New Jersey Bill of Sale Requirements
New Jersey does not strictly require a separate bill of sale to title a vehicle, but one is strongly recommended as proof of the sale. Notarization is not required for a New Jersey vehicle bill of sale.
- For a normal NJ private sale, titling is completed in person at an MVC vehicle center by submitting the properly assigned title plus the Vehicle Registration Application (Form BA-49); the assigned title records the sale price and odometer reading, so a bill of sale is not part of the agency titling submission for a standard NJ-titled used car.
- NJ MVC's 'Transferring Ownership of a Vehicle' guidance does direct the seller to provide the buyer a bill of sale containing the buyer's name and address, the date of sale, the mileage/odometer reading, and the sale price. A bill of sale is therefore expected in an ordinary private sale, even though it is not the document used to obtain the title.
- NJ MVC does NOT publish an official standalone bill-of-sale form. The Universal Title Application (OS/SS-UTA) is a title application (it replaces OS/SS-7, OS/SS-27, etc.), and the BA-49 is the Vehicle Registration Application — neither is a bill of sale.
- Notarization is NOT required for a standard New Jersey vehicle bill of sale or for the ordinary title transfer. The MVC requires notarization only for a Power of Attorney (when someone signs on another's behalf) or for a seller's statement when a vehicle comes from a state that does not issue titles.
- A bill of sale is specifically required when titling a non-titled vehicle (for example, one purchased at auction), submitted together with the last previously issued registration document. Title transfer must be completed within 10 working days of the sale to avoid a $25 penalty, and the transaction must be done in person at an MVC agency.
Federal law (49 CFR Part 580) requires the transferor to disclose the vehicle's odometer reading at transfer of ownership. Under the 2021 rule change, the disclosure requirement now runs for 20 years for model-year 2011 and later vehicles (a vehicle becomes exempt only when transferred 20+ years after January 1 of its designated model year). NJ incorporates this: the seller must provide an accurate odometer reading at the time of sale, and in a NJ private sale the mileage is recorded on the assigned title (and on any bill of sale used). If the reading is known to be inaccurate, the seller must note that the actual mileage differs and is unknown/an estimate.
