), but the record consequence is real, though it also clears fastest.
What the certificate actually says
The certificado de antecedentes penales is, in the ministry's own words, the document that accredits «la carencia o existencia de antecedentes penales que constan en el Registro Central de Penados en la fecha que son expedidos». Two consequences follow from that definition.
First, it is a snapshot: it reflects the register on the issue date, so a conviction cancelled last month simply no longer appears. Second, it is binary in practice for most uses: employers and administrations receive what the register currently holds against you, not your procedural history.
The register itself is not public. Art. 136.4 CP restricts it expressly: certificates issue only with the limits and guarantees of the applicable rules, and only judges and courts obtain certificates covering everything, including cancelled entries, which must be expressly marked as cancelled.
The request, and the one special case
The certificate is requested from the Ministerio de Justicia (the ministry's page above is the official entry point), by the person concerned or an authorised representative, and it is routinely demanded for oposiciones, licences, some employers and immigration files abroad.
One case has its own rule, stated by the ministry itself: the ordinary certificate does not qualify you to work with minors. Any role with regular contact with children requires the separate Certificado de Delitos de Naturaleza Sexual, the only document valid for that purpose. An employer in that sector asking for the ordinary certificate is asking for the wrong paper.
The files that are NOT antecedentes penales
Antecedentes policiales: the police's operational records of identifications, detentions and atestados. They exist independently of any conviction, never appear on the criminal-record certificate, and are governed by police-data rules with their own cancellation regime.
DGT annotations: firm traffic sanctions live in the traffic registry and clear three years after compliance. An administrative multa, however painful, is not a criminal record.
The record is designed to end
Spanish law treats the criminal record as temporary by design: fixed clocks of six months to ten years, counted from the day after the sentence is extinguished and conditioned on not reoffending, give a right to cancellation, applied even de oficio.
