Come si richiede il casellario giudiziale?

You can request your own certificato del casellario giudiziale in person at the Ufficio locale del casellario inside any Procura della Repubblica with a valid ID, by post with a copy of your ID, or by booking online at certificaticasellario.giustizia.it with SPID, CIE or CNS and then collecting the certificate in person. You do not need to give a reason for the request.

How much does the casellario giudiziale certificate cost?

The ordinary certificate costs 19,92 euro. Requesting it with urgency, meaning same day or next working day issuance, adds 3,92 euro, bringing the total to 23,84 euro. Payment is made in person using marche da bollo, revenue stamps.

How long is the certificate valid?

The certificate is valid for 6 months from its date of issue, regardless of which channel was used to request it.

Can I get the casellario giudiziale certificate entirely online?

Not yet, as of the verification date on this page. The certificaticasellario.giustizia.it portal lets you book a certificate online using SPID, CIE or CNS, but the document itself is still collected in person at the counter of the local casellario office, and pagoPA online payment is not currently available for this certificate. Check the portal directly for the current state of the service, since online services in this area have been expanding.

Can an employer ask me for my criminal record certificate?

A private employer does not generally have the right to request your casellario giudiziale directly. The law authorises a private employer to request it directly from the casellario office, using its own form, only when hiring for a role involving direct and regular contact with minors. Outside that case, an employer has no comparable statutory basis to request the certificate from the issuing office itself.

What is the difference between the casellario giudiziale and the certificato dei carichi pendenti?

The certificato del casellario giudiziale (art. 24, DPR 313/2002) shows convictions and certain other judicial measures already on record. The certificato dei carichi pendenti (art. 27, DPR 313/2002) is a separate document covering criminal proceedings that are still open. Someone asked to prove they have no pending charges needs the second document, not the first.

Does every past conviction appear on the certificate?

No. Art. 24 of DPR 313/2002 excludes several categories by law, among them convictions for which rehabilitation was granted and not later revoked, convictions for contravvenzioni punished only by a fine, and cases where a messa alla prova concluded successfully. The certificate is not a complete transcript of every past event.

Can I use a self-declaration instead of the actual certificate?

In dealings with a public administration or a manager of a public service, art. 46, lettera aa), of DPR 445/2000 lets you sign a dichiarazione sostitutiva stating you have no criminal convictions, instead of producing the certificate. That route generally does not apply to a private employer. Signing a false declaration is a criminal matter under art. 76 of the same decree.
