New Zealand Criminal Records Law: the Clean Slate Scheme

A criminal conviction can follow someone long after the sentence is served, but New Zealand law hides many older convictions automatically. This section explains the Clean Slate scheme and how criminal records work.

This is general information about New Zealand law, not legal advice. For your own situation, consult a lawyer or your local Community Law centre.

The Clean Slate scheme

The Criminal Records (Clean Slate) Act 2004 conceals eligible convictions automatically for people who meet all of its conditions, most importantly seven years conviction-free, no prison sentence ever, and no specified serious offence. It is not something a person applies for, and it is not something anyone grants; it happens by law once the conditions are met. For how a criminal record connects to everyday matters like jury service, see the everyday law section, and for the wider picture the New Zealand law guide.

Frequently Asked Questions

Do I have to apply for the Clean Slate scheme in New Zealand?

No. Concealment under the Criminal Records (Clean Slate) Act 2004 is automatic once you meet every condition, so there is nothing to apply for and no one grants it. If you are eligible, your convictions are simply not disclosed on a standard criminal record check. Any service that offers to clear your record for a fee is not doing anything the law does not already do for free.
